Lodge Terms of Use - Please Review
CHECK IN/OUT - Check in time is after 3pm and check-out is 1pm. Upon arrival, all members of a group must sign in electronically, acknowledging that they have read and understand the Lodge Terms of Use. "
MAXIMUM OCCUPANCY- The maximum number of guests is limited to 12 people except as specifically arranged with the Owner and incrementally paid for. On the 3rd floor, due to structural limitations it is imperative that no more than 8 people at a time be there at the same time.
SMOKING - The Lodge and property is a non-smoking facility. Unfortunately we have found many smokers leave cigarette butts in the yard or beach so we went completely non-smoking.
PETS - Pets are NOT permitted under any conditions. Violation is grounds for immediate termination with no refunds of rent or deposit.
RESERVATION/DAMAGE DEPOSIT- A damage deposit of $500 USD has been provided by your group organizer. The deposit is fully refundable within 14 days of departure, provided the following provisions are met:
- No damage is done to the premises or its contents, beyond normal wear and tear.
Report any damage or broken dishware that occurred
- Garbage and recyclables are placed outside the kitchen door in back of the Lodge
and soiled dishes are cleaned and put back where they came from
- The Lodge is left locked
- No linens are lost or damaged
- Any watercraft or beach equipment used is returned in like condition
- Place sheets and pillowcases on the floor by the bed in each room, blankets on bed
- The BBQ grill, oven and refrigerator are left clean and in good order
- Floors are swept and any spills cleaned up
- The renter is not evicted by the owner (or representative of
the owner), or local law enforcement.
QUIET TIME - Quiet time for outdoor activities is 10pm. Please respect the neighbors by not making any unusually loud noises.
COOKING - Place grease from cooking in the can provided in the freezer. Do not pour down the drain or dispose outside as it may attract bears or other wildlife.
RECYCLING - Please separate glass, aluminum and cardboard recycling into provided bins. Garbage and recycling should be placed in the garbage cans outside the kitchen door in back of the lodge.
LANDSCAPING - Please do not drive on the grass as the sprinkler system could be damaged. If towing a trailer you can turn around by pulling around the front of the small house. Please don’t move rocks (or allow kids to) at the beach. Please don’t throw rocks into the pond by the lodge.
DOORS - In order to keep bugs, flies and any other creatures out of the Lodge, keep doors closed at all times. Instruct children to do the same.
HEATING/AIR CONDITIONING - There are 4 heat pumps plus a heated floor providing heating and cooling at the lodge. Two of them control temperature in the upstairs bedrooms, one for each side (north and south) of the lodge. The thermostats for these zones are in the 4th (top) floor, one on the north wall and the other one the south wall. Please only use the air conditioning if people are in the rooms. If air conditioning is used for the bedrooms, all the bedroom doors and windows must be closed. If this is not done the heat pumps can freeze up with condensation, and it costs $70/hr for a technician to come and resolve the problem.
TELEPHONE – We recommend using your cell phone to make calls via wifi. However a phone shared with the Owner’s residence is provided in the Lodge and Tenant may make unlimited calls within the local exchanges.
LINENS/TOWELS – Your stay includes a one-time linen/towel setup. Lodge towels and linens cannot be taken outside the Lodge. Please use your personal beach towels outside. Please use the clothesline under the deck for wet towels and swimsuits.
CARE OF PROPERTY - Tenant is expected to care for the property as if it were their own. Rearranging of furniture is not permitted. The Lodge must be left the same as you found it. Upon check in, any significant existing damage will be mutually noted by Tenant and Owner. Tenant will be responsible for damage that occurs during their stay beyond normal wear and tear.
CHILDREN – Children and minors must be supervised at all times both inside and outside the Lodge. The Lodge and property contain features that may be easily damaged and/or unsuitable for children that adults must communicate with children about and establish rules for. There is no swimming allowed in the pond, and Tenant agrees to use extreme caution when walking along its banks and will not let children venture out unattended. The pond is 5 feet deep. Precautions must be taken to avoid injury from the natural wildlife here such as deer, snakes, spiders, etc. There are large wild animals in the thousands of acres behind the lodge. Children should be accompanied by an adult when crossing the road to the lake. No lifeguards are provided at Palmer Lake.
ALL RENTALS ARE TO FAMILIES AND RESPONSIBLE ADULTS ONLY – The average age of a party must be 25 years or more. The property is patrolled on a regular basis. Tenant acknowledges that he/she will personally occupy the property for the entire rental period and will not sublet any portion of the property. Tenant agrees that the premises shall not be used for any illegal or unlawful purpose. Occupancy and use of the premises and common areas in such a fashion that disturbs or offends neighboring houses shall be deemed grounds for termination.
CANCELLATIONS – Cancellation or early departure does not warrant any refund of rent or deposit.
VISITOR POLICY – Tenants may receive guests at the Lodge for a maximum period of 3 hours per day, up to a total maximum count of 21 people including Tenants staying at the Lodge and guests unless otherwise specifically arranged for in advance with the Owner.
OWNER’S LIABILITY –The Tenant agrees to release and indemnify the Owner from and against all liability, should anyone be injured upon the premises during the term of the rental, resulting from any cause whatsoever. Owner bears no responsibility for injury of anyone in Tenant’s party, regardless of whether they signed in upon Check In. In the event that the Owner is unable to deliver said property to Tenant under this rental agreement prior to occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, Tenant hereby agrees that the Owner’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by Tenant.
USE OF BOATS / WATERCRAFT – The Tenant’s stay at the lodge may include the complimentary use of an assortment of watercraft, such as a fishing boat, paddle boat and kayak. Tenant acknowledges his/her sole responsibility for the safe and proper operation of the craft; and for the safety and welfare of other boaters, persons, and passengers. The Owner makes no representations as to the condition or capability of said watercraft. Life jackets must be worn at all times when on the water. Palmer lake is approx 60 feet deep. The lake is subject to sudden changes with wind conditions. Watercraft at the beach must be secured or they may drift away. The Tenant agrees to indemnify and hold harmless the Owner from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said watercraft.
