Lori Keskimaki Photography

***  Compensation:  For Sevices rendered by Lori Keskimaki Photography as required by this Agreement, the Client will provide the compensation to the photographer of the fixed amount checked above this clause along with the deposit specified below. 

 Terms of Payment:  A non-refundable deposit of $50 is due at the time of booking. All session deposits and fees are non-refundable. You will be invoiced for the remainder of the balance the week before the sesson date. All balances must be paid in full prior to the session date.Payments are only accepted online via Paypal, credit card, or debit card. No checks or cash will be accepted for the mini-session.

Client Repsonsibility:   It is the client's responsibility to record the date and time of this session on his/her personal calendar.  Faillure to show up at your session appointment will result in forfieting your deposit.  Upon resceduling you will be responsible for a new deposit to hold that date and time.

Communications:   E-mail is the preferred form of communication.   All communications from Lori Keskimaki Photography will come via e-mail as this is the easiest form of communication and allows for organized electronic files.  You will recieve  a series of e-mails between now and Session date.   These e-mail contain very import information that will help ensure a successful session.  Please do not delete any of the e-mails as you may need ot refer to them in the future.  The client must agrees to checking their e-mail on a regular basis before booking this session.

Cancellation Policy:  In the event that you need to cancel, please notify me as soon as possible, but no later than 24 hours before the session, and I will reschedule your session at a more convenient time.  A session that is not rescheduled within 7 days of the original appointment will forfiet their deposit.  Photographer cancellation:   In the event that I need to cancel, I will contact you as soon as possible to reschedule.  Photographer cancellation includes, but is not limited too:  weather (as deemed in the opinion of the photographer),  illness, family emergency, and equipment malfunction.  No shows and cancelled session are finacially responisble for any custom items and props ordered specific for your sesison an d willbe deducted form your deposit.

Other Photographers: Other photographers are prohibited during the session, as this is a distraction and can inhibit the quality of the photos. In addition, you are contracted with only Lori Keskimaki Photography for this session. Therefore, It is understood that Lor Keskimaki Photography is the exclusive photographer retained to perform the photographic services requested on this contract.

Taking Photos: Taking photos on a cell phone or any other camera is not allowed during a studio session, as the props, lighting, backdrops, etcetera have been purchased and are property of Lori Keskimaki Photography.   In addition, Lori Keskimaki Photography also has the education and experience to posing maternity, family, and newborns. Any photos taken by a client during the sesison will  in result in an automatic charge for the current digital image rate as listed on the wesite.  You may ask permission to take photosduring the session that include the photographer in the photo only.  All photos taken must be sent to Lori Keskimaki for approval before sharing on social media.   

Mini- Session:  Sessions are approximately 10 minutes and includes the number of digital images that you selected and 4 x 6 prints that correspond with the digital images. Although I strive to get many poses during your session, there is no guarantee that any pose will be achieved or perfect. Every person photographs differently and what I get depends on, but is not limited too: the cooperation of the subject, time of day, and weather. Reshoots are not availble for mini-sessions.

Photographic Style:  I have read the "Investment and Information" concerning maternity and/or newborn portriat sessions which is located in the drop-down menu on Lori Keskimaki Photography's website.  I have also veiwed the frequently asked questions and behind the scenes links on the website.  In addition, I have also viewed Lori's sample work on her "blog" and "Look Book" that is also located on Lori Keskimaki Photography's website.  This agreement validates that I acccept Lori Keskimaki Photography's photographic style and is one of the reasons that I am choosing Lori to photography.  Although, other ideas are welcomed, do note that Lori is not a "Pinterest" style photographer and has had many hours of professional training in order to create the professionally styled and posed newborn images.  Specialty edits are an additional fee. Lori Keskimaki photography uses only the highest quality props that are specially made for newborn photography.  Lori Keskimaki Photography cannot be held responible for items you bring that do not fit well, photograph well, or flow cohesively with the colors or theme.  Therefore, you are also required to purchase any or all digital images that photograph any items/props that you choose to bring to the session.

Online Proofing Gallery:  Your images will be hosted on an online digital gallery for 60 days at no charge while you are deciding how you want to share and display your portriats. You may share this gallery with friends and family to make it easy for others to choose images of your new bundle of joy too. Once your gallery expires you may purchase additional storage space to  host your images for $10/month.  This fee will come out of your deposit.

Also note that you will be previeiwng your images in my studio on a screen that has been color calibrated.  The computer used for editing your images is also calibrated regularly to match the color profile of professional labs.  Viewing your images on a home computer, cell phone, or other device is likely to illustrate poor color representation as those devices are not specified to a professional lab's high color profile representaion.   Therefore your images may look different on your home viewng device than on the porfessional equipment that will be use to preview you images.   

Preveiw Changes: If you decide you would like me to make any changes to any of your online previews, please let me know within 5 days of the date your previews are ready for previewing. After 10 days your files will only be availble per the website. (Postponing your preview session may lower or eliminate the number of days alloted to make any changes.)

 Digital Images:  3-5 downloadable digital images are included in your session (along with matching 4 X 6 prints). Puchased digital image files are a "Print Release" and permitted for personal use only. This will allow you non-profit personal print usage for the images purchased. The Copyright remains with Lori Keskimaki Photography. In accordance with the USC Title 17 (Federal Copyright Law) authorization is not permitted for the commercial use of images as Lori Keskimaki Photography retains the original copyright. This includes, but is not limited to, commercial advertising, editorial use, entering contests, or any event where you could potentilally profit from the use of the image. Files may not be copied, scanned, sold, edited, altered, or published, under any cirumstance without written permission from Lori Keskimaki Photography. Violators of this Federal Law will be subject to its civil and criminal penalties.

Prints:  Your digital images will be uploaded to a printing lab that I recommend. Professional cameras have a lvery arge color profile. Consumer labs like Walmart, Walgreen, Shutterfly, Snapfish, etc.. have low color profile printers and will therefore, distort the color of your professional images. It is a 100% guarantee if you print your images any plac eother than my recommendation tha tyou will have color distortion. I highly recommend that you print your professional images at www.mpix.com versus a consumer lab. Mpix has high color profile printers, but offers prints at a low price. We will discuss this further at your pick up appointment.

Ordering:  Once decisions have been made, then you are ready to place your order.   All orders must be e-mailed (orders through texts and social media messages will not be accepted).  Please note that an additional 25% deposit of the order total is required for all orders.  This is in addition to the deposit paid at the time of booking.  

* No part of any order will be delivered until the balance for the order is paid in full.

All products and print orders are final and cannot be returned as they cannot be resold.   Please choose your product sizes carefully and utilitze the services offerered by Lori Keskimaki Photography to help you choose the proper size images for  displaying.  

Payment plans are avialble upon request.   You will pay an additional 25% down upon ordering and the remaining balance can be paid over a period up to 12 months.  A $25 minimum monthly payments is required.  There is a $15.00 late fee.  Missed payment will be charged a 7% APR interest will be charged on the remaing balance of any missed monthly payments.

You may pay for your order with Paypal, credit, debit, or cash. 

Changes: Prints and  products are subject to change at anytime. The charges in this contract are based on the Photographer's Standard Price List.  This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

 Tax and Shipping:  Shipping fees and MI 6 % sales tax applies to all print/product orders.

 Force Majuere:  Life In MotionPhotography is not in breach of contract nor liable for events that are beyond control which prevents the Party from complying with any of its obligations under this contract including, but not limited to:  Acts of God (fire, weather, flood, etc...), illness or emergency, unavailibity of goods, default of suppliers or sub-contractors, loss or breakdown of caryying vessel, industrial action/strike, embargo, government action, pandemic, war, threat of war, terrosit, blockade, revolution, riot, or civil commotion. In addition, this limited liability shall also apply in the event that photographic materials are damged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.  In the event that the Photographer fails to perform for any other reason, Lori Keskimaki Photogprhy and Life In Motion, LLC shall not be liable for any amount in excess of all monies paid.

Limitation of Liability:  The Client agrees, to the fullest extent permitted by law, to limit the liability of the Photographer and Photographer's associates on the service provided for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorney's fees and cost and expert witness fees and costs, so that the total aggregate liability of the Photographer and all those named in association shall not exceed the Photographer's total fee.  It is intended that this limitation apply to any and all liability or cause of action however alleged or uprising unless otherwise prohibited by law.

Release:  I,  for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably author Lori Keskimaki Photography, (Life in Motion, llc) to use photographs of me and or my property and authorize him/(her/their and his/her/their assignees), licensees, legal representatives and transferees to use and publish (without my name or company name) photographs, pictures, portraits or images herein described in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, editiorial, advertising, education, publishing (including publishing in electronic form on CDs or internet websites and social media), for any product or services, portraiture contests, gainful profit, or other lawful uses as may be determined by the photographer or studio named here. I further waive any and all rights to review or approve any uses of the images, any written copy or finished products. I release and discharge Lori Keskimaki Photography from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom he/she took the photographs.
 

For valued consideration, I hereby authorize the above photographer permission to use names(s) of the photographed subject on social media in conjunction with photographs for the purpose of "Sneak Peak"previews.  I authorize the the following:

 Term of Agreement:  The terms of this Agreement will begin on the date of this Agreement and will remain in full force and effect until the completion of the Services.  Therefore, upon signature Lori Keskimaki Photography shall reserve the time agreed upon per e-mail and or messaging.  The deposit is non-refundable, even if the portrait session is rescheduled or cancelled according to the terms in this contract. 

I am a legal competent adult and have the right to contract out my own name.  I have read this document and fully understand its contents.  This release shall be binding upon me and my heirs, legal representaion, and assigns.  I am the parent or legal gaurdian of the person(s) being photographed in acoordance with this contract.  

I have read and understand the information on Lori Keskimaki Photography's wesbite about the service and session type that I am booking.

I understand that once I click on submit the form I will be taken to the payment center to pay my deposit which will secure my spot on Lori Keskimaki Photography's calendar. The information on the form will be lost if the deposit is not paid. Also note that all required fields, including state and country, must be completed in order to submit your form.
