1. New members may attend two free assessment classes before applying. No payment is required before acceptance. Membership is subject to approval by Eagles Sport Club CC ("ESC") management.
2. The member and parents agree to the club's rules and code of conduct, as amended from time to time. For minors, the parent/guardian signs as the contracting party and is liable for all fees and obligations.
3. Fees, as per the published fee schedule (announced each December and implemented from February), are payable monthly in advance by the 4th of each month.The annual affiliation fee, which covers association fees, facility & equipment maintenance is due by 4 February each year.
4. If fees are unpaid 7 days after the due date, ESC may suspend the member from classes and gradings until settled. Fees continue to accrue, and recovery costs are for the member's account.
5. The member may cancel at any time on 20 working days' written notice (email accepted); fees remain due for the notice period. ESC may terminate on written notice for serious or repeated misconduct, or fees unpaid for more than two months.
6. The member (or parent/guardian) declares the member fit to train, has disclosed all relevant medical conditions, and will disclose any changes in writing. ESC may require a doctor's clearance for new members aged 40+ or any member with a disclosed condition. The member consents to emergency medical treatment being arranged where necessary, at the member's cost. CONFIRM BELOW
7. I understand that martial arts training, by its very nature, involves inherent risks — including the risk of serious injury and, in rare cases, even death — that cannot be eliminated regardless of the care taken. Participation (my own, or that of my minor child) is voluntary, and I knowingly accept these risks. In consideration of participation being permitted, I agree — for myself and, where applicable, on behalf of my minor child, and for my heirs, representatives, and assigns — to indemnify, hold harmless, and release Eagles Sport Club CC, its officers, employees, and agents from all claims, demands, or actions for personal injury or damage to property arising from participation in the club's programs and activities, except to the extent caused by the gross negligence or wilful misconduct of the club or its representatives. I understand that by initialling below I am giving up substantial rights, including the right to sue. CONFIRM BELOW
8. ESC may use photos/video of members taken during club activities for training analysis, promotion, and social media — only if the box below is ticked. Consent may be withdrawn at any time in writing. CONSENT BELOW
9. Personal information is processed in line with POPIA, used only for administration and communication, and not shared with unrelated third parties. Members may request access to, correction of, or deletion of their information in writing. Training halls are monitored by 24-hour security cameras for safety and security purposes only; footage is stored securely.
10. The residential and email address provided serves as the member's domicilium citandi et executandi. Address changes must be given in writing.
11. This agreement is governed by South African law; the parties consent to the Magistrate's Court's jurisdiction. If any clause is invalid, the rest remain in force. Except for clauses 2 (rules) and 3 (fee changes), no variation is valid unless in writing and signed by both parties.
