  • Client Portrait Agreement/Contract & Copyright

  • 1. Session Fees Client agrees to pay photographer a retainer of $200 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee this will be used as your session fee. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer. You can view your Portraits online in a password protected gallery. Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase. 2. Location Costs & Fees If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 10 minutes of Kallangur. Any location outside of these limits will be subject to an additional charge of $50 Travel fee as part of the agreement. 3. Rescheduling/Cancellations If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. 4. Re-shoots / Refunds Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. 5. Archive After three (3) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. 6. Payment All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received. 7. Damage Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by mail. Client assumes all responsibility for the safety of all portraits upon receipt. 8. NO ELETRONIC DEVICES Cameras, cell phone cameras, and camcorders are not permitted during sessions. 9.Digital Images. If the client purchases the digital download of images, Callie Crawley Photography will provide printing instructions. To ensure the best print quality, avioid altering the images before printing. The photographer is not responsible for printing errors or for quality of prints or products printed eleswhere. 10.Copyright Laws/Model Release. Callie Crawley Photography retains the copyright on all images (even those purchased) and reserves the right to use the images for advertising, display, publication, or other purposes. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons includied in the portrait in this manner and shell indemnify property of this Studio/Photographer. Under no circumstances, can a client use these images for profit, commercial endeavors, professional display, or in competitions. Copying or scanning images from the client's gallery,Callie Crawley Photography's website or Facebook is considered stealing, regardless of the intent for use. NOTICE OF COPYRIGHT: It is ILLEGAL to redistribute these photographs for profit or use other than private consumption without the photographer's permission, and violators of this Federal Law will be subject to its civil and criminal penalties. 11.Liabiltiy. Client is aware that the quality of the end result print of the digital files delivered is not under the control of the photographer and frees the photographer from any liablitiy for any claims whatsoever based upon discoloration in the end result print. If the photographer cannot fullfill this Contract due to fire or other casuality, strick, act of God, or other cause beyond the control of the parties, or due to the Photographer's illness or emergency, then the photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing. lost through camera or malfunction, lost in the mail, or otherwise lost or damaged withut fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount n excess of the retail value of the client's order. The client releases Callie Crawley Photography, from all liabilities, clains and damages that may result from any accidents or incidents that may happen during the session. All images are copyright under the Federal Copyright Laws and subject to fines of up to $150,000 if breaking those laws. By signing this contract you agreeing not to copy, save, or reproduce images in any way. This includes copying and saving images from the website, blog, Facebook, or any other form of advertisment. Model Release I hereby give to Callie Crawley Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. Liability Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them. A typical newborn session last 1-4 hours. In order to guarantee the client 15-20 images, the photographer must complete her typical workflow before attempting any special request from the client. The completions of all special request are left to the discression of the photographer. If it is determined by the photographer that your newborn needs to be rescheduled within the first 45 minutes of your session, the photographer will reschedule your newborn session at no charge. It is strongly advised that you have a pacifier accessible for the session even if you don't intend on using one on a regular basis. Session Requests *Session starts at the agreed upon time. It is strongly encouraged that client arrives 10 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins. *Please do not bring any children not being photographed to the session. A typical session will need you to assist me and sometimes this is not possible when having to attend to other children. Whilst it is not ideal to have other children present i know that some people will have no options and that is fine. *Please make sure hair is combed and face is clean and free of runny noses or eyes. Your Session Sessions are conducted at the photographer's home located at Kallangur. The client should take the time to review samples of the photographer's work to make sure that her style of photography and editing is a good fit. When a client books with Callie Crawley Photography, he/she gives the photographer full reign over session styling and artistic editing of photos.  The photographer will be choosing the best of the images to edit and present so if the client sees anything that he/she doesn't care for during the session, he/she should PLEASE speak up.  It is Callie's goal to provide all clients with pictures that they will love.  If the client is opposed to any of this, Callie's style of photography may not be a good fit. Better to discuss this now then after the session as there are no refunds. After the session The client will receive an email and/or message to view an online gallery within 3 weeks of session, this gallery will be available for a week (1 week). The client will choose their images from this gallery according to the package they have chosen and the fees are payable before orders are sent to print . The client is to receive the contents that are in the package they choose and purchased. Digital Files will be made available to download via your gallery once payment is received. A cd can be requested at additional costs. Please note, again, there no refunds or exchanges on fees paid due to the custom nature of portrait photography.*
