Terms and Conditions:
AGREEMENT- This agreement/contract is between Janese Hockman Photography (hereafter “photographer or I”) and the undersigned client, (hereafter “client, you or your”) with the portrait session detailed below.
AGREEMENT OVERVIEW- This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties. If the Parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
SENIOR SESSION PRICING- A non refudable booking fee is a portion of the senior session price and is required for all portrait sessions. This is a non-refundable retainer and is determined by photographer. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No session date is reserved until a retainer is received. The retainer shall be applied/credited towards the session fee.
SENIOR SESSION PRICING CONT.- You will have two weeks from the date when the photographer notifies you via email that your prints and or products are available for pick up to pay for the remainder of the balance of the collection you booked. One day after and each subsequent week thereafter will be invoiced an additional fee of $25 until the invoice is paid off; fee not to exceed $300. All moneys are to be paid before any digital images, prints or any kind of photo media can be given to the client, regardless of a predetermined payment plan. (A separate check is to be paid directly to your Hair and Makeup stylist on the day of your session.
CANCELLATION/RESCHEDULE POLICY- I realize that sometimes things come up and you may have to cancel or reschedule. If you need to reschedule your session for a different date or time, please try to do so at least 7 days prior to the scheduled session date. When rescheduling with more than 24 hours notice, the non-refundable booking retainer fee you paid may be applied toward your new rescheduled session date. If the session is not re-booked within 6 months, the booking fee will need to be repaid. If you cancel or reschedule less than 24 hours before the session time, or do not appear for the session, a Cancellation Fee of $50 will be imposed.
FAILURE TO PERFORM- If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, illness, Acts of God, including but not limited to, road closures, severe traffic, weather, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less retainer fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, memory card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
Returned checks are subject to a $50.00 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by the Photographer in the event that enforcement of this contract becomes necessary. All legal action shall be taken appropriately.
RE-SHOOT- Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer will re-shoot at a 50% discount from the original session collection price. Client is then able to order prints from the second portrait session only. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera or memory card failure or exposure problems), Photographer will reshoot at no additional charge.
SICK POLICY- If in the event that you are ill/sick or are running a fever, etc. please call and reschedule your booking. I have 3 children at home and would love it if you did not share your cold/sickness with me or them:) I am happy to reschedule your booking without an additional fee. Please notify me within the 24 hours before your scheduled session. You must book a new session within 2 weeks to keep from loosing your $150 retainer fee. If in the event that the photographer is sick/ill/injured the photo session will be rescheduled at another date and time.
LATE POLICY- Since I schedule my shoots based on sunset times it is imperative to be on time to your session. When you are late it pushes everything back, from hair & make-up, travel time, etc. causing location lighting to change. If you are late up to 25 minutes, I have the right to cancel the shoot and reschedule for a different date. If you are late 26 minutes or later from your session time or you are a “no show” I will cancel the shoot and there will be a Late Fee of $50 to reschedule your session. Your booking retainer will not be refunded. You have 14 days to reschedule your session and not loose your retainer fee. In other words, DON’T BE LATE!
