  • In my role as a volunteer, subject matter expert, committee person, certification administrator or staff member, I have been entrusted with certain information regarding the operations and membership of Electronics Technicians Association, International, Inc. (hereinafter referred to as ETA). ETA is committed to protecting the confidentiality of our customers, members, volunteers, certificants, and personnel and with the business data entrusted to its care. With this in mind and as it pertains to my relationship with ETA, I agree and acknowledge the following:

  • Confidential and Proprietary Information

    For purposes of this Agreement, “Confidential Information” is defined as all information and materials, in whatever form, whether tangible or intangible, disclosed by ETA or any of its authorized representatives to Volunteers, or to which Volunteers otherwise gain access as a result of volunteering for ETA.   All ETA proprietary information that is not known generally to the public is considered as “Confidential Information”.

    Without limiting the generality of the foregoing, the following are deemed as Confidential Information:

    • Ideas for research and development;
    • Computer records and software (including software that is proprietary to third parties);
    • Any other information which ETA must keep confidential as a result of obligations to third parties;
    • Information regarding the administration of components of certification programs;
    • Exam-related technologies and components;
    • Item content, characteristics, development or other aspects of the examinations and their development, maintenance and administration;
    • Identities of certification holders, candidates, customers, suppliers, or third party contractors, including without limitation any media, advertising, or public relations firms;
    • ETA’s e-mail distribution list(s) and certain portions of its database information;
    • Human resources data/information about employees, contractors, members and other volunteers;
    • Information submitted in the investigation of complaints or involving ethics cases;
    • ETA’s financial data;
    • Any other information to which a Volunteer may have access while involved in ETA’s activities.
  • Non-Disclosure

    I agree to maintain the confidentiality of all Confidential Information. I agree not to misuse, misappropriate, disclose or divulge in writing, orally or by electronic means, any Confidential Information, directly or indirectly, to any other person or use them in any way, either during the term of this Agreement or at any other time thereafter, except as is required in the course of service to ETA. I also agree not to, without prior written consent from ETA, utilize any Confidential Information for future use unrelated to present activity. In no event shall I use Confidential Information in a manner that is in any way detrimental to ETA or others.

    I acknowledge and agree that all Confidential Information and similar items maintained in hard copy, electronically or online relating to ETA's business, shall remain exclusively the property of ETA and shall only be used by myself for the purpose(s) permitted by ETA.

  • Conflict of Interest

    I shall avoid personal and professional conflicts of interest in all matters pertaining to ETA's programs. Conflicting interests may include but are not limited to such areas as financial, personal relationships, and/or professional relationships.

    If a situation arises where it is unclear as to whether a conflict of interest exists, I shall discuss the issue with the President of ETA.

  • Remedies

    Violation of this Agreement could be grounds for termination of service with ETA. In the case of a volunteer, a Committee Chair plus any two members of the Executive Board of Directors may elect to remove a volunteer at any time. In cases where a staff member is involved of violating this agreement, ETA's personnel policies shall determine the appropriate disciplinary action or termination process.

    The provisions of this Agreement, including any Volunteer’s obligations hereunder, shall survive any expiration, termination, or rescission of this Agreement and remain even after Volunteer’s or staff member’s relationship with ETA ends. Except as provided herein, I am prohibited from disclosing or using any Confidential Information in all circumstances, including but not limited to subsequent engagements or employment with third parties.

    This Agreement shall be binding upon myself and my personal representatives and successors in interest, and shall endure to the benefit of ETA, its successors and assigns.

    I acknowledge that a violation of the terms of this Agreement may cause damage and harm to ETA and that any such damage or harm will be difficult if not impossible to calculate in monetary terms and will be irreparable to ETA. I agree that, upon notice from ETA declaring a breach of this Agreement, I shall immediately cease all further activities which are, or are claimed by ETA to be, a breach of this Agreement. ETA may also avail itself of any other remedies within the limits prescribed by law.

    If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.

  • STEP 8: Code of Conduct

    Use the tabs above to quickly move between each section.
  • 1. I will improve my own technical proficiency for the sake of my own firm and my country.

    2. I will conduct myself in a professional manner - admitting and accepting errors when proven wrong - and refraining from changing the facts in an attempt to justify my position.

    3. I will never encourage, directly or indirectly, any gratuity, commission, tip or other extra financial benefit in connection with any work I perform, over and above the compensation agreed upon by my employer, or over and above the service charges established by my firm.

    4. I will avoid any conflict of interest or appearance of conflict of interest.

    5. I will assist fellow technicians in understanding both the technical, as well as the financial needs of the firm I am a part of, as I know that teamwork is the key to success.

    6. I will respect the fact that my customers, clients, and non-technician fellow workers may not easily understand the highly technical and complex nature of my work. Therefore I will have patience and will do my best to allow them maximum understanding of the difficulty and the need for each of my procedures, and within reason, when requested, explain use and/or operation of the products I service.

    7. I will display my licenses, certification and other diplomas as marks of professionalism for public recognition.

    8. I will undertake only those assignments for which I have been properly trained and qualified, and will request help, without hesitation, for those which I am not qualified.

    9. I will not misrepresent my firm or my own credentials and qualifications, nor will I downgrade those of my fellow technicians or competitors.

    10. I will perform the duties of my job with complete fidelity and honesty. I will not use my certification in a misleading manner, and I will make claims regarding this certification only with respect to the scope for which certification has been granted.

    11. I will safeguard trade secrets, never revealing facts, data, or information obtained in connection with services rendered, without prior consent of the client or my employer, except as authorized by law.

    12. I will not improperly offer to, or obtain work, by way of commissions, or otherwise make an offer to pay a client or prospective client in order to obtain work.

    13. I will have due regard for the physical environment, for public safety, health and well-being. If my decisions are overruled, I will notify my employer, client, and/or other such authority as may be appropriate.

    14. I realize that I must give back some of what others have given to me. Where feasible I will accept cheerfully, to the best of my ability, positions on advisory committees of my school, membership in my professional association, or in other activities, doing my share to raise the level of income, knowledge, proficiency, skills, and public understanding and respect for my profession.

    I5. When I can no longer abide by these principles, I shall consider seeking a different profession.

    16. If something occurs during the period of ETA certification that makes it impossible or dangerous for me to continue performing the tasks for which I was certified, I shall notify ETA of the change of situation to determine if continued certification is in the best interest of ETA and/or the industry.

    17. I will not use the certification in such a manner as to bring the certification body into disrepute, and will not make any statement regarding the certification which the certification body considers misleading or unauthorized.

    18. I will discontinue the use of all claims to certification that contain any reference to the certification body or certification upon suspension or withdrawal of certification, and to return any certificates issued by the certification body.

    I have read and I agree to abide by the above ETA® International Code of Conduct.
