Terms & Conditions of our Agreement
Kindly read our Agreement outlined below, then please sign and complete your payment, all of which executes and confirms our agreement.
OVERVIEW
I desire a wonderful experience and a high quality product for each of my clients. This Agreement helps both of us achieve that objective by communicating and agreeing on each of our expectations; for the experience and for the product . . . both of which are an investment of time, talent, and treasure to bring precious memories and joy for a lifetime. Thank you for the opportunity to serve you, and for your attention and completion of this important framework of understanding between us. I look forward to serving you!
1. PHOTOGRAPHY SESSION ORDER:: This Agreement is your purchase order for photography in the form of digital images and/or prints and products. We agree that there are no oral or other agreements between the parties, and this contract represents a full and complete understanding and agreement between us; the Client and the Photographer.
2. LIMIT OF LIABILITY:: Although care will be taken with the digital files, the Photographer limits any liability for loss, damage, or failure to deliver photographs for any reason of Photographer's non-performance caused by any force majeure or similar circumstances, major debilitating illness, accident, or any cause beyond their control. In any event, the limit of Photographer's liability shall not exceed the contract price stated herein.
3. EXCLUSIVE PHOTOGRAPHER:: We agree that no other photographer, amateur or professional, may be allowed to photograph at the session while the Photographer is working. The Photographer is executing her craft within time, space, lighting, and communication constraints and must efficiently and effectively manage the complete photo shoot environment, without interruption, distraction, or competition for subject’s attention, in order to deliver the experience and product we each desire. Without adherence to this important portion of our Agreement, the Photographer cannot assure the quality of the experience and product. In the unfortunate event that the Client is unable to maintain and control this aspect of our agreement during the session (including iPhone photography), the Photographer will communicate a correction/warning during the session, and if it persists, may at her discretion withdraw from the session without refund of any session fees and with no liability of the Photographer.
4. ARCHIVAL OF IMAGES: The Photographer desires that her work is valued and achieves the mutual objectives with the Client. The Photographer will make the product available and deliver the product in the time periods outlined elsewhere in this Agreement, but will not guarantee archival of the digital files beyond a period of four weeks after the session/event date.
5. DISPLAY OR PROMOTION:: It is agreed that the Photographer may display and use photographs from the session/event for her website and internet promotional marketing material, as well as any other non-commercial purposes, all without Client’s name attribution.
6. RETAINER FEE:: Upon payment of the retainer fee, the Photographer reserves the time and date agreed upon and will not make other reservations for that time and date. For this reason, the retainer fee is non-refundable, even if the photo session is cancelled for any reason by the Client.
7. GUARANTEED DELIVERY:: Photographer agrees to have images available for viewing no later than four weeks following the session date.
8. EMPLOYMENT:: This contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.
9. SESSION TIMELINESS:: With respect to timing, each session will begin at the agreed upon time. If the Client is running a little late, the session may remain to the agreed upon length. If the Client is more than 20 minutes late, a re-schedule may be necessary with an additional, non-refundable Retainer Fee. Any re-schedule will be set at the earliest mutually available appointment date and time.
10. WEATHER: With respect to weather, Photographer will use her discresion and communicate if weather is unsuitable for a photo session and will make contact for a proper rescheduling of the session at no additional cost to the client.
11. CLIENT COOPERATION:: The Photographer desires a wonderful experience and amazing product that will bring a lifetime of pleasure in the homes and families of her Clients. Clearly, to achieve this objective each subject must cooperate, and take and act accordingly with the instructions of the Photographer to obtain the proper expressions, lighting, spacing, etc. The Photographer will utilize all of her professional training and interpersonal skills to achieve this result, however in some cases the cooperation may not be achieved. In this unfortunate situation, our Agreement simply states that the Photographer is not at fault for any lack of cooperation that may be experienced with children, adults, or any subject being photographed. It is understood between us in this Agreement that if the Photographer, after repeated attempts to obtain cooperation, determines it necessary due to lack of cooperation of subjects, Photographer may terminate the photo shoot and ask for a rescheduled photo shoot, which may in turn require payment of an additional Retainer Fee.
12. PRINT RELEASE and OWNERSHIP OF IMAGES:: The Photographer owns full copyrights to all images. If a print release is given with DIGITAL images, clients may self-print on their own accord from any vendor they may select. However, the Photographer will NOT guarantee the quality of the product when Client does any self-printing. The Photographer will ONLY guarantee the quality of the product when printing of images is contracted directly through Jenna Reyna Photography.
13. EDITING and ALTERING of IMAGES:: This important point of our Agreement confirms between us that the product images that the Photographer delivers are given in their final edited form and may NOT be edited in any way by anyone, including adding filters. We agree that the finished artwork product that the Photographer delivers is the copyrighted image and is final.
