Photography Session Contract
Client has hired Carmen Dunham Photography ("CDP") to photograph themselves and/or their family and has purchased high-resolution digital files from Client's photography session with CDP. This Photography Session Contract form (the "Agreement") is intended to define the rights of CDP, on the one hand, with respect to those files and any resulting digital or print images.
Retainer. Client agrees to pay CDP a retainer at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that is applied toward the session of the Client. If the retainer is not submitted within 24 hours, this contract will be null/void and the session will be cancelled. The remaining balance is due at the time of the session.
Rescheduling. Should the session be postponed as a result of inclement weather, serious illness or inury of either party, or any other cause not under the direct control of either party to this contract, neither party will be held to the terms of this agreement. When the event is rescheduled, Client agress to give CDP first opportunity to provide photography services under the same terms and conditions. Should CDP be unavailable for the rescheduled date, a full refund is due.
Copyright and Licensing Notice
Limited License. CDP retains the copyright to all images under U.S.C. Title 17 (US Copyright Law). Client is hereby granted a limited, world-wide license by CDP to reproduce the images and make an unlimited number of prints for personal use only. Permissible personal use under this limited license includes, but is not limited to: printing, copying, emailing, and web publishing.
Client may post any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram, etc.) and/or share or use any digital files from either Facebook or my website, provided that Client may not alter the image in any way and that client will use only the watermarked images (which CDP will provide). The prohibition against altering images includes adding any filters, re-editing images, cropping images, and/or removing the watermark on images. Any such alteration constitutes infringement of CDP’s copyright.
No Editorial Use. Client may not use any CDP images for editorial purposes of any kind and may not enter any CDP images into competition without the express written permission of CDP.
No Commercial Use. Client may not use any CDP images for any commercial purposes, including but not limited to: advertising, stock photography, print sale profits, resale of any nature, or any use that results in financial gain.
Limitation of Liability. Client’s purchase of the original files releases CDP from any liability due to loss or damage of the images, and also releases CDP from any obligation to maintain copies of any digital file, image, or photograph.
CDP’s Use of Images. Client hereby grants to CDP the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use, unless otherwise expressly agreed between Client and CDP beforehand. CDP agrees to limit the use of these images and photographs to promotional use only.
CDP may revoke this license at any time and for any reason.
By purchasing high-resolution digital files from CDP, Client agrees to the above terms.
