ELIGIBILITY GUIDELINES & PROGRAM TERMS
- Participants must be customers of Santa Margarita Water District (District) and the location of the property must be within the District’s service area.
- The owner of the single-family residence must be the person applying for the program.
- Program time and resources are limited. This offer is limited and is available on a first-come, first-served basis to eligible participants.
- Eligibility to reserve an appointment time with a landscape designer is incumbent upon completion of the Questionnaire and Drawing Your Project Site Plans. Incomplete or insubstantial responses may disqualify an applicant from continuing in the Program.
- The District reserves the right to deny eligibility or cancel applications if a participant’s landscape square footage or project requests are outside the scope and ability of this Program. Areas under 300 square feet or over 1,500 square feet may be considered outside the scope and ability of this Program.
- District reserves the right to conduct PRE and POST-installation inspections of the landscape to verify the condition of the landscape, the square footage of the landscape, and the plant palette composition.
- The Program and District contractors and agents are not responsible for providing hardscape construction detail plans for landscape elements such as, but not limited to, swimming pools, spas, barbeques, gas fire pits, overhead structures, etc. At their own expense, participants are responsible for obtaining hardscape construction details for city and HOA Approval. HOA’s may require such detail plans in order to approve changes to a participant’s landscape.
- The irrigation system must be a low flow system, such as drip irrigation or high efficiency, low precipitation rotating sprinkler nozzles. Exposed soil must be covered with 2-3" of mulch.
- The District reserves the right to use PRE and POST-installation photographs for marketing purposes. Identifiable location features, such as address numbers, will not be included in any promotional materials.
RELEASE OF CLAIMS AND INDEMNIFICATION
Neither the District, nor its contractors or agents, makes any representation or warranty regarding the services or products that you receive under this Program. The District does not control any of the outcomes associated with your participation. Installation of the landscape design does not guarantee reduced water use. By participating in the Program, you thereby release, waive, discharge and covenant not to sue the District, their officers, agents, servants, or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of the design, installation, and/or use of water efficient landscaping and devices. The District does not maintain any insurance policy covering any circumstance arising from your participation in this Program or any activity associated with or facilitating that participation. Any and all claims or causes of action in connection with any defect or failure of performance of any contracted service or installed product or device provided may only be pursued with the participant’s contractor or the appropriate manufacturer/distributor. The Program participant is responsible for ensuring that the Project complies with all applicable Federal, State and local laws, as well as applicable CC&Rs and/or HOA restrictions. Quality of work and appearance of the converted area are the responsibility of the participant. The District is responsible for enforcing the terms and conditions of the Program.
