(includes bidder# + 1 guest pass)Seller fee: 6%Buyer fee: 8%Photocopy of title (front & back) or tag receipt must be submitted in advance with auction entry. The originals must be submitted when car enters Auction Sale and must be titled to seller, unless the seller is a Motor Vehicle Dealer. Vehicle mileage must be recorded in space provided.By submitting this form, You (seller) agree to the Terms and Conditions of consigning my vehicle with L. W. Benton Auction Company. In addition, I understand that I will be liable for the balance of the full registration fee and the minimum commission for removing my consigned vehicle from the site of any L. W. Benton Auction before the auction for any reason.Additional Information: Please describe your vehicle fairly and accurately, as this information will be used in advertising and on the auction block. Be honest and avoid potential problems by fair representations.If you have multiple vehicles to consign, please feel out the complete form for the first vehicle, then add just your full name and vehicle information for each additional vehicle. For Questions:  Please contact Richard at 478-973-0550Exclusive right to sell     I, the undersigned (hereinafter known as the seller), grant L.W. Benton Company, Inc. (hereinafter known as the auctioneer) the ex¬clusive right to sell items listed or otherwise delivered to the auc¬tioneer at a public auction until the outlined sale date. No item or items may be removed, withdrawn, or sold before the aforementioned sale date without the prior, expressed written consent of the auctioneer.  If items are removed, withdrawn, or sold, auctioneer shall receive full commission on the item as determined by a certified appraiser.  The auctioneer also reserves the right to advertise for, display and catalog the items without notifying the seller.Commission and settlement     The seller agrees that a commission, as stated above, of the auction pro¬ceeds will be paid to the auctioneer. The seller further agrees that all expenses incurred for the advertisement, promotion and of conducting said auction should be first paid from the proceeds realized from said auction before the payment and satisfaction of any liens or encumbrances.  Auction settlement of collect¬ed funds will occur not more than 20 business days after the auc¬tion date. Please allow 14-20 working days from the auction date for checks to arrive.  A buyer’s premium of 8% will be paid by the buyers and will be collected by the auctioneer as payment for services rendered unless otherwise noted.  Merchandise will be auctioned “as is” and in the condition in which it is received, i.e. if consigned unassembled the item will be sold unassembled. It is the responsibility of the consigner to provide any special description of the merchandise or its condition at the time of consignment.Buyer default   In the event a buyer does not fulfill their obligation to pay for the items from the auction, LWBC and/or its agents will make every effort to collect said payments and encourage timely removal of items, however, LWBC and/or its agents cannot be responsible for the actions of the buyers.  Under these conditions, settlement shall not take place until full payment is collected from the buyer or seller choses to take back possession of the item.  If LWBC makes payment to a seller for item(s) that a buyer’s payment becomes default on, the seller is responsible for repayment to L.W. Benton Company the default amount within 10 days from the time LWBC gives notice to the seller.Liability, agency, and liens     Seller is to maintain property and liability insurance on items con¬tinuing throughout the auction. Seller further agrees to hold harmless all auctioneers and staff members associated with L.W. Benton Company, Inc. from any liability, including but not limited to default payment, loss, breakage, theft, fire, or any other occurrence beyond the control of the auctioneer or associates of L.W. Benton Company, Inc. Seller is required to disclose all liens applicable to auction merchandise prior to signing this auction contract.  Otherwise, Seller covenants and agrees that he has good title and the right to sell, and said goods are free from all encumbrances. Seller further authorizes the auctioneer to check public records for liens. Seller agrees to pro¬vide merchantable title of all items to be sold in auction. L.W. Benton Company, Inc. and all associated auctioneers are agents of the seller only. The final Internet inventory update will take place the night before the auction and some items may not be listed on the internet until that time.This is a legally binding agreement; the seller has read and understands the terms agreed to herein. If there are parts of this contract that are not understood by the seller, it is advised that an attorney be consulted before proceeding.  Seller agrees to hold harmless, L.W. Benton Company, Inc. and/or any of its agents and/or representatives against any claims of the nature referred to in this contract.  Venue for any controversy or claim arising from or relating to this agreement, or breach thereof, shall lie exclusively with the Magistrate or Superior Court of Jones County, Georgia.  This agreement shall be interpreted in accordance with, and governed by, the laws of the State of Georgia. Questions and inquiries for additional information concerning L.W.
