I. RENTER ELIGIBILITY
Renter must be at least 18 years of age with valid photo identification. If the service agreement is for a minor under the age of 18, a parent or guardian must sign and will be held responsible for the contract and actions of the minors.
II. RESERVATIONS
Deposits are required to secure a reservation. We require a deposit of no less than $100 unless otherwise stated. No reservation will be made until payment of deposit is received.
III. PAYMENT
We accept money orders, cash, and credit/debit cards with proper photo ID. A $5.00 processing fee is issued per card transaction. Rental Payments must be paid in full 1 day prior to reservation date but no later than before the departure for the delivery of the bus. If payment is not received by the above stated times, we reserve the right to cancel your reservation at any time without refund of any paid deposits. No exceptions unless otherwise stated.
IV. RULES OF CONDUCT
There will be NO possession, consumption, or sale of ANY type of narcotics, illegal drugs, or weapons. There is NO SMOKING allowed on the bus. We have a zero tolerance policy for disorderly behavior. Party Hardy Bus reserves the right to expel any person from the vehicle and /or terminate this contract. In the event of termination of the contract NO portion of the contract will be refunded. Violation of any of these rules will result in immediate termination of the contract and forfeiture of all paid deposits and fees for services.
V. ALCOHOL POLICY
We cannot, by law, supply alcohol to/for clients. Guests must provide their own alcohol. All guests on the party bus must be 21 or older to drink alcoholic beverages. By law, no alcohol can be consumed by anyone less than 21 years of age. If there are any underage people on the bus we will not allow any alcoholic beverages or alcoholic containers to be brought on the bus. Our staff will be checking ID's. All identification must be valid and current. There are NO glass bottles, cups or glass containers allowed on the bus. This is for your own protection. Cans, plastic, and Styrofoam are welcome.
VI. INJURIES
We will not be held responsible or liable for injuries caused by or due to: slippery steps (entering/exiting the vehicle), loud music, slippery floors, glass breakage, insufficient lighting, effects lighting, motion of the vehicle, or any conditions existing in the interior or on the exterior part of the vehicle which may cause harm or injury. We urge all guests to remain seated while the vehicle is moving to avoid injury. All injuries must be reported to the driver immediately in order to get proper medical attention. You may be asked to fill out an accident report form with the proper authorities. All medical emergencies will be the sole financial responsibility of the client or injured guest and continuance of your reservation will be at the sole discretion of the driver and Party Hardy Bus.
VII. DAMAGES AND CLEANUP FEES
If a passenger should vomit inside/outside the bus, or if excessive garbage is found throughout the bus, there will be a $100.00 clean-up fee issued. If any property of Party Hardy Bus gets damaged or stolen by the contract holder or guests, you will be held liable for all replacement costs, collection fees, attorney fees, court costs, etc.
VIII. LOST OR STOLEN ITEMS
Party Hardy Bus recommends that all and any valuables be removed from the vehicle when unattended. We will not be held responsible for any lost, damaged, or stolen property during or after the completion of the rental.
IX. OVERTIME
Please note that your party begins when the driver arrives for the initial pick-up and ends when the last person is dropped off. No exceptions. Customer agrees that overtime will be billed at the contracted rate by the hour and agrees to pay any overtime charges whether or not the entire hour is used. Additional charges are to be paid in full before your party ends. Also note that there is no guarantee that overtime hours will be available. Please be sure that the number of hours you are writing on the contract will be sufficient time for your event.
X. CANCELLATIONS & RESCHEDULING
Due to the nature of this business rescheduling is not an option that we offer, as buses cannot easily be re-booked on short notice. If you choose to cancel you must do so within 4 weeks of your scheduled event to receive a full refund. Partial refund may be obtained 2 weeks prior to your scheduled event. After this point any cancellation results in forfeiture of your fee. If your party does not show up at the last minute and you want to cancel, we are not responsible and no refund will be given.
XI. REFUND PROCEDURE
In any case that a refund is to be issued, you shall provide a forwarding address at which Party Hardy Bus may mail you the refund. Refunds will be mailed within 30 days after your reservation.
XII. VECHILCE RELATED ISSUES
Since Party Hardy Bus offers high-tech-equipped vehicles, sometimes heat and excessive use of all power-operated equipment might be subject to temporary failure. Party Hardy Bus is NOT LIABLE in cases of unexpected vehicle breakdowns, accidents, severe weather, or anything that may delay a timely arrival. All efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent, and customer rejects the replacement vehicle, NO refund is due. If no replacement vehicle is available, the refund will be limited to the amount paid by the customer. No additional charges will occur for overtime or vehicle upgrades in such cases. We are not responsible to fulfill any itineraries developed by the customer, which indicate a certain time the customer expects to arrive at a certain location after the initial pickup time. If Party Hardy Bus is not on time to the initial destination for pickup, we will provide the missed time at the end of the night; NO refunds will be given.
XIII. RENTER RESPONSIBILTY
You are responsible for informing your guests of all terms and conditions of this contract and ensuring they have proper photo ID. You are also responsible for the actions of your guests regarding damage to the vehicle. This includes but is not limited to gum, smoking, beverage spills, burns, rips and tears of interior, vomiting, urine and breaking of any glassware or equipment. We are not liable for anything that people do or bring with them, included but not limited to: Before being picked up, while riding on our buses, or after being dropped off. You are responsible for any and all damage costs, clean-up fees, and overtime charges. If you would like to provide gratuity, it is at your sole discretion. If legal action is necessary to collect monies due, you will be responsible for all court costs, our attorney fees, and the remaining balance due.
