Check the following statements in agreement to the terms and conditions. Terms and conditions of J.M. Photography, hereafter reffered to as Photographer. (By checking the boxes below you are agreeing to the terms and conditions of this agreement.)
*Weather Conditions - If, in the opinion of photographer, inclement weather or other adverse conditions prevent the creation of the photographs to meet artistic standards of the Photographer, Photographer may elect to use an alternate location or to reschedule the session.*Cancellation/Late Policy - If the Client cancels this agreement before session, retainer fee paid to the Photographer will be transferable to a newly scheduled date, within 30 days. If Client fails to cancel session and fails to show up for session, retainer fee will be NON transferable and NON refundable. A session is deemed cancelled if Client arrives 20 minutes past the scheduled session time. The photographer reserves the right to reschedule due to illness, equipment malfunction, or other circumstances beyond her control. Accurate measures will be done by the Photographer to recommend alternate local photographers. Cancellations made by the Photographer will result in a refund of the retainer fee.*Liability - The Photographer is not responsible for any injuries incurred by the photographic parties. Clients will be responsible for their children and themselves, and release the Photographer from any claims.*Travel/Location Fees - Travel time is included in the session fee unless over 20 miles from the 60477 area code or for a newborn session to take place in Clients home, in which a flat fee of $50 will be applied to session package price. Client is responsible for covering additional fees and costs related to location choice (admission fees, parking fees, etc.)*Cooperation - Client agrees to positive cooperation and communication for the best possible result within the definition of this session. Photographer is not responsible for key individuals' failure to be present or cooperative during the session. Photographer will not tolerate verbally or physically abusive behavior, nor will Photographer share her time or compete with guest photographers for the attention of the subjects, unless a second shooter is hired by the Photographer. If the Client fails to cooperate, resulting in an unacceptable degree of misconduct, or damages the equipment of the Photographer, it will result in an early or immediate departure of the Photographer. The Client understands that in such an event, no refunds will be given. The Photographer reserves the right to leave the session at any time.*Non-Guarantee - Although all possible care will be taken to produce photographs of all requested poses during the session, Photographer cannot place an unconditional guarantee on the above. Photographer will not be held responsible for any ruined photographs due to shadows, lighting, flashes due to guests' cameras; or any other ruined photographs due to any other cause in or outside of Photographers control. Neither party will in a breach of contract due to, flood, fire, warfare, government laws, or regulations, equipment malfunction, and/or conditions beyond their control. Should this become an issue, photographer has the right to decide on how to resolve this matter by offering a re-shoot of the session as the first option, if a re-shoot is not possible, it will be at photographers discretion to decide if a refund is appropriate.*Proof Gallery - An edited proof gallery will be presented via jennifermenaphotography.zenfolio.com for viewing and selecting of final images. No original files (RAW images) will be released to secure the integrity of the Photographer and uphold her editing style. Digital files delivered in the gallery are at the artistic discretion of the Photographer, and will be selected based on quality and style.. Photographer has the right to remove any images that do not meet quality or style standards. Client understands not all images taken at session will delivered, Proof gallery will be delivered within approximately 2 weeks of session date. During all holiday or busy seasons, turn around time will be extended up to an additional 7-10 days. Client has 2 weeks to select final images for delivery of digital images, number of final images included will be based on package purchased. Additional digital images may be purchased along with professional lab prints and printed products.*Digital Files - Client may purchase additional digital images when proof gallery has been delivered. All digital images will be delivered via-web based digital download. If Client loses or damages his/her digital images J.M. Photography will not be liable for such loss or damage and is not held responsible for replacement of said lost or damaged files. If files are still archived, client has the option to purchase replacement images for $50. It is highly recommended by the Photographer, that the Client immediately backs up any digital files to an external hard drive, usb or via online cloud storage. Client has access to their final downloadable online gallery for 14 days. After 14 days a $25 fee will be applied to reopen your gallery. It is illegal to copy or reproduce these photographs elsewhere without the Photographers permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Photographer requires that images uploaded to social media include use of a watermarked image or a tag and/or mention of the Photographer and/or her Facebook page (Facebook.com/J.M.Photography).*Viewing and Printing Images - Please note that all images produced by Photographer have been done so with the use of color calibrated monitors. Monitors used by the Photographer have been calibrated with a professional imaging lab to meet printing standards, thus color change may occur when images are viewed on non-calibrated monitors. Also note that images viewed in a non professional editing program will appear less sharp than if the same images are viewed using a professional program. Printed images will be correct in color, sharpness, over and underexposure or any other deviation of original digital file that may be affected by a non-calibrated monitor and non-professional programs, that is, if the printed images have been produced by a professional imaging lab. It is highly recommended that printing shall be done through J.M. Photography to ensure quality standards of the Photographer have been met. J.M. Photography is not liable for the quality of images printed by any consumer or professional lab other than orders placed through J.M. Photography and professional lab choice of the Photographer.*Print Release - A limited print release is supplied with the purchase of your digital files to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. entering contests), selling or altering your images without the Photographers permission.*Tax - Client agrees that a 9% sales tax will be applied to the sales of any physical product sold and delivered to client by J.M. Photography. Sales tax is not applicable on non-physical item purchases such as session fee and digital download images.*Copyright - Client agrees to understands that all rights belong to the Photographer. All photographic materials, including but not limited to negatives, proofs, and previews, shall be exclusive property of Photographer. Photographer shall own the copyright of all images created and shall have exclusive rights to make reproductions and/or alterations and edits. Client agrees to not crop, alter, or edit the digital files in any way. This is to include adding filters, or converting to black and white. Black and white edits will be provided by the Photographer upon request. Only in the event of selecting a Facebook profile picture will cropping be accepted. Violators of this Federal Law will be subject to its civil and criminal penalties.*Image Processing - Photographer reserves the right to edit and retouch images in a style and manner of their choosing. This includes creative and artistic conversions to black and white or vintage color tones. Basic processing is included in all packages: color correction, facial touch-ups, cropping and exposure. Photographer will process images based on standard editing to best represent her brand and editing style.*Severability - If any provision of this agreement is held to be invalid or in-enforcable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.*Model Release - I hearby grant Jennifer Mena permission to use the photographs of the names mentioned above for any purposes, including but not limited to, advertisments, and promotional uses, commercial and non-commercial cluases, social media sharing, and/or for personal uses of her own portfolio. I also grant the owner to re-use and/or republish the photographs as the photographer sees fit, including but not limited to, contests, exibhitions, galleries and/or magazine entries. I also acknowledge that the photographs taken are the Photographers sole property and the Photographer maintains the full copyrights.
APPLICABLE LAW

This contract shall be governed by the laws of the United States in the State of Illinios, and any applicable Federal Law.
By signing the following, you are stating that you have read and understood the information in this agreement and that you are of legal age. You agree to the policies, terms, and pricing of this session agreement set forth by Jennifer Mena Photography. Any modifications need to be in writing and signed by both Client and Photographer.

NON-Refundable Retainer Fee Payment 50% retainer fee due upon booking. Your contract must be signed and retainer fee paid to book your session, dates and times will not be held without doing so. 50% balance due before your session. You will receive an invoice via email for the remaining balance, and must be paid before session begins. Editing will not begin if balance remains unpaid and may delay you gallery delivery time.
