    The work product doctrine is an essential pillar of the confidential lawyer-client relationship that enables lawyers to conduct research and analysis in anticipation of litigation without intrusion from opposing parties.  But not all work product is protected equally.  This program will discuss the basic framework of the work product doctrine, the difference between opinion and fact work product, and recent decisions creating a split among federal courts as to how the distinction between fact and opinion work product is analyzed.  It will also discuss best practices to protect your work product from disclosure.
