I hereby apply for credit and affirm financial responsibility, ability, and willingness to pay invoices in accordance with the published terms. The above information is warranted to be true and complete. I hereby authorize Superior Rents & Sales, Inc. or its agents to verify and collect information, including but not limited to bank references, trade and credit references, consumer and/or commercial credit reports.
I hereby agree to pay a monthly finance charge of 1.5% on all past due balances. A balance will be considered to be “past due” if said balance is not paid by the 20th day of the month after which the statement is issued. Finance charges, if applicable, will be assessed from the original statement date. Furthermore, I hereby expressly agree that after the expiration of ninety (90) days from the date an unpaid balance becomes “past due,” Superior Rents & Sales, Inc. may increase the monthly finance charge to the highest percentage then allowed under the Missouri Revised Statutes.
I understand that failure to return rented or leased personal property within the time specified in an agreement in writing may subject me to criminal liability and prosecution pursuant to § 578.150 RSMo. I understand that failure to return rented or leased personal property having a value of under $500.00 may be a class A misdemeanor offense in Missouri, and that failure to return rented or leased personal property having a value of $500.00 or more may be a class C Felony in Missouri. Returns of the rented or leased property at the end of the lease term, but does not pay the lease charges agreed upon will subject to prosecution under § 578.150 RSMo.
I understand that Superior Rents & Sales, Inc. reserves its right at all times to assert any Mechanics’ and Materialmen’s liens that it may be entitled to through the use of rented or leased equipment for improvements made on commercial property pursuant to Chapter 429, RSMo. I hereby agree to take any steps that may be necessary to assist Superior Rents & Sales, Inc. in perfecting a lien under said chapter, including but not limited to: (i) obtaining the consent of the lien from the owner of such commercial property pursuant to § 429.013 RSMo.; (ii) notifying Superior Rents & Sales, Inc. in writing of the intent to use the rented or leased equipment to make improvements on commercial property prior to the commencement of the use of the rented or leased equipment; and (iii) notifying Superior Rents & Sales, Inc. in writing of the address and telephone number of the owner of such commercial property prior to the commencement of the use of the rented or leased equipment on said commercial property.
I hereby agree that all decisions with respect to the extension or continuation of credit shall be in the sole discretion of the Creditor.
I agree to be responsible for all costs and expenses of collection and reasonable attorney’s fees incurred by Superior Rents & Sales, Inc. in enforcing any of the provisions contained herein, or for any losses, costs, expenses and reasonable attorneys’ fees incurred by Superior Rents & Sales, Inc. as a result of its reliance on any false or misleading statements made by me herein whether or not such false or misleading statements have been made intentionally or knowingly.
By signing below, I am certifying that I have read and agree to all of the foregoing provisions contained within this Credit Application.
