As of March 30th, 2022, client named above, hereafter referred to as "Client," enters into the following agreement with Amber Potter Photography, hereafter referred to as "Photographer." This contract constitutes the entire agreement between both parties and will apply to all future transactions.
A. Session Fees
Client agrees to pay photographer a creative fee deposit of $150 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee for one senior portrait session, to be used within 12 months of purchase date. This fee covers the time and talent of the photographer, and does not include any digital images or prints. Each session has an additional $350 deposit required, due no later than 1 day prior to your travel session, which includes basic retouching and creative editing of images, as determined by the photographer, and a gallery of at least 45-55 edited proofing images. This portion of the deposit does include your fully edited ditial images with print release for personal printing. Additional retouching/editing beyond what photographer normally provides is available at additional expense to be determined by photographer. Photographer will edit photos according to photographers editing style, which will be consistent with the photographers portfolio displayed online.*MO Sales tax is applied according to state law.
B. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 30 minutes of zip code 65810. Any location outside of these limits will be subject to an additional charge of $.55/mile as part of the agreement. Travel fee does NOT apply to ST. LOUIS photo sessions.
C. Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Sessions are rescheduled at photographers discretion when inclement weather is expected that would prevent photographs from being taken, (i.e, rain, snow, extreme wind, and storms). Sessions are not rescheduled for cloudy weather, unless there is a lack of usable light for photographs, as determined by photographer.
D. Re-shoots
Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.
E. Proofs
Proofing of client images will be available for viewing within 4 weeks of session date, in a password protected web gallery or an in person ordering session. During exceptionally busy seasons and circumstances beyond photographers control, gallery turnaround time can extend to 6 weeks or longer, although this is not the norm. Please respect that the photographer works a full time schedule from home with small children. Photographer will make every effort to complete a full gallery as quickly as possible, and during exceptionally busy seasons a small amount of edited images can be completed ahead of the full gallery for the use of announcments, gifts, and holiday cards as needed by client during time contraints.
F. Ordering
At this time, ordering can be done via clients online web gallery. Online galleries will be active for 10 days before expiration. A $50 reset fee will apply to reactive a gallery that expires before an order is placed. Photographer and client may also schedule an ordering session to take place in clients home, the photographers studio, or at an agreed upon location. Due to the custom nature of each session, all sales are final. Client must be absolutely sure of their purchase prior to the end of your ordering session, as print orders are placed with our professional lab within one to two (1-2) business day(s) of your session.
G. Archive
After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
H. Payment
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
I. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
