Accordingly, please forward the release of lien on this property to World Class Title with a copy of this letter. In the event that the above-referenced mortgage is an equity credit line account, please accept this as authorization to close this line of credit and to accept no further advances on this account. In the event that this loan is set up on an automatic payment plan, please discontinue the service immediately. OWNER'S AFFIDAVITThis property is owned by me/we. No other person has the possession or any right to possession of the property or any interest therein, including oil, gas or other minerals, or any contract or option rights to purchase or acquire other than in the transaction this affidavit is given.
This affidavit is given to induce the settlement agent, title insurance agent and title insurance underwriter to disburse any funds held as settlement agent and/or to issue a title insurance policy or other title evidence. Each person (individually or in their capacity as an officer or a corporation or partner in general or limited partnership) signing below indemnifies and agrees to save harmless the settlement agent, title insurance agent and/or title insurance underwriter against any loss or expense, including attorney fees, sustained as a result of any of the foregoing statements not being true and accurate.
WIRE AUTHORIZATIONIn order to facilitate the closing referred to above, the undersigned does hereby direct, authorize and instruct World Class Title ("Title Agent") to wire funds in the amount reflected on line 603 of the settlement statement due to the undersigned from the closing. The undersigned is aware that the bank listed above may charge a wire receipt fee and accepts the responsibility of any such FEE. In order for World Class Title to facilitate the wire transfer, you must attach either a voided check or wire instructions on your bank's letterhead. Undersigned(s) does hereby jointly and severally agree to indemnify and hold World Class Title and our underwriter harmless from, but not limited to, any and all loss, costs, damages and expense of every kind which they shall or may suffer or become liable for due to their authorization from the statements or terms made herein.
ACKNOWLEDGEMENT CONCERNING TAX PRORATIONThe undersigned, being the buyers and sellers of the premises referenced above, hereby acknowledge that the tax proration reflected on the settlement statement was based on the most recent available tax rate and valuation provided by the County Auditor's Office, whether or not certified, and they hereby consent to the same. The Buyers and Sellers further agree to hold World Class Title harmless for any tax increase or decrease occasioned by millage or valuation changes, retroactive revaluation, change in land usage, or loss or any homestead status.
COMPLIANCE AGREEMENTThe undersigned Seller(s) on this date of purchase/sale, if requested by World Class Title, to fully cooperate and adjust for errors, ommissions or corrections of any of all closing documentation if deemed necessary or desirable, in the reasonable discretion of World Class Title. It is the intention of the undersigned that all documentation for this transaction and all payments or disbursements made shall be an accurate reflection of the parties' agreement, and each party shall pay all costs and expenses associated with their agreement and/or as dictated by custom and usage in this area. The undersigned Seller(s) do hereby so agree and covenant in order to assure that this documentation executed this date will conform to the parties' agreement. It is understood that World Class Title will rely upon this agreement and the covenants herein in closing this transaction. In the event said parties are executing documents at two different locations and/or different dates, said closing and transaction is closed in escrow (not final) until all required parties to the transaction have fully signed, delivered and complied with all required documentation, conditions and funds to finalize the transaction. Some costs reflected herein may be based on good faith estimates that require post-closing adjustments. Any variations in actual costs from those reflected in the closing statement, which result in an overage or shortage less than $50.00 shall be credited to or debited against the Closing Agents Fees. The undersigned Seller(s) agree to comply with the above-noted requests by World Class Title within five (5) days from date of notification of said request by World Class Title.
WATER AND SEWER CHARGES NOTIFICATIONThere may be unpaid charges for water and/or sewer services furnished to the property being purchased and that no allowance for such charges was made or taken into account on the closing statement. These charges may not now be a lien against the property, but if not paid, they could become a lien at a later date or in lieu thereof, the local authority furnishing such services if such charges are not paid. The title insurance policy being furnished to Buyer(s) does not insure against the filing of any future lien or the termination of service which could result from such charges, if any, remaining unpaid.
LIMITED POWER OF ATTORNEYThe undersigned hereby appoints World Class Title and/or its assigns, to be my (our) attorney in fact (Agent), to act for me (us) only as to the matters of this transaction. In the event a clerical or typographical error is discovered on any document pertaining to this transaction, my (our) Agent, and /or its assigns, is hereby authorized to correct any clerical or typographical error and to initial, sign, seal and deliver as my (our) act, any instrument which my (our) Agent determines to be necessary to effectuate the correction. Specifically, my (our) Agent may make a correction limited to the matters state below on an original document, and is authorized to rerecord that original document where appropriate. The undersigned declares that any and all corrections made by said Agent shall be as valid as if the same had been initialed, signed, and delivered by me (us) personally. The undersigned ratifies whatsoever my (our) said Agent shall lawfully do or cause to be done in the correction of clerical and typographical errors as limited below.Limitations:-My (our) agent is authorized to correct clerical and typographical errors as to the names of the parties to this transaction; the legal description, county or address or the real property which is the subject of this transaction; the date of any document; and/or execute any instruments reasonably necessary evidencing such matters.-My (our) Agent is not authorized to make any changes or corrections as to the interest rate stated on the security instrument or promissory note; the amount of principal indebtedness stated on the security instrument or promissory note; or the amount of consideration stated on the security instrument. This Power of Attorney is made of my (our) own free will for the purpose of facilitating necessary corrections. The undersigned understands that signing this Power of Attorney is not mandatory.The Powers granted to Agent hereunder shall terminate three (3) months from the date stated hereinabove, unless otherwise extended by the undersigned in writing.
ACKNOWLEDGEMENT OF PURCHASE CONTRACTSeller(s) and Buyer(s) acknowledge that the terms of the sales agreement have been met by all parties and said contract is valid as of the date of closing.
WEBSITE, INTERNET AND SOCIAL MEDIA RELEASE FORM (OPTIONAL)I/we consent and authorize World Class Title Agency, LLC (“World Class”) to take photographs or produce videotapes, audiotapes, web casts and/or other types of media productions that capture my/our name(s), voices(s), and/or personal image(s) or the images of the exterior and/or interior of any real estate that I/We are selling/purchasing in which World Class is handling the closing of the transaction (hereinafter these types of media are collectively referred to as “Materials”).
I/We authorize World Class to copyright the Materials which shall be become their sole property, and I/We authorize World Class to use, reuse, copy, publish, display, exhibit, reproduce, license to and/or share with a third-party that may or may not be an affiliated entity, and to distribute the Materials in promotional materials or other forms of media which may include, but are not limited to World Class’ website, social media sites (e.g. Facebook, Instagram, Social MLS, Twitter, You Tube, LinkedIn, etc.), or any other internet site deemed appropriate by World Class for the promotion of its business. I/We also agree that World Class may identify me/us by name, street name, city and state. I/We agree that I/we are participating on a voluntary basis and that I/we will not receive any compensation from World Class for signing this release or as a result of the use or publication of any Materials. I/We hereby release World Class, its representatives, employees, managers, members, officers, directors, and affiliated companies from any and all claims and demands arising out of or in connection with any use or publication of said Materials, including without limitation, all claims for invasion of privacy, infringement of my right of privacy, defamation and any other personal and/or property rights.I acknowledge that I am at least eighteen (18) years of age and that I am the owner of any real estate which may become part of the Materials referenced above.
NOTICE OF AVAILABILITY AND OFFER OF CLOSING PROTECTION COVERAGEPursuant to Ohio Revised Code Section 3953.32, you are hereby notified of the availability of Closing Protection Coverage in connection with the above-referenced transaction for the premium stated in the Offer of Closing Protection Coverage outlined below. Closing or settlement of a real estate and/or mortgage loan transaction can be characterized as having two components. One component pertains to the title to the Premises and the title insurance policy therefore. The other component pertains to the handling of funds and documents by the Licensed Agent . A title insurance policy does not cover losses due to the mishandling of funds or documents by the Licensed Agent. However, Closing Protection Coverage, as outlined below, does provide such protection. Description of Coverage: The Closing Protection Coverage indemnifies you against the loss of settlement funds resulting from any of the following acts of the Licensed Agent or anyone acting on behalf of the Licensed Agent, subject to certain conditions and exclusions specified in the Closing Protection Coverage Form:
(1) Theft, misappropriation, fraud, or any other failure to properly disburse settlement, closing or escrow funds; and(2) Failure to comply with any applicable written closing instructions, when agreed to by the Licensed Agent.You are covered by a Closing Protection Coverage Form only if it is specifically addressed to you.
