This agreement constitutes an order for wedding photography. Clara Williams agrees to provide photography services at the requested times and locations as discussed.
A fee of $2800.00 (plus tax) is agreed upon, which will include up to ten consecutive hours of wedding-day photographic coverage by Clara Williams and a second shooter, a USB of high-resolution, edited images, along with a written release allowing the printing of the images, a proof book, and an online gallery of photos. This also includes an engagement photography session, with the high-resolution, edited images delivered via digital download along with a print release.
This fee also covers Clara Williams's travel expenses to the event.
1 | BOOKING POLICY & RETAINER
The $1000.00 wedding retainer must be paid upon selection of wedding package to secure your desired date. The wedding agreement (which includes the model releases and copyright policy) must also be signed. Once all of these steps are completed, the booking process is finished and your date will be secured. Clara Williams will not schedule a wedding commission until the wedding retainer is paid and the paperwork is properly completed. Clara Williams will collect the retainer immediately upon selecting the wedding package. The wedding retainer is non-refundable. Clara Williams accepts payments via Paypal online invoice or personal check or money order. The retainer will be applied to your final balance.
The remaining balance must be paid two weeks before the wedding date.
2 | CANCELLATION POLICY
Clients must give a 30 day notice of cancellation. The $1000.00 retainer is non-refundable in the event of cancellation.
3 | LOCATION(S) & TRAVEL
Clara Williams will travel for your wedding. If there are any costs/fees associated with the location the client has chosen for their wedding, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Clara Williams requires that travel feels are paid by the client for herself & her assistant. These fees include expenses such as meals, gasoline, air travel, hotel, car rental fees, etc. Clara Williams has set fees in place for each of these expenses and client agrees to pay the fees if Clara Williams must travel for a session. Clara Williams will travel up to 30 minutes (one way) from her office, without charging travel fees.
4 | COOPERATION
Weather conditions, time restrictions, lighting conditions and lack of subject cooperation are just some of the factors that make wedding photography an imperfect science. Please be assured that I am anxious to give you the best possible wedding photography, but good photography does not happen automatically. It will take your cooperation and teamwork to help me.
The parties agree to positive cooperation and communication for the best possible image results. Clara Williams is not responsible for key individuals’ failure to be present or to cooperate during photographing, neither for missed images due to details not revealed to Clara Williams or for a subject’s failure to cooperate. The Client is responsible for the conduct of those being photographed.
Clara Williams welcomes the Client to express their preferences with regard to the wedding photography. However, the Client agrees to let Clara Williams choose the best photographic methods and abide by her decision.
5 | PHOTOGRAPHIC STANDARDS
Clara Williams will select the images that best represent her photographic standards. Any unsatisfactory images will be deleted. Only the final images will be available for viewing. All final images will be fully edited, as Clara Williams does not show unedited images.
6 | SALES & PAYMENTS
Prints and products may be purchased through your online gallery. All payments for prints/products are due at the time of ordering. Due to the custom nature of the products, all sales are final, and refunds are unavailable. All sales are subject to 7% Nebraska sales tax. Prints and products are purchased through your online gallery.
7 | DIGITAL FILES & COPYRIGHT
If your package includes digital files, you will receive a limited print release along with your USB of images. This print release allows you to display the images, print the images, upload, email, or electronically transfer the images or files, and publish the images on personal websites or social media websites.
All images remain copyright of Clara Williams and may not be reproduced without written consent from Clara Williams. All images are also protected by Federal Copyright Law. Scanned or reproduced images are both illegal and a degradation of the original image quality. The Photographer is the only one who can crop or modify any image produced as a result of this session.
8 | IMAGE ARCHIVAL
Clara Williams will archive your images 90 days following your wedding. After 90 days, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. There will be a $150 fee for archived image retrieval.
9| LIABILITY & DAMAGE
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits and image files upon receipt.
10 | PROFESSIONALISM & EXCLUSIVITY
Clara Williams will not tolerate verbally or physically abusive behavior, nor will she share her time or compete with guest photographers for the attention of the subjects. If such conduct occurs, it will result in the early or immediate departure of the photographer. The client understands that in such an event, no refunds will be granted. It is understood that Clara Williams will act as the sole and exclusive photographer.
11 | ASSISTANTS & ASSOCIATE PHOTOGRAPHERS
Clara Williams travels with an assistant/associate photographer to all commissioned weddings. Clara Williams’ assistant is trained to help with posing and organization, and should be treated with respect. Any verbally or physically abusive behavior towards the associate photographer will result in immediate dismissal of all commissioned wedding photography parties.
12 | MEALS
If you choose to serve a meal to your guests, Clara Williams requires that you provide herself and associate photographer with the same meal. Meals are to be provided at the time the clients are eating. The caterer may not require that the Photographer(s) should be made to wait until all the guests have eaten or been served before the Photographer is provided food or that the Photographer(s) be required to eat in a separate room. The Photographer(s) must be able to eat as near to the time as the client eats to ensure that the Photographer(s) can be finished eating before the before the toasts or
any other part of the reception occurs that should be photographed. If the meal is served buffet style, the Photographer(s) will be served following the bridal party.
13 | LIMIT OF LIABILITY & NON-GUARANTEE
In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Clara Williams will make every effort to secure a replacement photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.
Clara Williams takes the utmost care with respect to exposure, transportation and processing of photographs. However, in the unlikely event of the client’s photographs being lost, stolen or destroyed for reasons within or beyond Clara Williams’ control, the latter’s liability is limited to the return of all payments received for the wedding package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The limit of liability shall also apply to photographs/images not produced due to un-cooperation.
Although every possible care will be taken to produce photographs, Clara Williams cannot place an unconditional guarantee on the above. Clara Williams will not be held responsible for any ruined photographs due to others (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Clara Williams’ control. The performance of this contract on behalf of Clara Williams shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond her control.
14| MODEL RELEASE
The client hereby assigns and grants Clara Williams and her legal representatives the irrevocable and unrestricted right to use and publish photographs of the client/subjects or in which the client/subjects may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. They hereby releases Clara Williams and its legal representatives and from all claims and liability relating to said photographs. It is agreed that Clara Williams may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, store fronts, window displays, studio display, television advertising, magazine advertising and any other purpose thought proper by Clara Williams.
15 | ORDER DELIVERY
The client understands that all orders may take up to six weeks for delivery of images.
