Read the form carefully before completing, and be sure to print a copy for your records before submitting to DVOC, as this will serve as your official session agreement and print release. Weather & Rescheduling

As your Photographer, I keep a close eye on weather conditions and will be in contact with you before our scheduled session if it is not possible for a session to take place due to inclement weather. Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
Cancellation

PLEASE REVIEW - Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. If you are unable to keep your scheduled photo session, DVOC Photography requires a 72 hour advance notice. We will work together in rescheduling your shoot for another date/time convenient for both of us. If this is not possible, DVOC Photography will credit your retainer towards a future photo session that is booked within 60 days of your original session date. Photo Requests

While DVOC Photography will make every reasonable effort to take photos specifically requested by Client(s), Client(s) understands certain circumstances are uncontrolled due the vagaries of the weather, available light, time restrictions, and willingness of subject(s), DVOC Photography does not guarantee all requested photos will be taken. The Photographer(s) are equipped to handle most low-light situations. In situations where flash photography is prohibited or is deemed to be unsafe, the Client agrees to accept the Digital Images as-is, given the technical limitations of low-light photography.
Editing & Altering Images

Altering images is strictly prohibited. I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity! Basic retouching and creative editing of images is determined by photographer. Additional editing is available at an additional expense to be discussed between client and photographer, if requested. Additional prints, products and digital images may be available for purchase.

Exclusive Photographer

It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the session near the Photographer while she is working due to reasons of the photographer delivering the quality of images as expected. Any breach of this agreement (including iPhone photography) can constitute a reason for non-completion of the job with no liability to the Photographer. This includes photos with cameras, cell phones, tablets, etc. Doing so will result in end of session. Please ask before capture behind the scene photos during your session.

Copyright & Reproduction

It is illegal to copy or reproduce the Client's photographs elsewhere without DVOC Photography’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. All photographs, both on DVOC Photography’s website, blog or Social Media accounts, including all potential proofs and purchased prints, are copyrighted, reproduction of any image by any means, including copying, re-printing, screen captures, and other means of print reproduction are strictly prohibited and are a violation of copyright law. Additionally, it is illegal to post any of DVOC Photography’s work on the Internet, blogs, and social networking sites, without the express permission of the photographer. The only exception to this is if you have purchased the print release digital files provided by DVOC Photography. The Photographer shall own the copyright in all images created and shall have the irrevocable right to use the photographs in all forms and in all media and in all manners without restriction as to changes or alterations, for advertising, trade, promotion, exhibition or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of DVOC Photography. Client waives any right to inspect or approve the photographs, finished versions incorporating the photographs or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs and assigns. The Client recognizes and agrees that the Photographer may reproduce, publish (including internet), exhibit and otherwise use images created without specific identification of persons or events as samples of work to be shown to prospective clients, for instructional purposes and as samples of work to be displayed for marketing or competition.
Client's Usage

The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement. The Client’s prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. If the Photographer provides a digital file print release, the Client must act in accordance with the release.
Model Release

I hereby give DVOC Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others: A) To copyright the same in the photographer’s name or any other name that he/she may select; B) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade. Client hereby releases and discharge Photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
Failure to Perform

If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.
Waiver of Liability

Safety is a top priority at all portrait sessions, however the Photographer is not responsible for any behavior or risk on the Client's part which may undermine safety concerns. Client expressly releases the photographer, her employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. This waiver of liability includes waiver of any claim that may be a result of negligence.
Completion and Delivery of Photos

Portrait orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received. Due to the nature of these sessions, completion and product delivery time may vary. D𝒆𝒍𝒊𝒗𝒆𝒓𝒚 𝒐𝒇 𝒅𝒊𝒈𝒊𝒕𝒂𝒍 𝒅𝒐𝒘𝒏𝒍𝒐𝒂𝒅 𝒈𝒂𝒍𝒍𝒆𝒓𝒚 𝒊𝒔 𝒂𝒑𝒑𝒓𝒐𝒙𝒊𝒎𝒂𝒕𝒆𝒍𝒚 𝒕𝒘𝒐 𝒕𝒐 𝒇𝒐𝒖𝒓 𝒘𝒆𝒆𝒌𝒔 𝒂𝒇𝒕𝒆𝒓 𝒕𝒉𝒆 𝒔𝒆𝒔𝒔𝒊𝒐𝒏. Rush fee $100 .

Mediation
Severability

If any part of this Agreement is determined to be void, invalid, inoperative or unenforceable by a court of competent jurisdiction or by any other legally constituted body having jurisdiction to make such determination, such decision shall not affect any other provisions hereof and the remainder of this Agreement shall be effective as though such void, invalid, inoperative or unenforceable provision had not been contained herein. This agreement shall be governed by the laws of North Carolina.
Print Release

The bearer of this notice has purchased high-resolution digital files from his/her photography session with DVOC Photography (DVOC). Bearer is hereby granted permission by DVOC to reproduce the images and make an unlimited number of prints, for personal use only. This permission applies worldwide. Bearer agrees that he/she may not use any DVOC images for commercial or editorial purposes,or enter any DVOC images into competition without the express written permission of DVOC. DVOC retains the copyright to all images, per USC Title 17 (US Copyright Law).
