PAYMENT
The Client agrees to pay the Photographer the full session fee no later than 5 days prior to the scheduled photography session.
Your session date and time will only be considered confirmed once payment has been received, unless an alternative payment arrangement has been agreed with the Photographer in advance.
Payment can be made by bank transfer or cash.

If payment has not been received by the required payment deadline and no alternative arrangement has been made with the Photographer, the Photographer reserves the right to release the Client's reserved session date and time.
SESSION LOCATION & TRAVEL
-The session location will be discussed and agreed upon in advance based on the goals of the session, the family's preferences and the Photographer's recommendations.
Any additional travel fees, if applicable, will be discussed and agreed upon with the Client before the session.
MEDIA
The Photographer will be the primary and only professional photographer during the session.
To allow the Photographer to work safely and effectively and to ensure the best possible experience, the use of additional cameras, professional photography equipment or video recording during the session is not permitted unless agreed upon with the Photographer beforehand.
Parents and family members are welcome to take occasional personal photographs on their phones, provided this does not interfere with the Photographer's work or the flow of the session.
IMAGE PROCESSING and Creative Control
The Client understands that the Photographer has creative control over the photography session, including decisions regarding:
Poses and natural interactions
Location and composition
Lighting
Props
Camera angles
Image selection
Colour and image processing
Final artistic presentation
The Photographer's editing style is demonstrated through her portfolio and the Client confirms that they have viewed and are comfortable with this style before booking.
Temporary attributes such as minor bruises, blemishes or scratches may be removed during editing at the Photographer's discretion.
Other alterations, including significant changes to clothing, hair, logos, cosmetic features or other subjective requests, may incur an additional editing fee.
The Photographer's creative judgement will be used when determining the final editing of each image.
RAW or unedited images will not be provided.
COMPLETION SCHEDULE
A selection of photographs may be shared as a sneak peek on Facebook or social media within approximately 72 hours of the session, at the Photographer's discretion. (Permission will always be asked prior to anything posted online)
The completed gallery/images will generally be provided within 14 days of the photography session, unless otherwise discussed with the Client.
Where a USB is included in the Client's package, it will be delivered either in person or by post.
Delivery times may occasionally be extended due to circumstances outside the Photographer's reasonable control. If there is likely to be a significant delay, the Client will be notified.
MODEL RELEASE
The Photographer has the right to use and publish images and photographs taken during your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use.
The Client agrees that they will not be compensated.
If the Client prefers to keep their images private, this must be discussed with the Photographer prior to the session. The names and ages (for those under 18 years old) of session participants must be listed in the questionnaire.

If the Client does not wish for their images to be used publicly, this must be communicated and agreed upon with the Photographer before the session.
The Client acknowledges that names and ages of children participating in the session may be collected for session planning and identification purposes. The Photographer will not publicly disclose this information alongside images without appropriate permission.
COPYRIGHT AND IMAGE PROTECTION
Copyright of all photographs created during the session remains with Abby Murray Photography.
The Client receives a personal-use licence for the final images supplied to them.
The Client may:
Print the photographs for personal use
Share the photographs with family and friends
Email the photographs
Post the photographs on personal social media accounts
The Client may not sell the photographs, use them commercially, substantially alter them, enter them into competitions or use them for advertising or promotional purposes without prior written permission from the Photographer.
IMAGE SHARING
Clients are welcome to share their purchased images on social media for personal purposes.
Where web-sized images are supplied, these may be used for personal social media sharing.
Images posted by Abby Murray Photography should not be altered, filtered or edited, and any Photographer watermark should not be removed.
Clients are welcome to tag and share posts from Abby Murray Photography.
CANCELLATIONS / RESCHEDULING
The Photographer understands that unexpected circumstances can occur.
If the Client needs to cancel or reschedule, they must provide at least 48 hours' notice wherever reasonably possible.
More than 48 hours' notice
Where more than 48 hours' notice is provided, the Photographer will work with the Client to arrange an alternative date where possible.
Less than 48 hours' notice
If the Client cancels with less than 48 hours' notice, the session fee will be forfeited.
The same applies where the Client fails to attend their scheduled session without providing appropriate notice.
This is because the Photographer has reserved the date and time specifically for the Client and may be unable to offer that appointment to another family at short notice.
Exceptional circumstances may be considered by the Photographer at her discretion.
WEATHER & PHOTOGRAPHER RESCHEDULING
For outdoor sessions, extreme or unsuitable weather conditions may require the session to be postponed.
Examples may include:
Heavy rain
Storms
Extreme heat or cold
Strong or unsafe winds
Other conditions that may make the session unsuitable or unsafe
Where possible, the decision to postpone an outdoor session will be made at least 4 hours before the scheduled session time.
The Photographer reserves the right to reschedule a session due to illness, severe weather, equipment malfunction, emergency or other circumstances outside her reasonable control.
If the Photographer needs to cancel or postpone the session, the Client will be offered an alternative date where possible.
If an alternative date cannot reasonably be arranged, any payment made for the affected session will be refunded.
CLIENT COOPERATION AND NO-SHOWS
Family photography sessions are intended to be relaxed and enjoyable. The Photographer will make reasonable efforts to engage children and create a positive experience.
Parents or guardians remain responsible for supervising their children throughout the session.
The Photographer cannot guarantee that children will cooperate, smile, sit still or participate in every photograph.
The Photographer will work creatively with the family and children's personalities to capture natural and meaningful photographs.
If the Client arrives more than 15 minutes late without contacting the Photographer, the Photographer may need to shorten the session or, depending on the circumstances, treat the appointment as a missed session.
No refund will be provided where a session cannot reasonably proceed due to the Client's failure to attend, significant lateness without notice or lack of cooperation.
The Photographer may conclude a session earlier than the scheduled end time if she believes sufficient photographs have been captured, the children are no longer able to participate, or continuing would not reasonably benefit the Client.
QUALITY AND ARTISTIC STYLE ASSURANCE
The Photographer will make reasonable efforts to provide images consistent with the quality and style demonstrated in her current portfolio.
The Client acknowledges that photography is an artistic service and that final images will reflect the Photographer's professional and creative judgement.
The Photographer cannot guarantee specific poses, expressions, photographs, weather conditions, children's behaviour or other circumstances outside her control.
Refunds or reshoots will only be considered where there is a genuine technical failure or other significant issue attributable to the Photographer.
Creative differences or personal preferences regarding artistic style will not ordinarily constitute grounds for a refund or reshoot.
LIMITATION OF LIABILITY
The Photographer will take reasonable care of all photography equipment, photographs and digital files.
In the unlikely event that photographs are lost, damaged or become unusable due to equipment failure, storage failure, accidental loss or another circumstance within the Photographer's control, the Photographer's liability will be limited, to the extent permitted by law, to the amount paid by the Client for the affected photography service.
Where only some images are affected, any remedy will be considered proportionately to the extent of the loss.
The Photographer is not responsible for the quality or output of prints or products ordered through third-party suppliers or services that are not supplied directly by Abby Murray Photography.
Nothing in this agreement excludes, restricts or modifies any rights or remedies that cannot legally be excluded under applicable Australian law.
PERSONAL SAFETY & RESPONSIBILITY
The Photographer will take reasonable care during the session; however, the Client remains responsible for themselves and for supervising any children or other participants in their group.
Clients should inform the Photographer of any relevant physical limitations, allergies, mobility concerns or other information that may affect the safety or comfort of the session.
The Photographer will not intentionally place a Client or child in an unsafe situation.
Nothing in this agreement is intended to exclude liability that cannot legally be excluded under Australian law.
CLIENT RESPONSIBILITY
The Client agrees to ensure that all members of their photography party are aware of the relevant terms of this agreement and understand that the Photographer will be directing the photography session.
The Client confirms that they have authority to enter into this agreement on behalf of any children participating in the session.
ELECTRONIC SIGNATURE
The Client agrees that an electronic signature, typed name, digital signature or other electronic acceptance of this agreement may be treated as their signature and has the same effect as an original signature, to the extent permitted by law.
CLIENT ACKNOWLEDGEMENT
By signing below, I confirm that I have:
-Read and understood this agreement.
-Provided accurate contact and session information.
-Understood that full payment is required at least 5 days before my session.
-Understood that cancellation with less than 48 hours' notice may result in the session fee being forfeited.
-Read and understood the rescheduling, weather and no-show policies.
-Viewed and accepted the Photographer's photographic and editing style.
-Read and understood the copyright and image-use terms.
-Selected my preference regarding the promotional use of my photographs.
-Had the opportunity to ask questions before signing.
-Agreed to the terms of this booking agreement.
