Entire Agreement: This agreement contains the entire understanding between Nicole Schantz photography and the clients name above. The only way to change this agreement is to do so in writing, signed by all parties.
WEATHER: In the event it rains, the photographer will contact the client to discuss a R/S date. If it is windy, snow or any other type of bad weather it is up to the photographer to cancel and r/s the session. Please not, if it is drizzling the session will be canceled, if it is windy we will as well r/s the session.
EXPENSES INCURRED: When applicable, the client is responsible for all travel expenses, accommodation and meals for the photographer for the session. Travel expenses are base on the distance between the event location and 20 miles from the photographers house. (Conowingo, MD). For all events the first 20 miles are included in the price agreed upon. All miles exceeded over 20 miles are $.55 per mile.
Capture and Delivery: Nicole schantz Photography is not liable to deliver every image taken at the session. The determination of images delivered to the client is left to the descretion of the photographer. The images are completed within 14 days. You may do addition rush time which is 24 hours for $50.00.
Retainer Fee: A retainer fee is required upon receipt of contract. To reserve the session date, Client shall pay to Nicole Schantz Photography, upon execution of this agreement. The retainer fee is non-refundable of $25.00 when booking a session with Nicole Schantz photography. No client can ask for a refund and they are in the understanding of this. In the event the client cancels, they can re-book but another retainer fee is required. The retainer fee can be sent via paypal @ nicoleschantzphoto@Gmail.com
Photo Delivery and Storage: The clients images will be delievered to the client after processing. Processing can take up to 14 days to complete and be delivered. The clients images will be delivered via a online digital download gallery with a photo print release. It is the clients responsibility to download the images on their own computer, no a cell phone. The clients gallery expires 30 days after the delivery date. The photographer will archive the images within 90 days of the delivery date.
SHOOTING TIME/ADDITIONS: The client and Nicole Schantz Photography agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the schedruled start time and ends at the scheduled end time. If the client does not arrive at the appointed time for the event, shooting will commence at the scheduled start time and end at the scheduled end time. All addition time beyond the end time will be billed to the client.
RESPONSIBILITIES: Nicole Schantz Photography is not responsible for compromised coverage due to causes beyond the control of the company including but not limited to obtrusive guest, lateness of the client or guest, weather conditions, incorrect address provided to the owner of the company or any other terms. Nicole Schantz Photography is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The company is not held liable for missed coverage of any part of the event(s).
PERMITS: The client is responsible for acquiring all permits and necessary permission for all locations we will be using the day of the session or event.
FILM and COPYRIGHTS: The photographs prododuced by Nicole Schantz Photography are protected by Federal Copyright Law (all rights protected) and may not be reproduced in any manner without the company’s explicity written permission.
Cooperation: The parties agree to communication and cooperation for the best possible result within the definition of the session. Nicole Schantz photography is not responsible if individuals fail to appear or cooperate during photography. If the photograher feels insafe at any time, she will end the session. When you are in studio, it is very important to not allow the children to run throughout the basement of the studio. This is for your own saftey.
Mini Sessions: Mini sessions are 15 to 30 minutes. The time starts when your time starts and end when your time ends. A mini session IS NOT to be used for more than 1 family. ONE family per mini session.
Sessions are for families, added family will be a extra charge of $10.00 per person. additional families can be added with a one to two hour session. Not a mini session.
RELEASE: The client hereby assigns Nicole Schantz Photography the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restrictions; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images.
CAPTURE AND DELIVERY: The company is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of the company. The client MAY NOT bring their own camera to capture images during the session. The photographer will end the session and the client ill be resposible to pay for the session. The photographer does not use photoshop, only edits in Adobe Lightroom 4. The photographer does LIGHT editing only! If the client wishes to add more time to a session they are agreeing to pay according to the hourly rate.
SAFETY: Nicole Schantz Photography reserves the right to terminate coverage and leave the location of the event if the photographer from the company experiences inappropriate, threatening or any other offensive behavior from a person(s) at the event.
SOCIAL MEDIA: The client reserves the right to post their pictures on their Facebook or any other social media but MUST display Nicole Schantz Photography in the comment field to avoid Copyrighting. Nicole Schantz Photography has the rights and permission from the client/s to post any image from their session on any social media site or company website for advertising.
LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. There is a NO GOOF off policy in the photographers studio. Any child who destroys any prop or breaks something in the studio or even a outdoor prop the parent is held responsible for that item. The photographer will stop the session and be asked to leave. The photographer is not help responsible if the child is is goofing off and is injured in home or outdoor.
DIGITAL COPIES: The client may purchase all the digitals from the session if they would like in a JPEG edited format for $225. This will allow them to get all images taken at the time of the session.
PHOTOGRAPHER REQUEST: No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session. If you take photographs during the session you will forfeit the remaining time UNLESS the photographer gives you permission.
*Session starts at the agreed upon time. It is strongly encouraged that client arrives 15 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins. Please do not bring guest that are not being photographed. If the client is 10 minutes late the photographer will leave the photo session location and not take the client.
EQUIPMENT: In the event the client would destroy and props or camera equipment, the client is responsible for replacing those items. It is very important that your child/family member takes care of everything that they are using. Any broken items will be the clients responsbility.
PRINTS: The client agrees that if they do not wish to order prints with Nicole , she is not held accountable if the images are off. I highly suggest printing with Nicole
MINOR RELEASE: Client hereby confers on Nicole Schantz photography the absolute and irrevocable right and permission with respect to photographs that she has taken of my minor child. In any right the parents are seperated they have agreed that it is okay to have family photographs. If there a divorce agreement that no photographs are to be taken, Nicole Schantz photography is NOT HELP accountable for the images. This is to be taken up upon the parents.
ONLINE GALLERY: It will expire within 30 days, please make sure you download your images! It is a $30. reload fee. If you purchased a flash drive, I can add the images to it but will not mail it back. You must pick up in conowingo.
STUDIO: The photographer is not held responsible if the child injured themself at the studio, such as horsing around on the steps or in the studio. The parents MUST watch their child. If the chid breaks anything at the studio the parent must replace the item. Please note the studio is a inhome studio, not at a business outside of the photographers home.
Limit of Liability: In the unlikely event that Nicole Schantz Photography is injured or becomes ill prior to the event to photograph, Nicole Schantz Photography will make every effort to reschedule in a timely mannor.
During a session if the clients are more calm then the session will be great!
Outfits: Please ask your photographer what you should wear! Your photographer will send you some outfit ideas.
ENTIRE AGREEMENT: This agreement contains the entire understanding between Nicole Schantz Photography and the client. If the client has any objections about the contract the will be listed below from the client and initials will be provided by the client. You may not change anything until it is in writing.
