This Release (including Acknowledgement and Assumption of Risk) and Consent to Use Likeness, etc. (“Release”) is entered into by the undersigned in favor of FROLIC KIDS, LLC D/B/A FROLIC (hereinafter “FROLIC”), ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS, (including VOLUNTEERS, STUDENTS AND GUESTS) involved in activities of FROLIC, including, but not limited to, birthday and other parties, after-school programs, summer camps and other entertainment events for children, families and adults involving and interacting with dogs (collectively sometimes the “ACTIVITIES”) and in favor of ALL LANDOWNERS ON WHOSE PROPERTY ANY FROLIC ACTIVITIES MAY OCCUR (collectively, the “RELEASED PARTIES”). In consideration of being permitted to participate in the ACTIVITIES and/or to use the facilities of FROLIC and other valuable consideration, receipt of which is acknowledged, I represent, acknowledge and agree as follows:

1. ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS. I understand that the ACTIVITIES are not suitable for children and others who do not like dogs or who are fearful of them or being around dogs. I also understand that children and others are often allergic to dogs and that dogs can carry fleas or other foreign substances that pose a danger to some individuals. I represent to FROLIC and the other RELEASED PARTIES that neither I nor any of my children or others who I am signing for below or who are accompanying me in the ACTIVITIES have any known allergies to dogs. I also understand that dogs are often powerful, easily frightened, and unpredictable live animals and being around and interacting with dogs and others may be dangerous. I am voluntarily participating in one or more of the ACTIVITIES, with full knowledge of the potential dangers involved. The inherent risks include dogs jumping and knocking children and others off their feet, dogs fighting with other dogs, dog bites and scratches and reactions to loud or sudden noises (including thunder and from trucks and other vehicles, dropped trays, etc.) and/or movements, which can occur with or without warnings. Even while on leashes, the potential risks including, but not limited to, those listed above cannot be completely eliminated. I understand that SERIOUS, PERMANENT BODILY INJURY, DISABILITY OR DEATH OF MYSELF, MY CHILDREN OR OTHERS MAY RESULT in connection with my participation in the ACTIVITIES.

I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, ILLNESS, DISEASE OR DEATH, INCLUDING FINANCIAL LOSSES (INCLUDING LOSS OF EARNING CAPACITY) AND DAMAGE OR DESTRUCTION OF PROPERTY OWNED BY ME OR IN MY CARE, RESULTING FROM THE ACTIVITIES AND/OR BEING IN THE VICINITY OF DOGS, INCLUDING RISKS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. I ALSO AGREE THAT ALL AMOUNTS PAID BY ME IN CONNECTION WITH ANY ACTIVITIES ARE ENTIRELY NON-REFUNDABLE.

2. RELEASE OF LIABILITY, INCLUDING LIABILITY FOR NEGLIGENCE. On behalf of myself, my family, children, wards, heirs, estate, distributees, guardians, legal representatives and assigns, I HEREBY RELEASE THE RELEASED PARTIES AND EACH OF THEM FROM ALL CLAIMS, DEMANDS, CAUSES OF ACTION AND LIABILITIES based on any injury, disability, illness, disease, death, financial loss, property loss or damage, or other harm suffered by me, or by any third person for which I may be held responsible, that may result from my participation in the ACTIVITIES and/or being in the vicinity of dogs and dog-related activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE; provided that nothing in this Section 2 shall be deemed to release any Released Party from liability arising from their willful injury to me or any other person or any property, or their gross negligence.

3. CONSENT TO USE LIKENESS, ETC. I hereby grant to FROLIC and its employees, agents and successors and assigns, all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish in any media whatsoever my photographed or recorded likeness and voice and that of each of my children and any minor or others that are identified below and/or that have accompanied me or participated in the ACTIVITIES or any FROLIC events with my consent. This consent includes all photographs, video, and audio for any lawful purposes, including without limitation any and all promotional, marketing and commercial purposes. This consent is without geographic or time limitation.

4. PARENTS MUST SIGN INDIVIDUALLY AND FOR MINORS. I represent that I am 18 years of age or older and am legally competent to enter into this Release for myself. If signing for a minor, I represent that I am the parent or duly appointed legal guardian of the minor for whom I am signing this Release.
