Scheduled Appointment Time
Punctuality is essential for maintaining the flow of scheduled appointments. Should you arrive more than 15 minutes late, your session will be deemed cancelled, and please note that your retainer will not be refunded under any circumstances. Additionally, if you are late, the time lost cannot be reclaimed, as there are other clients booked immediately after your appointment. We appreciate your understanding and commitment to respecting the scheduled time.
Deposits and Retainers
In the event of a cancellation, the retainer fee of $50 will be forfeited. Should you need to reschedule your appointment, a fee of $35 will be assessed, and you are allowed a maximum of two rescheduling requests. Please ensure any rescheduling is communicated in advance to avoid additional fees. Failure to adhere to this policy may result in the loss of your retainer and limited options for rescheduling.
If you are a Pop Up/Vendor/Food Truck service, you can cancel within 7 days of our event. If it is within the 7 days you will forfeit your rental fee. If Elaine Griffin Photography Cancels your service, you will receive a full refund IF the cancellation occurred prior to your agreed arrival date and time.
Payment and Payment Plans
Your retainer for services will be applied to your balance due if applicable. Your balance must be paid in full the day prior to the scheduled session to secure your booking. If you opt for one of our memberships or payment plans, it is essential to adhere to the specified payment dates. Failure to comply with the agreed-upon payment schedule may result in the cancellation of your session and the forfeiture of any deposits made. We appreciate your understanding and commitment to timely payments to ensure a smooth and enjoyable experience.
Model Release
By signing this agreement, you acknowledge that Elaine Griffin Photography is the sole owner of all images captured during your session. Elaine Griffin Photography retains the right to utilize these images for various purposes, including but not limited to print media, social media platforms, in-person sales, promotional materials, and contests. This usage may include displaying the images publicly and sharing them to promote the services offered. Your consent to this clause allows for the effective marketing and representation of the photography services provided.
Live Pet
The Client acknowledges that they assume full responsibility for any live pets they bring into the session, including any liability for damages or injuries that may occur. In addition, should the Client participate in a session featuring live chicks, bunnies, or any other small animal, they agree to be responsible for their actions and any consequences arising from such interactions. Please note that no large animals are permitted during these sessions to ensure the safety and comfort of all participants.
Pop Up Vendors
Elaine Griffin Photography may engage Pop Up vendors at certain events to enhance the overall experience for attendees. However, it is important to note that Elaine Griffin Photography is not liable for any services rendered by these vendors, including but not limited to quality, reliability, or safety. Clients are responsible for independently contracting and managing any services they wish to obtain from these Pop Up vendors. By participating in events featuring such vendors, clients acknowledge and accept this stipulation.All outdoor tents must have reliable weights if they are using a tent. If the winds are above 30mph, tents will not be permitted. If you are a using a tent, it must be weighted down and secure. Any permits and licenses required are teh responsibility of the vendor.
Studio Space Usage and Responsibility
The Client agrees to use the designated event space with care and return it in the same condition as it was provided. Any damages to the space, furniture, or equipment caused by the Client or their guests will be the Client’s financial responsibility.
If food and beverages are served during the event, the Client is responsible for ensuring cleanliness and proper disposal of all waste.
If alcohol is served, the Client assumes full responsibility for maintaining a safe and controlled environment. The Client agrees to monitor alcohol consumption to prevent overindulgence and assumes all liability for any incidents related to alcohol consumption. The Studio and its staff are not responsible for any issues, damages, or legal consequences resulting from alcohol consumption during the event.
By signing this agreement, the Client acknowledges and accepts these responsibilities.
Copyrights and Print Release
Elaine Griffin Photography retains exclusive rights to all images captured during the session, ensuring that the integrity of the original work is maintained. Clients are permitted to crop images but are strictly prohibited from altering them in any manner, including the use of social media filters. For those wishing to print the images through their own lab, a print release can be purchased, granting permission to reproduce the images while adhering to the established guidelines. The preservation of the original quality and artistic vision is paramount, and any unauthorized modifications are not allowed.
Digital Image Delivery and Storage
Digital images will be delivered on the agreed-upon date and time, ensuring timely access to your gallery. The images will be available for download for a period of 30 days following your session, after which the gallery will expire. To safeguard your investment, your digital images will be securely saved and backed up. It is recommended to download your images promptly to avoid any potential loss after the gallery’s expiration. Should you need your gallery uploaded again there will be a $35 fee for processing time. The gallery will again expire after 30 days.
If you are a Pop Up/Vendor/Renter/Food Truck, any agreed images taken by Elaine Griffin Photography are the sole owner to the images. It is to Elaine Griffin Photography to provide any images to the client that are for business related promotions.
Student and Intern Mentorship
Occasionally, Elaine Griffin Photography may include an assistant, intern, or student in the mentorship process during the course of our collaboration. By signing this contract, you acknowledge and agree to their presence in relevant discussions and activities. If you prefer not to have them present, please reach out to Elaine Griffin Photography to discuss your preferences. Your cooperation in this matter is appreciated, as it enhances the learning experience for all parties involved.
Fore Majeure
In the event of unforeseen circumstances such as natural disasters, severe illness, or other events beyond our control, we reserve the right to reschedule or cancel services as necessary. We understand the impact these changes may have on our clients and will make every effort to communicate promptly and fairly accommodate any adjustments required. Our goal is to ensure minimal disruption while maintaining the integrity of our services. Clients will be informed of any changes as soon as reasonably possible, and we will work collaboratively to find suitable alternatives.
Chill and Unexpected Awkwardness
At Elaine Griffin Photography, we prioritize creating a light and calm atmosphere for all our clients, as we believe this enhances the overall experience. If at any point you feel uncomfortable or perceive a shift in this ambiance, we encourage you to communicate your concerns to us promptly. Your feedback is invaluable in helping us maintain a positive environment tailored to your needs. Our goal is to ensure that your experience with us is nothing short of exceptional.
In the event of an unplanned awkward moment (such as an unexpected sneeze, a wardrobe malfunction, or an accidental faceplant into the backdrop), both parties agree to laugh it off and embrace the chaos. The photographer reserves the right to capture the moment, but only if it will contribute to future hilarious laughs. No blooper-like images would be used without the clients consent.
