For good and valuable consideration (e.g. money, photo/video files, prints, DVD, etc.), the receipt and sufficiency of which is hereby acknowledged by Talent, both parties hereto agree as follows:
Description of the Recording
This Agreement applies to any and all recordings of Talent and Talent's property made by Producer on the shooting dates covered by this Agreement and to all reproductions of such recordings including Talent’s name, likeness, image, voice, sound effects, interview and performance on film/video, photograph, other analog or digital media, or otherwise (herein collectively called the “Recording’).
Use of the Recording
Talent hereby consents to and authorizes the use of the Recording by Producer and Producer's authorized representatives, agents, licensees, successors, assignees, and designees for any purpose whatsoever including without limitation: sale, reproduction in all formats and media (whether now known or hereafter developed), publication, display, broadcast and exhibition for promotion, advertising, education, trade, art or illustration in all markets throughout the world, in perpetuity. Talent agrees the Recording may be used without further compensation for an unlimited number of times and that this Agreement is irrevocable.
Producer grants Talent an unlimited license to use the created images and videos for private non-commercial use for the purposes of display, exhibition, promotion, and marketing, including physical and online media, but this license may not be passed to a third party without Producer’s approval.
Ownership and Rights in the Recording
Talent agrees that the Recording, the copyright in the Recoding and all other rights in the Recoding or copies or reproductions thereof are the sole property of Producer and that Producer may protect the copyright or dispose of or authorize the use of any or all such rights in any manner whatsoever.
Release of Producer from Liability
Talent releases Producer (and all other persons entitled under this Agreement to use the Recording) from all liability for libel, invasion of privacy, and all causes of action whatsoever in relation to the Recording, their making and use of Talent or Talent's property including, without limitation, any liability for alteration of the Recording, whether intentional or otherwise, that may occur during the making or subsequent use of the Recording.
Talent acknowledges reading the entire Agreement and understanding its contents prior to signing.
If Talent has not reached the Age of Majority, their Legal Guardian consents to the Agreement as outlined above.
