ENLIZABLE, LLC, d/b/a DFW BUBBLE BASH/BUBBLE BASH
PARTICIPANT AGREEMNET & RELEASE OF LIBALITY 

 

This Agreement is intended for adult participants and for parents or legal guardians signing on behalf of a minor participant.

1. Agreement

In consideration of being permitted to enter the activity area and/or participate in Bubble Bash activities, I voluntarily agree to all terms and conditions contained in this Agreement on behalf of myself and, if applicable, any minor participant for whom I am legally authorized to sign.

2. Released Parties

For purposes of this Agreement, the "Released Parties" include Enlizable, LLC d/b/a Bubble Bash and DFW Bubble Bash, together with its owners, members, managers, officers, employees, referees, instructors, volunteers, contractors, agents, representatives, sponsors, affiliates, equipment suppliers, insurers, venue owners, property owners, municipalities, school districts, churches, parks, homeowners' associations, corporate clients, event hosts, successors, assigns, and all other persons or entities involved in organizing, sponsoring, operating, or facilitating Bubble Bash activities.

3. Assumption of Risk

I understand that Bubble Bash activities—including but not limited to Bubble Soccer, Bubble Football, Bubble Bash games, relay races, obstacle courses, team-building activities, warmups, demonstrations, equipment use, setup, teardown, and related activities—involve inherent and unavoidable risks.

These risks include, but are not limited to:

●      collisions with participants or objects;

●      falls;

●      slips or trips;

●      uneven or natural terrain;

●      hidden obstacles;

●      equipment malfunction or misuse;

●      participant misconduct;

●      weather conditions;

●      heat-related illness;

●      dehydration;

●      insect bites or environmental hazards;

●      concussion;

●      traumatic brain injury;

●      spinal injury;

●      fractures;

●      sprains;

●      paralysis;

●      permanent disability;

●      property damage;

●      serious bodily injury; and

●      death.

I understand these risks may arise from my own actions, the actions of other participants, the condition of the premises, the condition of the equipment, or the ordinary negligence of a Released Party.

I knowingly and voluntarily assume all such risks, whether known or unknown, even if such risks result in serious injury or death.

4. Release and Waiver of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, I RELEASE, WAIVE, COVENANT NOT TO SUE, AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, LOSSES, LIABILITIES, COSTS, AND EXPENSES ARISING OUT OF OR RELATING TO MY PRESENCE AT, TRAVEL TO, PARTICIPATION IN, OBSERVATION OF, OR DEPARTURE FROM ANY BUBBLE BASH ACTIVITY, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

This release does not apply to claims that cannot legally be waived under applicable law.

5. Participant Health Certification

I certify that I am physically capable of participating in Bubble Bash activities.

I further represent that I do not knowingly suffer from any medical condition that would make participation unsafe, including but not limited to serious heart conditions, uncontrolled seizures, recent surgery, serious neck or spinal injuries, or any other condition that may be aggravated by vigorous physical activity.

I agree to immediately discontinue participation and notify Bubble Bash staff if I become dizzy, injured, ill, or otherwise unable to safely continue.

6. Participant Conduct and Safety Rules

I understand that Bubble Bash has established safety rules to reduce the risk of injury and equipment damage.

I agree to:

●      follow all instructions provided by Bubble Bash staff;

●      wear Bubble Bash equipment only as instructed;

●      keep shoulder straps and safety equipment properly secured;

●      wear closed-toe athletic shoes while participating;

●      refrain from intentional head-first collisions ("bull charging");

●      never intentionally strike or collide with a participant who is on the ground;

●      never intentionally kick, punch, trip, tackle, flip, or otherwise intentionally contact another participant except through normal gameplay using the inflatable bubble;

●      remove jewelry, watches, keys, phones, or other sharp objects before entering the bubble;

●      never participate while under the influence of alcohol, illegal drugs, or any substance that impairs judgment or coordination;

●      immediately report damaged equipment or unsafe conditions; and

●      immediately stop participating whenever instructed by Bubble Bash staff.

Bubble Bash reserves the right to remove any participant whose conduct is unsafe, disruptive, abusive, or inconsistent with these rules without refund.

7. Supervision

Bubble Bash staff are present to facilitate activities, explain rules, officiate gameplay, and promote participant safety. They do not provide childcare, custodial care, or continuous supervision of participants.

Parents, legal guardians, teachers, coaches, group leaders, and other responsible adults remain solely responsible for supervising participants in their care before, during, and after Bubble Bash activities.

8. Equipment Responsibility

I acknowledge that Bubble Bash equipment has been inspected prior to use.I agree to use all equipment only as instructed and to exercise reasonable care while it is in my possession.

I accept responsibility for any intentional or reckless damage I cause to Bubble Bash equipment beyond normal wear and tear.

9. Indemnification

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from any claims, liabilities, damages, judgments, attorney's fees, costs, or expenses arising from:

●      my conduct;

●      my violation of this Agreement;

●      my negligent or intentional acts; or

●      the conduct of any minor participant for whom I sign this Agreement.

10. Parent or Legal Guardian Consent

If signing on behalf of a minor participant, I certify that I am the minor's parent or legal guardian and have legal authority to execute this Agreement.

I consent to the minor's participation, acknowledge the risks described herein, agree to this Agreement on the minor's behalf to the fullest extent permitted by law, and agree to defend, indemnify, and hold harmless the Released Parties from claims brought by or on behalf of the minor arising out of participation.

11. Emergency Medical Authorization

In the event of an emergency, I authorize Bubble Bash staff to obtain emergency medical treatment for myself or the minor participant if I cannot be immediately reached.

I understand Bubble Bash has no obligation to provide medical care and accept full responsibility for all medical expenses incurred.

12. Property Damage

I accept responsibility for any intentional or reckless damage caused by me or any minor under my supervision to Bubble Bash equipment or to the property of others beyond normal wear and tear.

13. Media Release

I grant Bubble Bash, Enlizable, LLC, and its designees the perpetual, worldwide, irrevocable, royalty-free right to photograph, film, videotape, record, and otherwise capture my likeness, image, voice, and appearance during participation.

I authorize the use, reproduction, publication, editing, distribution, display, and promotion of such media in any lawful manner and in any existing or future media, including websites, social media, advertising, promotional materials, educational materials, and marketing campaigns, without inspection, approval, or compensation.

14. Governing Law

This Agreement shall be governed by the laws of the State of Texas without regard to conflict-of-law principles. Any legal action relating to this Agreement shall be brought exclusively in the state or federal courts serving Dallas County, Texas.

To the fullest extent permitted by law, the parties knowingly waive any right to trial by jury.

15. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding participation in Bubble Bash activities and supersedes all prior oral or written understandings regarding participation.

This Agreement shall survive completion of the activities.

Electronic signatures and electronically executed copies shall be treated as originals and shall have the same legal effect as handwritten signatures.
