Witness this Agreement by and between Equine LEAD, LLC, hereinafter referred to as “Manager” and Participants Name Hereinafter referred to as “Rider,” “Visitor,” and “Boarder,” if said person is a minor, said person’s Parent or Guardian.
In consideration received and in return for the use, today and on all future dates, of the property, facilitates and services of Manager, Manager’s instructors, employees and agents, Rider, Rider’s heirs, assigns and representatives, hereby agree to follows:

Rider/Visitor/Boarder agrees to assume any and all risks involved in or arising from such person’s use of the premises or presence upon the property as above described and the facilities included but not limited to bodily injury and physical harm to horse, rider, participant or spectator. Thereon, including, but not limited to, risks of death, bodily injury, property damage, falls, kicks, bites, bolts, collisions with vehicles, other horses, or stationary objects, fire, explosion, limited emergency medical care availability or the negligence or deliberate act of any other person. Rider/Visitor/Boarder acknowledges that horses, by their very nature are unpredictable and subject to animal whim, which may include behavior including but not limited to kick, bite, shy, buck, stumble, bolt or rear. It is not possible to predict a horse’s reaction to sound, movements, objects, persons or animals or the hazards of surface or subsurface conditions. Rider/Visitor/Boarder assumes all risks in connection therewith and expressly waive any claims for any injury or loss arising there from. Rider/Visitor/Boarder agrees to abide by and follow the rules and regulations of the facility which shall be posted and/or available from the facility Manager. Rider/Visitor/Boarder further acknowledges that the behavior of any animals is contingent to some extent upon the ability of Rider/Visitor/Boarder. Rider/Visitor/Boarder assumes all risks therefore and warrants a full and fair disclosure or Rider/Visitor/Boarder’s abilities have been given to the Manager and Instructor.

Rider/Visitor/Boarder or Parent or Guardian agrees to hold harmless, indemnify and defend manager against and hold harmless from any and all claims, demands, causes or action, damages, judgments, orders, costs or expenses, including attorney’s fees, whether actually incurred or not, which may in any way arise from or bring in any way connected with Rider/Visitor/Boarder’s use of or presence upon the property of Manager and the facilities located thereon. In the event Rider/Visitor/Boarder is a minor, the parent or guardian shall further indemnify, defend and hold Manager/Instructor harmless from any such claims by said minor child.

Rider/Visitor/Boarder has been advised to wear an ASTM/SEI certified horseback riding helmet and to provide such a helmet for any minor child that takes riding instruction from Equine LEAD, LLC and its instructors. Rider/Visitor/Boarder acknowledges and agrees that this helmet wearing requirement is mandatory. Rider/Visitor/Boarder voluntarily assumes the risk of injury, death, or any other loss if Rider/Visitor/Boarder fails to wear an ASTM/SEI horseback riding helmet at any time during mounted activities.

In the event Rider/Visitor/Boarder is using Rider/Visitor/Boarder’s own horse, or a horse(s) not owned by Manager, Rider/Visitor/Boarder warrants said horse(s) shall be free from infection, contagious or transmittable diseases. Manager reserves the right to refuse access or use of any horse upon the premises if same does not appear to Manager to be in good health, or is deemed dangerous or undesirable.

Rider/Visitor/Boarder agrees to waive the protection of any applicable statues in this jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing said release.
In consideration, therefore, for the privilege of riding, observing, working with and/or engaging in lessons, training, workshops and related educational activities with the horses and other animals at Equine LEAD, LLC, the Undersigned does hereby agree to hold harmless and indemnify against all claims, Equine LEAD, LLC, its owners and employees, Equine LEAD, LLC, Deborah O’Brien and any Equine LEAD instructors, interns, barn staff, or apprentices and any and all of their Heirs and Assigns (the Indemnified Parties) and further releases from any liability or responsibility for accident, damage, injury, or illness to the Undersigned Participant and/or Parent/Guardian of the Participant, or to any family member or spectator accompanying the Participant on the premises or around the horses owned or leased by the Indemnified Parties.
WARNING- All activities involving horses, donkeys, mules, or ponies have inherent risks for participants. Illinois law protects operators, owners, trainers, promoters and others from liability for injuries which are the result of an equine animals’ behavior.
