OAR Swimming Competency Self-Certification

FOR INDIVIDUALS UNDER 18 YEARS OLD: Please print out and complete the Swim Test Form with a certified lifeguard)

Rowing is a water related activity. Because rowing is a water related activity, it is critical that each rower have certain basic swimming skills to safely participate in water related activity. In order for any athlete to participate in any water related activity with Otsego Area Rowing, the participant must (1) self-certify that they are a competent swimmer (ONLY FOR INDIVIDUALS 18 OR OLDER), or (2) conduct the swim test set forth below and must complete this Certification and provide to Otsego Area Rowing.

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate on behalf of Otsego Area Rowing's program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:
1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring this to the attention of OAR immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (insert name of sports organization) their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

OAR Equipment Use and Responsibility Agreement
1. Participant assumes full responsibility for the scull, oars and associated equipment (the “Equipment”) owned by the owner thereof (the “Owner”) and used by Participant in connection with the Otsego Area Rowing, Inc. (“OAR”) included but not limited to Brookwood Gardens property.
2. Participant represents that he or she is capable of operating the Equipment and finds it in good working order, condition, and repair.
3. Participant shall bear all risk of damage or loss of the Equipment, or any portion thereof, and shall pay Owner the cost of repair or replacement. Participant understands that he or she is liable for all dirty, damaged, lost, or stolen Equipment and any fees associated therewith, and that all Equipment must be returned in good condition as determined by the Owner, and repaired at Participant’s expense.
4. Participant understands that he or she is responsible for returning the listed Equipment at the end of each session. Participant agrees that it is his or her responsibility to ensure proper loading, transportation and handling of the Equipment.
5. RECOGNITION OF RISK: Participant expressly acknowledges that rowing is an activity with inherent risks of injury to persons and property. Participant is aware of those risks and understands them. Participant alone has determined the sufficiency of any safety gear or other precautions that Participant decides to take to minimize the risks of the activity. No party related to the Owner, the CCC or OAR, including spouses, employees, and their members, governors, contractors and agents, has made any representation regarding the safety of, or the risks of the activity or the Equipment. Participant expressly assumes the risks of the activity and the Equipment. Participant understands the dangers of rowing and understands that weather can play a factor in boating safety and that such activities are subject to the unpredictable forces of nature.
6. RELEASE OF LIABILITY/INDEMNITY: Participant hereby releases Owner, the CCC, OAR, and their agents, contractors, employees, members and governors from liability for negligence and indemnifies and holds all of them harmless from any loss, expense, or cost, including attorney fees, arising out of damages or injuries, whether to persons or property, including those not listed on this agreement, occurring as a result of the use of said Equipment.
7. This agreement constitutes the entire agreement between Owner and Participant, and no term may be waived or modified, including any provision against oral modification, except in writing signed by both parties. There are no warranties, expressed or implied, by the parties, except as contained herein, and none of Owner, the CCC, OAR or any releasees shall be liable for any loss or injury to Participant nor to anyone else, of any kind or however caused. The laws of the State of New York shall govern this agreement.
I have read this agreement and understand it, and I sign it of my own free will. I am aware that this includes a release of liability and is binding on me, heirs, executors, administrators and assigns, or any person claiming by or through me. References to “I” shall include family members.

COVID-19 Vaccination Requirement

OAR requires all eligible members to receive full vaccination before rowing with the club.

OAR Media Opt-Out Release Form

Otsego Area Rowing ("OAR") occasionally uses photography and video recordings of participants of our rowing-related activities for print materials and/or our website and social media platforms.

A club member or parent may withhold permission (opt-out) to have a themselves or their child photographed, videotaped, and/or audiotaped during club-sponsored activities, including lessons and clinics. As the member or parent/guardian of the student identified below, I understand that if I opt-out, I (or my child) will not be included in pictures taken by club staff or members and made public in print or online.
A) I have provided proof of vaccination for SARS-COVID-19 if I am eligible by emailing a copy of my vaccination record to 27estli@gmail.com (Dr. Laura Kilty's email). I will abide by all local health regulations in regards to the pandemic by wearing a mask when appropriate, using hand sanitizer, and clean and disinfect all equipment used by others.

B) I have not completed vaccination for SRA COVID-19 yet, and understand that I must wear a face mask on land and whenever within 6 feet of other participants/members.
