Session Contractual Agreement Details:
- As agreed upon by the signed party(s) Katerina Marie Photography. Art. Designs. is the exclusive sole professional photographer hired to perform the photographic services to the above session.
- The 100% retainer fee (non refundable deposit/portion of package) officially holds the date requested to perform the photographic duties.
- The signed party(s) agrees to pay Katerina Marie Photography. Art. Designs. the remaining balance of the session at the designated times listed above on the first of those months or at signing based on the package selected.
- When hired for out of town/city/state services it is understood that the traveling quote not included in the agreed upon rate and Katerina will need to be reinbursed or prepaid for the travel expenses as they become available. Katerina Marie Photography. Art. Designs. will be responsible to book her flight, hotel, and additional traveling expenses so that the responsibility does not fall onto the client signed party(s). The client understands that Katerina Marie cannot make any travel plans until the travel expenses have been paid.
- It is understood that all sessions will be held at locations in Hamilton County Indiana that have been approved upon by the photographer, Katerina. Locations outside of Hamilton County will need approval from Katerina. If a location requires a fee, the client will be responsible for paying that in full.
- It is understood that these special mini photogrpahy sessions are solely for an individual, their spouse/significant other and children are able to participate. This is not for extended family portraits or groups over 6 individuals.
- It is understood that Katerina Marie cannot be held responsible for flight cancellations or any other "Act of God" that prevents Katerina Marie Photography. Art. Designs. from performing their hired duties. It is understood by the client that all travel fees are non-refundable.
- In the event that the scheduled session(s) become rescheduled for weather, Katerina will do her best to accommodate schedules. There will be no refunds.
-In the event that the payment of the remaining balance is not paid by the 1st of the designated month(s) and/or is paid with insufficient funds the signed party(s) agrees to pay Katerina Marie Photography. Art. Designs. a $50 per day late fee plus the remaining balance in full in the form of Square invoice. If this time period goes longer than 7 days past due Katerina Marie Photography. Art. Designs. will consider the contract void and will send the signed party(s) an invoice for the accrued balance and daily late fees assessed. Consequentially the session will not be covered by Katerina Marie Photography. Art. Designs. LLC.
- If the signing party selects the monthly payment schedule, it is understood that they are requried to pay the monthly fee for the full year. If the signing party decides to cancel their package, it is understood that they will be requried to pay the remainging balance that is due. For example, if the client selected the 12 month option and decides to cancel in October, they are still required to pay for the months of October, November and December. After canceling the package, the remainging balance will be due in one final payment via the method of Katerina's choosing.
- Any discounts given at the time of signing will not transfer into upcoming years of this package offering.
- The signed party(s) agrees that they are hiring Katerina Marie Photography. Art. Designs. for her distinctive fine art style of shooting and editing. They trust her judgement and expertise in how each photo should best be shot, edited, and presented. If for any reason they may possibly not like or are not pleased with the final results it is understood that Katerina Marie Photography. Art. Designs. does not provide refunds for unsatisfied work (nor gives transfer credits) under any circumstance. If additional editing is requested regarding the delivered gallery images, a fee of $100/photo will be charged.
-The signed party(s) will receive their photography digital gallery, disc, or USB drive of images no longer than 25 weeks from the avoce stated session date.
- In the event that Katerina Marie Photography. Art. Designs. is unable to uphold their obligations as stated herein, due to any unavoidable “Act of God”, the signed party(s) will be entitled to receive 100% of their monies paid back.
- In the event that the signed party(s) are unable to uphold their obligations as stated herein, to any unavoidable “Act of God” to herself or her family, they will be entitled to receive partial monies paid. A fee equal to the session cost is kept for the time, loss of potential profit and duties already performed. Subsequentially the above party(s) and their families will be relieved of any further obligations hereunder and are not responsible to uphold this contract.
- If litigation arieses due to any unavoidable Act of God neither the signed party(s) or Katerina Marie Photography. Art. Designs. LLC will be able to prosecute.
- In the event that the signed party(s) voluntarily cancels this contract for any reason other than an unavoidable “Act of God” there will be no refunds given under any circumstance at any point of the contract duration. The cancellation must be made in writing to Katerina King. Consequentially the signed contract will be voided immediately following the cancellation and any monies paid are kept.
-In case of camera body equipment failure, battery failure, memory card corruption failure, hard-drive failure, computer failure or any unavoidable “Act of God” that could potentially result in a loss of images there is no refund given under any circumstances to the signed party(s). If litigation arises due to any equiptment failure the signed party(s) will not be able to prosecute.
Photo Release & Copyright Notice:
- All digital photogrpahs are copyrighted, trademarked and are exclusive property of Katerina Marie Photography. Art. Designs. This copyright prohibits the signed party(s) from making reproductions of the original work in lure to profit from it. This also prohibits any additional editing to be performed by the signed party(s) or another source.
- The above party, by their execution of this contract, hold the right to print their photographs for personal, not-for-profit, use only.
- The signed party(s) gives Katerina Marie Photography. Art. Designs. full photo release and permission to use any photographs that were taken during any of the contracted duties for marketing, promotional, publication, website, and social media purposes.
-If the subject is under the age of 18 years, the signed party(s) gives Katerina King (Foster) and Katerina Marie Photography. Art. Designs. LLC the right to share photos from this session in marketing materials and on social media platforms.
The Terms and Conditions of this contract agreement have been read,
understood, accpeted and contracted to the client party and
professional photographer hired for the services. By e-signing or
physically signing this document it is understood that this contract will
be legally bound between client and photographer from the date it is
signed forth. This contract does not expire. Once this contract is signed
AND the deposit is received the event date listed will be covered by the
hired photographer, Katerina King of Katerina Marie Photography. Art.

All parties understand and agree to all that is above.
Client(s) agree(s) to only sign if they have read and agreed to the terms of service in this contract and they believe all information is deemed correct to the best of their knowledge.
