This Release and Waiver of Liability (the “Release”) is executed on this day of

in favor of African Promise Expeditions, an Limited Liability corporation existing under the laws of the State of Washington, USA, and any other African Promise Expedition's affiliated organizations, and its directors, officers, trustees, employees, volunteers and agents (collectively “the LLC").

 

 

 

 

 

 

I, the Participant, desire to travel on an personal development leadership retrreat expedition with African Promise Expeditions and engage in the activities related to being a participant (the “Activities”). I understand that my Activities may include but are not limited to traveling to and from projects and activities, towns, cities, or villages; consuming food and water available and/or provided; lodging in housing provided for participants; participating in a cooking demonstration; teaching a playing with children and adults at schools; constructing simple buildings and/or structures; working with people to provide basic first aid; riding bicycles; traveling by bike, foot, or bus; going on safari; participating in an optional boat ride on the Nile river; and hiking.  I further understand that I will not be compensated by the LLC for my service and/or participation.

I, the Participant, hereby freely, voluntarily and without duress execute this Release under the following terms:

 

I. RELEASE AND WAIVER.

I, the Participant, do hereby release and forever discharge and hold harmless the LLC and their successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my Activities with the LLC. 

I understand and acknowledge that this Release discharges the LLC from any and all liability or claim that I may have against the LLC with respect to any bodily injury, personal injury, illness, death or property damage that may result from my Activities with the LLC, whether caused by the negligence of the LLC or their directors, employees, agents or otherwise. I also understand that the LLC does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited medical, health or disability insurance in the event of injury illness death or property damage.

It is the policy of the LLC that children under the age of 18 shall not be allowed to participate in Activities with the LLC without the express, written consent of their legal guardian, after having been fully informed of any and all risks involved. 

I, the Participant, do hereby release and forever discharge and hold harmless the LLC from any claim which arises or may hereafter arise on account of first aid, treatment, or service(s) rendered in connection with my Activities with the LLC, or in the case of a minor child, with the decision by any representative or agent of the LLC to exercise the power of consent to medical or dental treatment as such power may be granted and authorized in the Parental Authorization for Treatment of a Minor Child.

 

II. MEDICAL TREATMENT.

I, the Participant, do hereby release and forever discharge the LLC from any claim or action whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my Activities with the LLC.

If the Participant is less than 18 years of age (a “minor”), the Participant and the parents having legal custody and/or the legal guardians of the Participant (the “Guardians”) also hereby release and forever discharge the LLC from any claim whatsoever which arises or may hereafter arise on account of the decision by any representative or agent of the LLC to exercise the power to consent to medical or dental treatment as such power may be granted and authorized in the Parental Authorization for Treatment of a Minor Child.

 

 

III. ASSUMPTION OF THE RISK.

I, the Participant, understand that my Activities may include work that may be hazardous to me, including, but not limited to simple construction; traveling to schools, towns, cities, and villages; exposure to potential illnesses; accidents. Additionally, I understand that I will be near wild animals in their natural habitat.

I also understand there is some inherent risk in consuming local foods and lodging in local accommodations in the city(ies) and country(ies) visited. I further understand I may be traveling to and from locations where there is a potential risk of war, insurrection, criminal activities, inclement weather or other circumstances that could threaten my health or safety.

I hereby expressly and specifically assume the risk of injury or harm in the Activities and release the LLC of all liability for any loss, cost, expense, injury, illness, death or property damage resulting either directly or indirectly from participating in the Activities.

 

IV. INSURANCE.

I, the Participant, understand that, except as otherwise agreed to by the LLC in writing, the LLC is under no obligation to provide, carry, or maintain health, medical, travel, dental, disability or other insurance coverage for any participant. Each participant is expected and encouraged to obtain his or her own health, medical, travel, dental, disability or other insurance coverage.  I agree to pay for any emergency medical costs and evacuations. I agree to purchase emergency medical and evacuation insurance from a provider of my choice and I will provide the LLC with a copy of the insurance policy before departure.

 

V. PHOTOGRAPHIC RELEASE.

I, the Participant, do hereby grant and convey unto the LLC all right, title and interest in any and all photographic images and video or audio recordings made by the LLC during my Activities with the LLC, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

 

VI. OTHER.

I, the Participant, expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Washington, USA, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Washington, USA. I further agree in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the validity of such clause or provision shall not otherwise affect the remaining clauses or provisions of this Release, which shall continue to be enforceable. Further, a waiver of a right under this Release does not prevent the exercise of any other right.

 

I understand that my $300 deposit is non-refundable under any circumstance. Other fees and payments are NON-REFUNDABLE as of 45 days prior to the scheduled departure. If A.P.E. cancels the trip for any reason, my $300 deposit is still non-refundable, but all other fees paid to A.P.E will be refunded.  I agree that African Promise Expeditions has the right to cancel the trip or to cancel my participation in the trip, under reasonable circumstances, at any time as long as all money I have paid to African Promise Expeditions is refunded to me. However, African Promise Expeditions will not reimburse for airfares and it is the responsibility of the participant to purchase a non-refundable ticket if they so desire and/or to get travel insurance. To express my understanding of this Release, I sign here with a witness.
