A. Model Release
I hereby give to Jennifer Suntych Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
B. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Should Client(s) break any equipment during the shoot, it will be the Client(s) responsibility to pay for repairs and or replacement of said equipment.
C. Limit of Liability
In the unlikely event that the Photographer is injured or becomes too ill to photograph the session, studio will make every effort to reschedule or find a replacement photographer or refund all funds paid. In the unlikely event the the photographs have been lost, stolen, or destroyed for reasons within or beyond the studio control, studio liability is limited to the return of all payments received for the protrait session, should a reshoot not be possible. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals. Studio will not be held responsible for clothing damaged due to outside nature, serious allergic reactions, or death.
D. Cooperation
Jennifer Suntych Photography is not held responsible for the behavior of Client(s) involved with the shoot, with the exception of studio personnel. If the desired outcome of the session is jeopardized by the behaviors of parties involved, studio cannot be held responsible.
E. Payment Arrangements
The retainer deposit is due at the time of booking to secure your session time. The minimum payment for packages will be paid before the day of the shoot and will be credited toward your package choice. The studio reserves the right to refuse services/products if the payment arrangements have not been met, unless prior arrangements have been made. In the unlikely event Client(s) is unhappy with photographs it will be at the discretion of Jennifer Suntych Photography to offer a one time reshoot at half price of the original session fee to Client(s). Should Client(s) refuse a reshoot, there will not be a refund of the retainer deposit as this is payment for shooting and editing your portrait session. If client wants additional editing of photographs there is a 45.00 fee per hour per photograph for said photographs and is at the sole discretion of Jennifer Suntych Photography.
RETAINER FEE: This signed contract and the retainer deposit are required to book your session. The retainer deposit is 100% of the session fee. In the event of a canceled session by Client(s) the retainer deposit is non-refundable. In the event Client(s) does not wish to purchase any prints/ products due to unforeseen circumstances, the retainer deposit is non-refundable.
PAYMENT STIPULATION: There is a $25.00 fee for any returned check, plus all other fees associated with said returned check will be the responsibility of said Client(s). In the event of a previous returned check by Client(s) studio reserves the right to refuse payent by check in the future, in which case, cash, money order, cashier's check, and debit/credit card will be accepted.
There are additional fees for the following: .50 cents per mile round trip for mileage over 40 miles, added time, additional outfit changes, and products/prints/services not specified in the package purchased.
Additional fees may be assessed for the adding of more than one person within the specified portrait session.
F: Reshoot policy
In the event Jennifer Suntych Photography is required by the Client(s) to reshoot the session without 7 days prior notice, the client will be responsible for an additional retainer deposit to secure another date.
In the event the weather conditions are not desirable for the shoot based on studio recommendations, the session will need to be rescheduled and the fee will be waived. Due to liability and equipment damages this decision will be at Jennifer Suntych Photography's discretion. In the event of sickness by client the soonest reshoot date will be made available for one time. If session needs to be rescheduled more than once an additional retainer fee will be implemented. If session must be canceled due to sickness or unforeseen life event of photographer the soonest date will be given to Client(s) for a reshoot.
F. Completion Schedule: Due to the nature of sessions, completion and product delivery time may vary. Most sessions will be finished within two to three weeks of session date. Your online gallery will be available for viewing and ordering products for 7 days. There is an additional $25.00 charge to reload your gallery after it expires.
G. Copyright & Penalty
Jennifer Suntych Photography retains all copyrights to all images created during Client(s) session. Copyright fines start at 150,000.00. A print release will be given with digital files to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is ILLEGAL to copy, scan, download, print, share, alter, screen shot or otherwise steal any image created by Jennifer Suntych Photography during Client(s) photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file and potential fines enforced.
Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.
