The ZINDIS Group has created a set of policies to best serve the needs of our vacationing guests as well as our homeowners. A gentle reminder that you are staying in a privately-owned home and we respectfully request that you treat it with respect, including all furnishings and linens. You should receive a Reservation Confirmation email soon after you make a reservation, whether you have made it online or over the phone. Please contact us right away (reservations@zindis.com) if not received. Our goal is to ensure that you have a positive, seamless vacation experience.
RESERVATION DEPOSIT: If your ZINDIS Reservation is made more than 60 (sixty) days prior to arrival, the reservation deposit is one half of the reservation total and will be charged at the time of booking. All balances are due 60 (sixty) days in advance of occupancy. If the reservation is made 60 (sixty) days or less before your arrival, the total of your reservation is due upon booking. All funds received are to be submitted in USD.
DAMAGE DEPOSIT: A refundable $500.00-$750.000-$1000.00 USD damage deposit shall be paid via credit card prior to occupancy. When this rental agreement ends, guest will surrender the property in the same condition as when received. Guest will leave the property in a clean condition free of all trash, debris, and any personal property. Normal wear and tear mean deterioration that occurs without negligence, carelessness, accident, or abuse. This deposit shall be used to cover any repairs or replacements due to damages or losses caused to the residence. The renter agrees to pay for the costs of any damages not completely covered by the deposit. After an inspection of the property by a ZINDIS representative, the damage deposit will be returned to the renters upon departure from the property. Please allow up to 14 (fourteen) business days to receive your refund.
OCCUPANCY: Occupancy is limited to the stated occupancy on the Booking Website. Over-occupancy is considered a SERIOUS VIOLATION of this lease and the tenant will be fined $100 for each extra person per night and or termination of the lease without refund.
HOUSE & CONDOMIMUM RULES: The Vacation Rental may have specific rules and policies regarding pets, smoking/vaping, quiet hours, parking, pool and/or hot tub usage, and other local, homeowner association, or property regulations. Please review these terms carefully, as a violation(s) may result in additional fees or the immediate removal of you and other members of your party from the Vacation Rental without refund.
FEES & ADDITIONAL SERVICES: All mandatory and optional booking-related fees will be disclosed in the Vacation Rental listing. If you fail to select any option(s) that incur additional fees applicable to your stay (e.g., pet fees, additional occupancy cleanings etc.) and it is later discovered that you should have paid for such option(s), you grant ZINDIS the right to charge the credit card number used to book the Vacation Rental for the associated additional fees.
CLEANING FEE: Your cleaning fee is INCLUDED for normal use upon your departure. If the house is left excessively dirty or messy, there will be additional cleaning charges applied. Guest shall leave premises in clean, undamaged condition and will be held accountable for any damage by negligent or wrongful acts caused by the Guest or Guest's visitors.
CHECK-IN TIME 3:00 p.m. Local Time or Later: Unless special arrangements are made at least 48 hours in advance for an early check-in, your villa will be ready for your arrival at 3:00 p.m. If you arrive prior to check-in time, there are many local restaurants and bars that you can enjoy. Our staff will be happy to assist you in locating an amazing place to relax, unwind and enjoy our wonderful Costa Rican hospitality. If arriving after 6 p.m. we request that a 48 hour advance notice is given that you will be arriving after normal business hours.
NOTE: A $45.00 late check-in fee will be applied to groups arriving after 5:30pm.
Please be prepared to pay this in cash upon arrival.
CHECK-OUT TIME 10:00a.m. OR EARLIER: Guests are respectfully requested to vacate the Vacation Property no later than 10:00 a.m. at the end of your ZINDIS scheduled reservation; it is essential for our housekeeping and maintenance crews to stay on schedule and have access to the rental at check-out time. A $50 late check-out fee will be applied and taken from your damage deposit for any unscheduled check-out occurring between 10:00 a.m. and 12:00. Unscheduled checkouts after 12:00 will be charged for an additional night.
NOTE: To request an early check-in/late check-out at no additional cost, please email reservations@ZINDIS.com at a minimum of 48 hours prior to your flight arrival or 48 hours before departure.
FALSIFIED BOOKINGS: If your booking was made under false pretense, including, but not limited to, a falsified name, age or size of party, you will be subject to immediate cancellation of your reservation, removal from the property, and forfeiture of all amounts paid.
UNITS FOR SALE: In the event the Property, which you are renting, is listed for sale, the need to show the Property may arise during your stay. We will make every attempt to schedule any showing at a convenient time so as not to disturb your vacation.
LIMITED SHORT-TERM RENTAL: It is expressly understood and agreed that this is a short-term, transient vacation rental and is not a lease or other long-term residential tenancy agreement, and that the Vacation Rental is not intended to be utilized as a primary residence. This Agreement is only for the licensed use of the Vacation Rental for the stated reservation dates. It creates no property rights in you and no rights to renewal or for recurring usage. If you hold over after the expiration of your reservation dates, your extended stay, if authorized, will be from day-to-day only and will not constitute a renewal or an extension for any further term. In such case, you will be liable for paying for the additional day(s) at a rate equal to two (2) times the nightly rate set for the property on the dates of your holdover, plus the actual costs of re-accommodating future tenants that were scheduled to use the Vacation Rental during such dates. You may not sublet the Vacation Rental or any part of it and shall not assign any interest (in whole or in part) to this Agreement or any rights hereunder.
CANCELLATION POLICY: Please review our cancellation policies listed below and contact us with any questions or clarifications needed prior to booking. Vacation properties are rented far in advance and it is therefore difficult to fill a vacancy as the lease term approaches.
All cancellations must be in writing.
Cancellations more than 60 days prior to your arrival will be refunded the entire amount paid toward your reservation less any processing fees.
Cancellations within 60 days prior to your arrival will be issued a voucher that you can use on the same property within 6 months with the exception of holiday dates. If the rental rate for the voucher dates are greater than than the origional reservation the differeance will need to be paid before the voucher reservation can be confirmed.
Cancellations made within 14 days of arrival date or "no-shows" are not eligible for refunds or reschedule requests.
Early Departure: No refunds will be given for early departure.
RESCHEDULING & CHANGES: Changes to your reservations (date changes if reducing number of days, number of persons), the first change is free, subsequent changes will be charged a change fee of $15 or 5% of change amount -- whichever is greater. We highly recommend purchasing travel insurance from a third party to cover a cancellation. Please read their exclusion clauses thoroughly.
A START-UP SUPPLY: For your convenience, the ZINDIS Group provides a basic start-up set of supplies upon your arrival. Our start-up supplies include toilet paper, one on the holder and one extra under each bathroom sink, roll of paper towels, dish soap, dishwasher and laundry detergent, garbage bags and hand/body soap. There is a comprehensive grocery store in Playa Hermosa and several in Playas del Coco where you can obtain most anything extra you might need.
TRASH REMOVAL: To avoid odors in the home as well as attracting the local wildlife, we respectfully request that you dispose of all waste in the outside dumpster during your stay and upon departure. Locations for trash disposal are posted in each villa.
SMOKING: All properties managed by the ZINDIS Group are non-smoking units. Please smoke in the designated areas only or on the balcony (if applicable) with your patio door closed. Violators will incur an additional charge of $250 or greater. Please also make sure your cigarette trash is disposed of properly and safely to avoid any burns or fires.
PET DEPOSIT: If you are renting a home that allows a pet, an additional deposit will be required. SPECIAL NOTE: A pet will only be allowed in a home upon approval from The ZINDIS Group, and must be disclosed at the time of booking. The deposit will be determined based on the home rented, the pet being allowed and the length of the stay.
REPORT DAMAGE AND NEED FOR REPAIRS: The ZINDIS Group and our homeowners make every effort to assure your vacation home is in working order prior to your arrival. In the event that there is a malfunction, it is considered the responsibility of the Guest to notify us immediately and we will make every effort to rectify the situation in a timely fashion. We will not be held accountable if the problem is not reported to the ZINDIS Group. The Guest agrees to allow employees of ZINDIS Group or their agents to enter the premises to make necessary maintenance repairs. Please note: No refunds will be made for mechanical failures of appliances and/or electronics or interruption and/or loss of utilities.
NATURAL DISASTERS: The Guanacaste Region of Costa Rica can experience thunderstorms, high winds, drought, fires, earthquakes, and other natural occurrences that can at times cause water rationing or outage, power outages, and internet and cable failures. We apologize ahead of time if any of these events cause an inconvenience during your time here; however, the ZINDIS Group will not be held responsible for such natural disasters and no refunds will be given.
WILDLIFE: The ZINDIS Group is not responsible and no refunds will be given for wildlife, insects, or other natural phenomena that may occur during your stay. Please be aware that Costa Rica has a healthy ecosystem and you will be visiting a tropical environment. Our rental homes are professionally exterminated on a regular basis. Should you encounter the need for additional extermination services during your stay, please feel free to contact us.
INTERNET ACCESS: The ZINDIS Group will not be responsible for interruption of these services or problems with computers or handheld devices. Systems at the rentals usually work the same as they would at your own home, occasionally a cable box, modem or router will need to be rebooted, (unplugged and plugged back in after 10 seconds). Refunds will not be given for interruption of these services.
TELEPHONE: In villas that have landline phones, you are welcome to use them to call anywhere in Costa Rica. Out-of-country calls are not permitted on local phones. Guest will be charged for any long-distance (outside Costa Rica) charges and fees.
LIABILITY AND DAMAGES: The landlord, its agents, servants, officers, and owners, direct or indirect, shall not be liable for any claims with respect to. (A) any death or injury suffered by tenant or any employee, contractor, licensee, invitee, guest, agent or customer of the tenant (each, a "Tenant Party") or any other person, from any causes whatsoever. (B) any loss or damage or injury to any property outside or within the property belonging to the tenant. Any tenant party or any other person and tenant agrees to indemnify and hold harmless the landlord for any damages (including reasonable attorney’s fees) that result from such loss, damage, or injury. The property shall be secured while unoccupied. Thefts of landlords’ items within the property that result from the tenant’s failure to keep the property secured shall be reimbursed by the tenant to the landlord. No illegal drugs are to be present on the property.
LOST & FOUND: The ZINDIS Group is not responsible for any lost, stolen, or damaged personal items. Any personal property the ZINDIS Group discovers after the Guest’s tenancy will be held for 30 (thirty) days from the date the item was found. If the Guest does not claim his or her lost personal property items within the 30-day period, the ZINDIS Group will donate or dispose of the personal property items. Guest will be responsible for paying any and all shipping and handling charges necessary for the return of items.
NOISE & DISTURBANCES: Guest will behave in a civilized manner and will be a good neighbor respecting the rights of surrounding property owners, Howneonwer Association, and other guests. Guests will not disturb, annoy, endanger, and/or interfere with surrounding property owners and guests. We have a zero-tolerance policy for any house, fraternity and/or bachelor/bachelorette type parties with excessive use of alcohol or illicit drugs in or at the property. If there is damage or we are called for a disturbance related to such activity, we will call local law enforcement to handle the situation. If excessive noise or disturbances occur resulting in notification by Homeowner Association, Police, or Neighbors the guest will receive 1 warning. If we receive a second complaint guest will be charged $250 and or vacate the Property and will forfeit the reservation and any monies paid. Quiet hours are from 10 p.m. to 8:30 a.m. Furthermore, for guests renting properties located within developments and/or associations, the guest agree to follow any and all HOA Guidelines. A copy of these are available for your review within your vacation home.
AIR CONDITIONING: Our area maintains an air temperature between 70F-110F year round. Tenants understand that if they lower the Air Condition lower than 73F, 23C that you risk freezing up the unit and therefore, damaging the AC unit. No units will achieve a temperature lower than 73F. Tennant agrees to maintain temperature above and close all windows and doors closed during usage. Abuse of the Air Conditioning and/or electrical systems could result in loss of damage deposit. Maintenance repairs that are considered related to not following the above guidelines will result in loss of damage deposit. If guest finds that the vacation home is not cooling sufficiently, they are responsible for notifying the ZINDIS Group immediately so that an evaluation can be made of the situation.
KEYS: Some sets of keys have alarm, garage, and gate clickers. Lost, stolen or damaged set of key(s), alarm clickers or garage/gate openers will result in a charge of up to $250 (key-dependent).
RATES: All published rental rates are subject to change without notice. Please understand a rate is not confirmed until a deposit is made. The ZINDIS Group reserves the right to correct rates that may have been misquoted due to human and/or computer errors.
SUBLETTING: Subletting is absolutely not permitted! Tenants who sublet may be subject to fines and/or immediate termination of this rental agreement. Guest(s) agrees that the ZINDIS Group or it agents may enter the premises for the purpose of making necessary repairs or maintenance when deemed necessary by the rental agent or owner.
AMENITIES: The ZINDIS Group Corp, LTDA cannot warrantee/guarantee amenities provided by or through any homeowner associations, including, without limitation, pools, hot tubs, clubhouses, tennis courts, golf facilities, grounds, and picnic & bike paths.
DISPUTES: This Agreement shall be governed by and interpreted in accordance with the laws of Costa Rica. Tenant agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by The ZINDIS Group enforcing this agreement.
ZINDIS ACTIVITIES CANCELLATION POLICY: Tours and activities booked through our Zindis Adventure Department. Tours or activities cancellations more than 48 hours prior to scheduled day will be refunded the full amount paid less any processing fees. Cancellations made within 48 hours or "no-shows" are not eligible for refunds. Tours, activities or services re-scheduling must be requested at least 36 hours in advance. Activities, tours or any service must be paid in full prior to the realization. If rescheduling is not possible because of the weather conditions, we will refund 100% of the amount paid. Cancellations MUST be notified via email to adventures@zindis.com
