I, the Adopter, desire to adopt an animal with the assistance of Bonaparte’s Retreat. In consideration of these services and in consideration of being given the opportunity by Bonaparte’s Retreat to adopt an animal, I acknowledge and agree as follows: The animal is being adopted by me is a home companion for myself and will not be sold, adopted, or given to another. The animal will not serve as a guard dog and will live inside my home and not outdoors. Further, I understand that I am solely responsible for the animal in my care. I understand that Bonaparte’s Retreat offers no warranty or guarantee as to any animal’s disposition, physical condition, health or ability to interact with any person or other animal. I understand that there are certain risks inherent in interacting with animals, including, but not limited to, exposure to infection, bacteria, and allergic reactions. I fully understand all risks associated with and inherent to my caring for an animal and fully assume said risks for injury, loss, or damages of any kind resulting from such risks involved in any associated activities. I hereby agree to release and forever discharge and hold harmless Bonaparte’s Retreat, and its directors, officers, employees, agents, volunteers, invitees, sponsors, donors, and all other persons or entities whomsoever from any and all claims (including liabilities, suits, or expenses), whether known or unknown, including claims caused or alleged to be caused by the negligence of Bonaparte’s Retreat or its directors, officers, employees, agents or otherwise, for injury, damage, death or other loss to me, my property, or the persons and property of third persons, in any way connected with adoption of an animal. I understand and hereby agree to waive all claims I may have against Bonaparte’s Retreat and agree that neither I nor anyone acting on my behalf will make a claim or file a lawsuit against Bonaparte’s Retreat. I agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee and that it shall be governed by and interpreted in accordance with the State of Tennessee. I agree that in the event that any clause or provision of this release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable. I, as the Adopter, agree to take all reasonably necessary precautions to prevent against damage and injury by or to the animal. I understand and agree that I am responsible for the safety of the animal that comes into my care and for the safety of other animals and people with whom the animal comes into contact. Further, I promise to take adequate care of the animal in a humane manner and to be a responsible animal guardian. This includes supplying adequate food, water, shelter, attention, and medical care as needed by an animal of this size and condition. I understand the animals must be kept on a leash AT ALL TIMES when in an unfenced or unenclosed area, even when hiking, or walking from my house to a car. Many rescue animals are escape artists, especially in a new environment or when left alone. I will be aware and careful. I give Bonaparte’s Retreat the right to inspect my home or call my home at any reasonable time, without notice, to assure that the dog is being properly treated and cared for. If I decide I am no longer willing or able to care for the animal, I will notify Bonaparte’s Retreat. I agree to keep Bonaparte’s Retreat informed of my current home address and phone number.
