PAYMENT PLAN:

Client and photographer agree to a payment plan for: A custom package that includes the following 3 sessions:

(1) Pregnancy announcment session. 1 hour session, 15 high resolution images delivered via digital download.

(2) Maternity session: 1 hour session, 15 high resolution images delivered via digital download.

(3) newborn session: 2-3 hour session, 15 high resolution images delivered via digital download

Payments will be as follows:

Payment 1: $413.33 due at time of booking (July 30th)

Payment 2: $413.33 due December 6th

Payment 3: $413.33 due January 15th

Client understands that full payment is due before services are carried out, and that failure to pay in full can result in cancelation of session.

I understand and agree to the payment plan

Entire Agreement: This agreement contains the entire understanding between Sarah Savage Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have the waiver in writing.

Reservation: A signed contract and the 50% non-refundable retainer fee are required to reserve your date and the specified coverage.

Tardiness/Cancellations: In the event that the client is late to the appointment time set, the client’s session will still be for the same scheduled ending time. In the event of cancelation, Sarah Savage Photography must be informed at least 24 hours before the designated session time. If canceling within 24 hours of your session the 50% retainer fee is non-transferable to a rescheduling date; it shall be liquidated damages to Sarah Savage Photography.

Proofing Galleries: Once the online gallery is emailed to you, you will have 7 days to select your final images. After the 7 days the online gallery will expire and there will be a $100 fee to reopen the gallery for another 7 days.

It is up to the discretion of Sarah Savage Photography to select the images for proofing in an online gallery. The number of images in the clients proofing gallery will depend on the package purchased. Remaining images taken by Sarah Savage Photography, that are not included in the proofing gallery, will not be shown or distributed. Sarah Savage Photography does not guarantee that all angles, poses, or locations taken during the session will be included in the proofing gallery.

Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Sarah Savage Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Sarah Savage Photography beforehand. Failure to cooperate by any of the subjects included in this session, may result in a fewer number of images in the online proofing gallery.

Sarah Savage Photography reserves the right to end a session at any time if she feels threatened or uncomfortable because of the actions of any person present at the session. If this occurs, there will be no refunds given and these sessions will not be eligible for future bookings.

Model Release: The client hereby grants Sarah Savage Photography, the irrevocable and unrestricted right to use and publish photographs of the client, and any persons that may be photographed, in the contracted session. This includes for the use in editorial, trade, advertising, photography competitions and any other purpose and in any manner and medium. The client hereby releases Sarah Savage Photography and its legal representatives and assigns from all claims and liability relation to said photographs.

Copyrights: The photographs produced by Sarah Savage Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Sarah Savage Photography’s explicit written permission. It is against Federal Copyright Law to edit or transform photos by Sarah Savage Photography in ANY way. If displayed on social networking sites, photos must say photos by Sarah Savage Photography somewhere visible on the photo or post.

The photographic images are the property of the client for personal use only. A print release will be given to clients at time of image download, for the purpose of personal prints.

If a client's photo is requested to be used in any print or online publication, they will discuss this with Sarah Savage Photography. Sarah Savage Photography grants client limited rights to use the images in marketing materials with specifications that photo by Sarah Savage Photography is listed on the image/article. If a client requests to use the image in the distribution of products such as but are not limited to posters, clothing, etc. a 5% compensation rate of the total number of sales will apply unless otherwise agreed upon in writing.

Limit of Liability: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, responsibility and liability is limited to the return of all payments received for the event/session package. Sarah Savage Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Sarah Savage Photography’s control, Sarah Savage Photography liability is limited to the return of all payments received for the event/session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Sarah Savage Photography may not be held responsible for any injuries that may happen during a session.

Weather Policy: In the event of weather conditions that are out of our control, sessions are only eligible for reschedule. No refunds will be given for weather related issues. Due to sensitivity of photography equipment, it is up to the photographer’s discretion to reschedule a session due to the weather.

Props: Any personal props that the client wants included in a session must be discussed and agreed upon at the time of booking. Sarah Savage Photography does not guarantee that props brought by the client will be used if not agreed upon before the session.

Appearance/Outfits: In the event that the client would like additional photos due to appearance out of our control (hair/makeup/clothing, etc.), the client will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.

Sarah Savage Photography asks that clients avoid wearing small prints such as thin stripes or tiny polka dots. Patterns like this can cause an error with digital cameras and will result in distortion of the clothing. If the client wears such a print, Sarah Savage Photography is not responsible for images that have this resulting distortion.

Although there are no additional fees for outfit changes, the amount of time it takes to change into those outfits does count towards the total amount of the session time.

Location Access and Fees: If the client wants a specific location that charges for access, the client will be responsible to cover all fees associated with photography permits from said location, parking, and entry.

Breach of Contract: In the event of a breach of contract the 50% retainer will be non-refundable and non-transferable. It shall be liquidated damages to Sarah Savage Photography. The client shall also be responsible for payment of any additional material charges or fees incurred by Sarah Savage Photography for the purpose of the agreed upon session.

Completion Schedule: Editing and gallery delivery takes approximately two-four weeks, but may take longer.

Packages: Upon signing this contract the client understands, and accepts the package, which is being purchased.

Studio Sessions: Please note that all studio sessions are taken in Sarah Savage’s home and that two dogs reside in this location. The dogs will be secured at all times while clients are present. IF CLIENT(S) HAVE PET ALLERGIES it is the responsibility of the client to inform Sarah Savage Photography before signing this contract so that necessary arrangements can be made.
