**Swim Lessons Waiver and Release of Liability**
As the legal parent or guardian, I hereby release and hold harmless Kidz Aquatic LLC, its owners, and operators from any and all liability, claims, demands, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned while on the premises or any premises under the control and supervision of Kidz Aquatic LLC, its owners, or operators, or in transit to or from any of said premises.
**Assumption of Risk**
I understand, agree, and acknowledge that there are inherent risks associated with sports activities conducted by Kidz Aquatic LLC. These risks may include but are not limited to paralyzing injuries, brain injuries, and death. The activities may be hazardous in nature and can include swimming, diving, and various strenuous exercises and physical activities. With full awareness of these risks, I confirm that to the best of my knowledge, my son/daughter has no medical, physical, or emotional health conditions that would hinder or prevent his/her participation in Kidz Aquatic LLC programs.
**Payment Policies**
**Packages of 10 Lessons:**
- A deposit of $150.00 is due at the time of registration; the remainder of the tuition must be paid in full by the first lesson. If payment is not received by the second lesson, we will be unable to continue teaching until payment is received. Unless prior arrangements are made with Janine, your spot will be lost.
- The deposit must be submitted within 7 days of reserving the class for your swimmer. If payment is not received in a timely manner, we will assume that the swimmer no longer needs lessons and will remove his/her name from the roster.
- A $25.00 fee will be charged for any checks returned by the bank. Tuition includes the class fees and the Annual Family Administration fee, which is renewed each calendar year.
**Monthly Classes:**
- A 3-month minimum is required. The first month's tuition and a $25 family registration fee are due at the time of registration. If full payment is not received within 7 days of reserving the class, we will assume that the swimmer does not need lessons and will remove his/her name from the roster.
- A $25.00 fee will be charged for any checks returned by the bank. Tuition is due in full at the time of the first lesson and includes the class fees and the Annual Family Administration fee (renewed each calendar year). You will be billed/invoiced on the 1st of every month.
- Unless prior arrangements with Janine are made, your spot will be lost. If there are any discrepancies or reasons that the amount cannot be paid on time, Janine will be available for negotiation.
We offer "KIDZ DOLLARS" for referrals! If you’re new to Kidz Aquatic LLC and want your friend to receive a "KIDZ DOLLAR" worth $15.00 off their next session, please provide their name. You can also earn "Kidz Dollars" for your own lessons.
**Cancellation Policy**
If the client and/or instructor needs to cancel a lesson for any reason, a 24-hour notice is required. Once the cancellation is approved, the lesson will be made up after all originally scheduled lessons have been met. If the client fails to provide a 24-hour notice, the lesson will be canceled with no makeup option available. All checks should be made payable to Kidz Aquatic LLC. If the instructor fails to provide a 24-hour notice, the client will receive one lesson free. There are NO refunds if you choose to cancel while already in lessons. In case of bad weather, please check with your instructor and the school to reschedule the lesson without cancellation penalties. However, repeated requests may only be honored at the instructor’s and the office’s discretion.
**General Policy**
A legal guardian must always be present at the time of the lesson. Failure to provide a guardian will result in the cancellation of the lesson.
**Lessons and Coaching with Janine (Owner)**
Janine works seven days a week during the summertime to accommodate everyone, and her weekend afternoons are especially valuable. If you have lessons with her, please be aware that if other clients cancel, she might offer you that slot to finish early. Be prepared for the possibility of having your lesson moved within an hour of your scheduled time on weekends if you would like to have lessons with Coach Janine. Otherwise, you will be assigned to another employee of Kidz Aquatic LLC.
