Here you will find the sessions and packages I offer. You will be required to pick the apporpriate session fee for your session. This will serve as your retainer and will be required to be paid as soon as you submit this form. Your package fee will not be required until one week prior to your session.

I understand that I am required to pay the session fee in order to secure my date. If the session fee is not paid, my date cannot be guaranteed. I understand that session retainers are non-refundable. Session and Package fees do incur a 6% sales tax fee. This signed contract and the retainer deposit are required to book the portrait session and purchased package. The retainer deposit is the session fee. In the event of a canceled session this retainer deposit is non-refundable. If all package fees have been paid, it is transferable to another session. Refer to rescheduling clause for details.

I understand that once I have chosen a package, I can only upgrade, and cannot downgrade. My package fee is non-refundable as well as the session fee. I have the choice to upgrade my session once I get my gallery and can checkout there, and pay separately. Any other products outside of the package I select will have to be purchased separately. I also will be getting a special price to purchase the rest of the gallery while my gallery is open. The price depends on which package was initially purchased. Details will be sent along with the gallery email. When the 10 days is over, and then I would like to purchase the rest of the gallery, it will be whatever the current price of Full Digital Collection.

If you have a discount applicable towards your session, a full deposit is still required to book your session. The final discount will reflect on your total, and will be reflected with your package invoice's total. A separate contract will reflect your final adjusted total.

All payments can be made through credit cards (Mastercard, Visa, Discover), Paypal, cash or check. In the event the payment is made by check, and the check doesn’t clear, there’s a $25.00 return fee.

Any addendums to this contract must all be agreed upon in writing by all parties.

For full release to Winnie Bruce Photography Photography for the use of your photos, please select to agree to the following statement.

I hereby grant Winnie Bruce Photography the right to use all digital negatives and/or reproductions from my photo session for display, publication, related website and blog use, contest entry, and/or peer review. I understand that although I have personal use rights to print and share the images which result from my session in any way for my own use only, they remain the intellectual property of Winnie Bruce Photography. For valuable consideration received, I grant to Winnie Bruce ("Photographer") the absolute and irrevocable right and unrestricted permission concerning any photographs that he/she has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if he/she so chooses. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also insure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom he/she took the photographs. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.

I understand that I am required to select a package to accompany my session fee. This package fee will be paid a week prior to my session. In the event that my invoice is not paid, or if I have not made prior arrangements to pay the session with cash, or check at the session itself, my products will not be delivered until everything is paid in full. Session fees DO NOT contain any products. Products are included in the package fees only. Package fees are non-refundable, but transferable to another session.

Session Information and understanding

This contract is written for the purpose of family or personal portraits. The signing of this contract states the client’s understanding that it is their choice to participate in these photos, and the client will not hold studio responsible for any negative actions or feelings that may commence due to the images of this shoot. The client understands that they will decide whether or not these images are made public, and will make studio aware of these preferences. Based off the print/product agreement the client is agreeable to the terms, conditions, and timeline of the session, and the delivery of images and products. The client states that they are 18 years or older. If the client is not 18 years or older, they understand a parent or legal guardian is required to sign this contract as well.

Purchase of high resolution files

Upon final payment by the CLIENT, CLIENT will have printing rights of the resulting images. CLIENT is obtaining digital files for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than PHOTOGRAPHER. If CLIENT is obtaining digital files for publication purposes, PHOTOGRAPHER shall request that a credit for PHOTOGRAPHER be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so. Images will be transferred to the CLIENT under the following conditions: the negatives are the property of the CLIENT for personal use only and the purposes of reproduction (printing). Use for contests, advertising, promotion, marketing and packaging, text and graphics, cropped, altered or modified IS STRICTLY PROHIBITED. The CLIENT must obtain written permission from PHOTOGRAPHER and compensate PHOTOGRAPHER prior to an event where the CLIENT, the CLIENT’s friends and/or relatives publish or sell the photographs. Any use of digital images on social networking sites such as Facebook, Twitter, or blogs, must contain PHOTOGRAPHER’s watermark to prevent theft.

Reshoot Policy

Winnie Bruce Photography does not offer reshoots based on client’s disagreement on the artistic approach that Winnie Bruce Photography takes with her sessions. All of her work is displayed on various sources such as her business Facebook page and website. If a client does insist on having a reshoot, the reshoot will only be rescheduled with an additional session fee. A session fee will only not be required if a session is needed to be re-done, re-shot, or continued due to weather, or artistic preference of Winnie Bruce Photography.

Disclaimer

If you would like to purchase additional products or prints, please visit our website. Prices are subject to change at any time without client notification. This contract solidifies the package contents and price at the time of booking. This contract is specifically for services and products purchased on purchase date. If products are purchased after gallery is closed, and prices have changed, products will be priced at the current price, not the price at booking. Any addendums to this contract must all be agreed upon in writing by all parties. If an amendment is requested after contract is signed to any or all parts of this photography contract, an amendment penalty will be incurred to reflect any or all income loss by Winnie Bruce Photography, and hourly rate by photographer with fees starting and no less than $500.00. Winnie Bruce Photography reserves the right to deny ammendments.

Print Credit

Print credit will be activated on the day that the session is turned over. The print credit will be active for 10 days. Expiration date will be on the bottom of the gallery. If the print credit is not claimed within those 10 days, the print credit will expire. Print credit will only apply to physical prints depending on what’s included in the package. Please see Purchased Package Contents/Price. Print credit does not apply to digital products, or The Organic Bloom Frames.

Additional fees

In the event that the client specifies a certain location to be used during the shoot, the client is responsible for all location fees involved such as location access fees, parking, etc. Client is also responsible for arranging the location access and any permits/passes related to doing so. There are additional fees for the following: added time, additional outfit changes, any products/prints/services not specified in the package purchased. Reference the a la carte pricing menu for specific pricing amounts. Additional fees may be assessed for the adding of more than one person within this portrait session. Additional fees may also be required if extra editing is requested. All edits are polished off per Winnie Bruce Photography’s discretion. Any additional edits requested by client will incur a $25 fee per image.

Camera Rules

Editing and image presentation

Upon hiring Winnie Bruce Photography, client understands the style of photography and editing that Winnie Bruce Photography does. The creative session fee covers all editing. All images are processed with Winnie Bruce Photography signature post processing. Minor retouching such as skin smoothing, removal of unsightly items in the photograph, and adjusting colors are all to be done with photographer's personal discretion. Clients are allowed to ask for only ONE minor adjustment, such as head swaps, color tone change that does not stray from photographer's style, or anything that can be quickly fixed with the spot heal, or clone tool in photoshop. Any requests for re-editing after the first re-editing will be charged an additional fee. Re-editing fees start at $25.00 depending on client requests.

Image Handling

Client acknowledges that by purchasing digital goods, that they are knowledgeable in regards of how to handle the files. Files are turned over in full-resolution JPEG files. The files come with a print release, and recommended to be printed through Winnie Bruce Photography’s chosen labs. If client chooses to print through any labs other than through the photographer, Winnie Bruce Photography cannot be held responsible for how the prints turn out. Winnie Bruce Photography holds no responsibility or does not aid in assistance in handling the files, such as files being too large, too small, or not the correct color if not printed through Winnie Bruce Photography. Client agrees that by purchasing high resolution files, that they have proper knowledge on how to treat, save, download, and backup said files.

Limit of Liability

In the unlikely event that the photographer is injured or becomes too ill to photograph the session, studio will make every effort to secure a replacement photographer unless otherwise specified by the client. If the situation should occur and a suitable replacement is not found or accepted, a reshoot will be scheduled for the next available time slot. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond studio control, studio liability is limited to the return of all payments received for the portrait session. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.

Schedule Arrangements

Due to the nature of the session a strict timeline will be enforced to ensure the package obligations are met. The session will start at the scheduled start time even if the client is tardy or unprepared. The session end time will remain the same. If additional time is needed, client will have the option to purchase based off the a la carte pricing menu for additional time. If you have more than one location for your session, the travel time going from destination A to destination B so forth does count towards the total amount of the session time. The same applies for outfit changes; changing from one outfit to another does count towards the total amount of the session time. The client is responsible for providing any props or outfits that are to be used within the session. Winnie Bruce Photography will not be held responsible for additional sessions needed due to forgotten items.

Rescheduling

In the event the client would like to reschedule because of any personal reasons, illnesses, scheduling conflicts, they will have 3 months to reschedule their date. A reminder that all session fees are non-refundable, and if package fee has been paid, and reschedule was not made within 3 months from the original date, package fee will not be refundable, and a new session fee and package fee will be required to be purchased again. Client can only reschedule 2 other times. On the third re-scheduled date, client is required to pay session fee again.

Completion

Due to the nature of these sessions, completion and product delivery time may vary. Please refer to the product/print order contract for specific completion times and dates for your purchased products.Average completeion time is 14-18 business days. If your session falls on a weekend, your session will be delivered on a weekday. If client would like the images to be completed sooner than the regular turnaround time, there is a rush charge of $100.00 to complete the images before the regular turnaround time.

Retainer

This signed contract and the retainer are required to book the portrait session and purchased package. The retainer deposit is the session fee. In the event of a canceled session this retainer deposit is non-refundable. The retainer fee covers all editing, email correspondence, and customer service given to client. Under no circumstance, (i.e. sickness, relocation, personal reasons) will the retainer be refunded.

Weather

In the event that the weather conditions are not desirable for the shoot based on studio recommendations, the session will need to be rescheduled and the fee will be waived. Due to liability and equipment damages this decision will be at studio discretion. In the event that a reshoot has been scheduled due to the nature of the client appearance in the previous session, the client is held responsible for purchasing an additional package.

If client is late, without prior notice, for 30 minutes from the session start time, Winnie Bruce Photography reserves the right to leave the session location premises. Winnie Bruce Photography will make ample attempts via phone call, text message, and email to reach client. If a client does not respond to any means of communication, Winnie Bruce Photography reserves the right to retain all paid fees. If Winnie Bruce Photography is the one that is late, Winnie Bruce Photography will extend all proper communication at least 10 minutes prior to session start time. If Winnie Bruce Photography is late more than 30 minutes, a $100.00 product credit will be gifted to client.
