            • ** The above figures show the paid in full amount for each length of contracted time.  You may only 3, 6, 9, 12 month incriments.  The weekly option is if you choose to pay your contract out weekly instead of paid in full.  Should you decide to pay weekly you may elect to pay via PayPal, cash or check.  If you choose to pay weekly via PayPal, payment for that week is due by Friday afternoon by 1pm eastern time.  If by check or cash, payment for the week is due at the conclusion of Friday night's show assuming you have elected to receive service on Friday & Saturday night.  If you opt to pay in full you will be required to remit payment via PayPal upon signing this agreement.**

            • Performer & Client Terms & Conditions

            • Let it be know that On the above stated date, you the above named representing the above named establishment (hereafter referred to as 'client') enter into an agreement with Nuthin But the Tunes (hereafter referred to as 'performer') to retain the services of the performer for the purposes of providing DJ entertainment in your establishment.  The client and the performer agree in good faith with each other on the conditions of this agreement, length of service and rate of pay.  It is strongly recommended that the client read this agreement in its entirety.  There will be several points within this agreement where the client will initial off to ensure the portion was read and understood.

            • Performer Rights & Responsibilities

            • The performer agrees to provide DJ service for the duration of most recent agreed upon length of service.  The performer will take special care to play only type of music specified by the client.  The performer will arrive a minimum of 20 minutes prior to the agreed upon start time of the show.  the performer will conduct himself in a professional manner at all times.  The performer will at all times make the client aware of any issues that may hamper the performers ability to provide service on a given night (ie: a show booked for a private client, illness or inclimate weather.)  The performer will not seek payment for dates not worked.  

              The performer may not consume alcohol while working the show(s).  However, the performer may request a soda or water at no charge to the performer.  The performer may also order food, but only from the appetizer menu at no charge to the performer.  The performer may order more expensive items off the establishment menu but must pay full price or a discounted price at the discresion of the client.

              The performer will work with his or her own equipment and music, unless the establishment has a DJ booth available for use.  The performer may hook up to the establishments house speaker system if a connection is available.  If not, the performer is responsible maintaining a good working rig.

              The performer may not request tips from establishment patrons but may accept tips if offered.  These tips do not count towards the balance due and are not required to be reported to the establishment.  Performance is based on a 4 hour show but the performer may be asked to work extra hours in a given evening at an over time rate of $50.00 per hour over the 4 hours worked if the performer chooses to do so.

              The performer in a concerted effort with the client will advertise the client via all means available to include signage, social media or website at no charge to the client.

            • Client Rights & Responsibilities

            • The client retains the right to decide the type of music to be played in the establishment (ie: rock, hip hop, metal, dance, edited/unedited, etc.)

              The client retains the right to pick the nights (a mandatory 2 nights) of performances, set the length of contract which informs the rate of pay.

              The client has the right to expect total professionalism from the performer.  Further, the client has the right to expect punctuality, open lines of communication and adherrance to music guidelines set forth by the client from the performer.

              The client is responsible for providing a safe venue to work in.

              The client is responsible for providing enough room for gear.  The performer requires at least (2) six foot long tables (or) enough tables to reasonably equal out to (2) six foot long tables.  If the client has a DJ booth available it may be offered as a set up location.

              The client is responsible for providing a power source to power equipment.

              The client is required to maintain an open dialogue regarding instances where the performer's services may not be needed on a date that would normally be worked, a 3 days in advance notice is recommended (ie: booking a local live band, renting the establishment out for a private event, closure of establishment due to weather, building repairs, etc.)

              The client may terminate agreement.  However, contract termination for anything outside of violation of the terms of this agreement will be subject to an early termination penalty (ie: client agrees to 6 month contract but terminates agreement 2 months into contract for no reason inside of this agreement, client is subject to early termination penalty which requires the client up to 2 months of the remaining time left on the contract in one lump sum immediately.)  An exception to this may be a going out of business liquidation and documented proof of going out of business will be required.  The client may need to negotiate lower rates with the performer in a time of economic downturn but if mutually agreed upon that a rate cannot be agreed upon, the agreement may be terminated with no penalty.

            • You, as the appointed representative of the above named establishment recognize on the date stated above that you have read and agree with all terms and conditions of this contract.  Your digital signature below signifies you have no questions or issues with the above stated terms and conditions.  Thank you for choosing Nuthin' But the Tunes to provide the entertainment for you and your patrons.  We look forward to a long and mutually prosperous working relationship.
