In consideration of the benefits of promotional and recreational activities of The Riverside Range Gun Club, Inc. (hereinafter referred to as “Club”, and in consideration of like commitment by other members, I, apply for membership in the Club to be effective upon the acceptance of me as a member by the Board of Trustees of the Club, my payment of the annual membership fee, and my completion of the remaining voluntary legally binding agreements between me and the Club.
I acknowledge receipt of a copy of the Club’s Code of Regulations (“Regs.”) and Member Rules (“Club Rules”). I agree to follow and comply with all of the Club Rules. I acknowledge that failure to follow Club Rules or non-payment of fees/dues may result in the suspension or immediate termination of my membership in the Club as provided in the Club Rules and Regs.*

In consideration of permission to enter and use the shooting range (hereinafter, “RRGCI”) and to participate in or observe firearms related activities, I hereby agree to each of the following terms and conditions of this Agreement, and have checked each to indicate that I have read, understood and agreed to each of them: *

I have received, read and understand the Rules of the Riverside Range Gun Club, Inc. and will comply with those rules while at the RRGCI.I am familiar with and understand the operation of each firearm which I have brought, will borrow or rent for use at RRGCI, including safe handling, loading, unloading, ammunition requirements and safety features.I will report any unsafe condition or situation immediately to RRGCI Trustees and VolunteersI acknowledge and fully understand that I and all others engaged in firearms shooting, coaching, training or observation will be involved in activities that involve substantial inherent risks of serious personal injury, including, but not limited to: death, disability, severe social, emotional or economic damages and losses which may result from either my actions or inaction's or those of others using the RRGCI; such risks include, but are not limited to:My failure to abide by firearms safety rules or to properly handle firearms or ammunition;The failure of others to abide by firearms safety rules or to properly handle firearms or ammunition;Defects in the manufacture or design or other defects in firearms or ammunition;Design, damage or maintenance defects in any of the RRGCI facilities or equipment;The fact the RRGCI will not provide continuous supervision or monitoring of users and activities on the range;The possibility of exposure to lead and other heavy metals or toxins.On behalf of myself, my heirs, executors, administrators and assigns, I hereby waive, release and discharge the trustees, members or volunteers of RRGCI from any and all claims, demands, actions or lawsuits seeking damages on account of any personal injury, disability, economic loss, medical expense or death occurring to me or anyone else, caused or alleged to have been caused, in whole or in part, by negligence of the trustees, members or volunteers of RRGCI.On behalf of myself, my heirs, executors, administrators and assigns, I will indemnify, defend and hold harmless trustees, members or volunteers of RRGCI from any and all claims, demands, actions or lawsuits for any personal injury, disability, economic loss, medical expense or death occurring to me or anyone else, caused or alleged to have been caused, in whole or in part, by negligence of the trustees, members or volunteers of RRGCI.I assent to this Adult Release, Assumption of Risk & Indemnity Agreement shall be interpreted solely under Ohio and that the sole forum for settlement of any disputes will be in Ohio.I am the legal guardian, listed at the bottom of this Agreement, for any minor who will be accompanying me at the RRGCI.I take complete responsibility for any guest who will be accompanying me at the RRGCI.Release. In consideration of the Club and its Board of Trustees providing membership in the Club which permits me as a member to have access to Club facilities, meetings and tournaments (“Club Activities”), I hereby fully release and discharge the Club, its Board of Trustees, volunteers, members, insurers and agents (hereinafter collectively “Released Parties”) from any and all liability resulting from loss of life, any personal injury to myself or damage to my property which is caused in any way by the negligent acts or failures to act of Released Parties, individually or in concert, related directly or indirectly to my presence in or around the Club’s facilities and activities, including its shooting range, and other unnamed, but conceivable accidents that can cause severe bodily injury or loss of life in which a firearm is involved.Risks/Safety. I understand and agree that during daily life there are certain hazards associated with the possession and use of firearms, and being in the presence of persons possessing or shooting firearms of varying and or limited amounts of safety and shooting training and experience that may result in injuries. These include but are not limited to being shot, being struck by shrapnel or flying debris, and other unnamed, but conceivable accidents that can cause sever bodily injury or death.Indemnification & Hold Harmless. I agree to indemnify, defend and hold harmless Released Parties and their agents for any liabilities or any loss or damages whatsoever arising from, related to, or in connection with my presence in or around the Club’s shooting range. This includes, but is not limited to, any claim or liability for personal injury or damage or loss of property, which is made, incurred or sustained, but not limited to the shooting range.Ohio Law & Courts; Attorney Fees. Any and all disputes, controversies or claims arising out of or relating to this Agreement or for the breach or validity of any term or provision of this Agreement, shall be resolved exclusively by final and binding arbitration. The arbitration shall be held in Akron, Ohio in accordance with the arbitration rules of the general division of the Summit County, Ohio common pleas court. The parties shall have 5 days to agree upon a single arbitrator from a panel of arbitrators provided by the court. If the parties do not mutually select an arbitrator within 5 days, either party shall notify the court and the court shall select the arbitrator. In preparation for the arbitration, the parties agree to participate and engage in discovery in accordance with the Ohio Rules of Civil Procedure. It is the intention of the parties to participate and engage in a discovery process in the arbitration proceeding that is as thorough and cooperative as that which is provided to litigants in Ohio courts. The parties shall cooperate in providing discovery in a reasonable amount of time before the commencement of the arbitration hearing, but all such discovery that is requested by a party shall be exchanged no later than forty-five (45) calendar days before the scheduled date of the commencement of the arbitration hearing. All parties to the dispute shall be permitted to present their respective cases without regard to the formalities of the Rules of Evidence as used in the courts of the State of Ohio. The arbitrator, with the guidance and arguments of the parties, may give such weight to the matters presented as they deem appropriate. The arbitrator shall have the authority to award any legal remedy or legal relief a court of the State of Ohio could order or grant, but under no circumstances shall the arbitrator award any punitive and/or exemplary damages. The laws of the State of Ohio and Federal Arbitration Act shall govern all disputes.
Renewal Waiver
I, the undersigned, acknowledge that I have carefully read this Agreement and understand its contents. I am aware that by signing this release, I am waiving certain legal rights, including the right to sue Released Parties. CAUTION: READ BEFORE SIGNING! This document affects your legal rights and will bar your right to sue!
