OPT Cap-Gap Extension Request Form

Purpose

This form is used to extend work authorization for F-1 visa holders on OPT who have applied for an H-1B visa, but whose OPT authorization will expire before the October 1st turnover date to H- 1B status. Once an H-1B petition is filed the cap-gap will automatically go into effect and will extend work authorization until October 1st of if the application is approved, or until a decision has been made regarding the petition. Although the cap-gap authorization is automatic, it is important that students submit this form for reporting requirements. .
How to Request an H1-B Cap-Gap I-20

Submit the following documents.
- Completed Cap-Gap Extension Request Form
- Copy of current OPT/STEM OPT EAD
- Copy of H1-B Filing Documentation
  Please note that documentation indicating your H1B registration was selected does not qualify you for Cap-Gap. Your H1B petition (Form I-129) must be filed in order to qualify.
Please allow 15 business days (minimum) for processing of your request and issuance of the Cap-Gap I-20.
