Please read each section carefully and digitally sign. This is a contract between Murat Uzman Photography (herein noted as "Photographer") and you representing anyone being photographed within your party during the said session (herein noted as "Client").
A. Session Fees
The Client shall pay the session fee in full at the time of booking unless other arrangements made. The non-refundable session fee formally books your portrait appointment and covers time and talent of the Photographer, any pre-session consultation through email, by phone, or in person as needed, post-session basic retouching and creative editing of images, and an Online Proofing Gallery. It does not include any prints or products.
B. Ordering Products
Clients may purchase products from the Online Proofing Gallery, during the viewing/ordering appointment if one scheduled, or directly through contacting the Photographer. The proofing gallery will be made available approximately 2 weeks after the session. Clients have 30 days to give their order, at which time the online proofing gallery will be deactivated. There is a $35 fee to reopen the proofing gallery. Clients are not obligated to purchase any products if they choose not to.
C. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their session (including parking fees), the client will be responsible for such fees. Creative session fee covers travel within 30 minutes of Hampton Twp, PA. Any location outside of these limits will be subject to an additional charge of $.57/mile as part of the agreement.
D. Rescheduling
Client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, the session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond his control.
E. Re-shoots / Refunds
Re-shoots are determined at the discretion of the Photographer. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the session fee to the client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order. In the unlikely event that the finished product from a portrait session is unusable due to camera or memory card failure, Photographer will reshoot at no additional charge. Re-shoots and refunds will not be given for any other reason.
F. Model Release
Displaying art of work created by the Photographer in his website and portfolio or as studio samples are expected and necessary means for the Photographer to show talent and capabilities to prospective customers.
Photographer reserves the right to use the photographs from the session in his own promotion, advertising and marketing including, but not limited to, displaying the same in his website and portfolio, samples, blog and social media, and on print or online medium.
G. Sneak Peeks
The photographer occasionally posts one or two images from the Client's session on his business page in social media (e.g., Facebook and Instagram) as "sneak peeks" within a day or two of the session. The watermarked images posted as sneak peeks can be tagged and re-shared by the Client even if the pictures were not purchased.
