This session agreement is put into place so you know what a portrait session with me includes and that I am able to meet your expectations.

Please read all information carefully, print a copy for your records and then provide your digital signature and submit.

Terms and Conditions

I. Fee Payment

The Session fee is $225.  This covers the time and talent of photographer for a 20 minute session within 15 miles of the Studio, basic retouching and creative editing of images as determined by the photographer, (3) favorite image to download in high resolution, watermark free with print release.  At Client request, photographer will prepare one of these favorite files to be formatted for the yearbook and submit directly to the school.  (Client to provide yearbook specs and contact info.)

 Client will recieve an online gallery with at least 10 watermarked images to chose from.  Additional images, prints or photo products may be available for purchase at an additional fee.

  

Session Fee of $225 and completed Mini Session Agreement is required to hold your slot.  

 

Due to the nature of digital products/images the entire session fee is NON-REFUNDABLE.

 

II. Cancellation

If an illness or situation prevents a photo session from taking place, client may reschedule their session if proper notice is given prior to their shoot. 

If Jennifer Prisco Photography cannot perform this contract due to fire or other casualty, strike or act of God, or other cause beyond the control of the parties or due to Photographer's illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that Jennifer Prisco Photography fails to perform for any other reason, Jennifer Prisco Photography shall not be liable for any amount in excess of all monies paid.

Please plan to arrive at least 5 minutes prior to your session time.  If you are late arriving minutes late will be deducted from your total shooting time. 

 

III. Re-shoots 

Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.

If SEVERE inclement weather prevents session from taking place, you will be notified at the phone number provided as soon as the decision has been made.  Photographer will give at least 2 options to reschedule session.  If client and photographer can not come to an agreement on a date, deposit will be refunded. 

 

IV. Client Proofing

Images will be available to online viewing and downloading approximately 4 weeks following your session date.  You will be notified that your gallery is ready for viewing via email provided.  Online gallery will be active for 5 days.  All orders must be placed during this time.  There is a $25 reinstatement fee to re-host the gallery for an additional 7 days to allow for additional viewing, downloading and ordering.  Once images and products are ordered, all sales are final. All books, albums, frames, etc. are non-refundable. Since my products are custom in nature, orders cannot be canceled.  Jennifer Prisco Photography does not guarantee the quality of any images printed at any outside photo lab. 

After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

 

V. Additional Retouching

Final images will be chose by Jennifer Prisco Photography for quality, color accuracy and composition.  This means that not every file from the session will be included in the image presentation or be available to the client.  Final images will include basic edits, retouching and color adjustments.  If Client has a request for a small alteration of an image such as a tighter crop or orientation change, this will be accommodated at no additional charge assuming the Photographer has been notified before any orders have been placed. For more involved requests there may an additional fee. The Client will be notified of any possible fee before any work begins.  

VI. Truth in Photography Clause

Photography is an artistic interpretation of what a photographer sees when taking a photograph. The interpretation includes the subjects, the location available and the lighting available. There needs to be a level of trust between the subject(s) for the end result to be pleasing to the subject and the photographer. If any party or parties in your session are unwilling to be open to posing or expression suggestions it is best to discuss this with your photographer before your session begins. 

VIII. Copyright 

All images taken at your session are copyrighted by Jennifer Prisco Photography and are protected by Federal Copyright Law.  It is therefore unlawful to reproduce their work in any manner without written permission from Jennifer Prisco Photography. Reproduction includes, but is not limited to, scanning, downloading, right-clicking, making screen shots, emailing, saving to hard drive, posting on websites or blogs, photocopying or printing images in any manner. Please respect Jennifer Prisco Photograph's livelihood and the care and attention paid to each of your images by adhering to copyright laws. Jennifer Prisco Photography wishes to have the final artistic control over the final look of the client's images.  Scanned or reproduced images are both illegal and a degradation of the original image quality.  

IX.  Model Release 

Jennifer Prisco Photography retains the copyright of all original images and reserves the right to use and reproduce them for the purpose of, but not limited to, advertising, website/blog, display, portfolio, or any publication to promote business free of compensation. 

X.  Exclusive Photographer

It is understood that Jennifer Prisco Photography is the exclusive official photographer retained to perform the photographic services on this agreement. No other cameras or recording devices are allowed during the photo session, including the use of cell phone cameras.
