Photography by Kimberly Murphy has relocated outside of the Des Moines area but will return on a very limited, part-time basis. Please be advised that rescheduling may not always be possible or may be delayed due to this new travel-based schedule.

Studio addresses and session locations in the Des Moines area will be provided prior to the session date and may vary depending on availability.

A. Session Fees & Retainer Policy
The client agrees to pay a non-refundable retainer of $100.00 plus tax at the time of booking to secure the session date and time. This retainer is applied toward the total session cost.

Upon receipt of the retainer, Photography by Kimberly Murphy reserves the agreed-upon date and time and will not accept other clients for that slot. For this reason, all retainers are non-refundable, regardless of cancellation reason, to offset loss of business.

Multiple rescheduling requests may result in additional retainers or refusal of service. Session dates and times are not guaranteed without a paid retainer and confirmed communication.

Session fees include the photographer’s time and talent, as well as basic retouching and creative editing, as determined at the photographer’s discretion. Additional or advanced editing requests are available at an additional cost, determined by the photographer.

Additional prints and/or digital images may be available for purchase. Image selection is made by the photographer, unless otherwise specified in the purchased package.

Digital Image Delivery
High-resolution digital files are provided via an online gallery and are included with the session.

If the client would like images delivered on a CD or USB, Photography by Kimberly Murphy must be notified in advance. These products will be billed separately.

Custom DVD or USB: $150.00 plus tax and shipping

B. Location Costs & Travel Fees
Any fees or costs associated with a client-chosen session location are the sole responsibility of the client. Photography by Kimberly Murphy does not arrange or guarantee payment for location permits or fees.

The creative fee includes travel within Ankeny, IA, and the Cedar Valley area. Locations outside of these areas may be subject to an additional travel fee, which will be discussed and agreed upon during the consultation.

 

C. Rescheduling Policy
If illness or an unforeseen situation prevents the scheduled photo session from taking place, the client may reschedule with at least 24 hours’ notice prior to the session time without penalty.

If the client fails to provide a minimum of 24 hours’ notice, or chooses to cancel the session entirely, the session retainer/fee will be forfeited and is non-refundable.

Multiple rescheduling requests may result in additional retainers or refusal of future service.

Photography by Kimberly Murphy reserves the right to reschedule a session due to illness, inclement weather, equipment malfunction, or other circumstances beyond the photographer’s control.

Sick Policy
For the health and safety of the photographer, assistants, and other scheduled clients, please do not bring sick family members to a session.

If a child or participating family member has a fever, stomach flu symptoms, or any contagious illness, the session must be rescheduled, even if the illness occurs within 24 hours of the session time. No exceptions.

If a child or family member arrives visibly ill, the session will be stopped immediately and rescheduled.

Photography by Kimberly Murphy will make every reasonable effort to reschedule the session at a time that works for both parties. This policy is in place to help prevent the spread of illness and protect everyone involved.

 

 

D. Re-Shoots & Refunds
All re-shoots are granted solely at the discretion of the photographer.

Re-shoots will not be provided for issues related to:

Clothing, makeup, or hair choices
Weather-related conditions
Failure to follow the photographer’s recommendations
The photographer is not responsible for missed moments, a child’s cooperation, or participant behavior during the session.

Session and package fees cover the photographer’s time and talent only. No refunds will be issued on any session fees or packages.

Once images have been delivered to the client, no exchanges or substitutions will be permitted.

E. Image Archive & File Retention
Photography by Kimberly Murphy will retain digital image files for six (6) months following the session date. After this period, images may be permanently deleted from the photographer’s storage system.

Images may be retained beyond this period for promotional or portfolio use, at the photographer’s sole discretion.

Photography by Kimberly Murphy is not responsible for loss or damage to digital files due to circumstances beyond the photographer’s control, including but not limited to equipment failure or data loss.

F. Payment Policy
Payment in full is due on the day of the session. Orders will not be processed, edited, or delivered until full payment has been received.

If a payment plan has been arranged in advance, the order will be processed only after the final payment is completed.

If payment is not received within 30 days of the session date, a late fee of $35.00 plus tax per month will be applied to the outstanding balance. All late fees must be paid in full before images are processed or delivered.

A fee of $100.00 plus tax will be charged for any returned or insufficient-funds checks.

 

H. Model Release
The client hereby grants Photography by Kimberly Murphy the absolute and irrevocable right and permission to use photographs taken of the client and/or the client’s minor child(ren), including images in which they may be photographed with others.

This permission includes, but is not limited to, the right:

a) To copyright the images in the name of the photographer or any other name selected by the photographer;

b) To use, reuse, publish, and republish the images, in whole or in part, individually or in conjunction with other images, in any medium now known or hereafter developed, for any lawful purpose, including but not limited to promotion, advertising, marketing, trade, editorial, and portfolio use.

The client hereby releases and discharges Photography by Kimberly Murphy from any and all claims or demandsarising out of or in connection with the use of the photographs, including but not limited to claims of libel, invasion of privacy, or misrepresentation.

I. Liability & Damages
Photography by Kimberly Murphy is not responsible for any injuries sustained by the client or any participating parties during the session, whether on location or on the photographer’s property.

The client assumes full responsibility for themselves and any minor children present and releases the photographer from all claims against the photographer or their business.

The client is financially responsible for any damage to the photographer’s property or equipment, whether caused accidentally or intentionally by the client or members of the client’s party.

Photography by Kimberly Murphy is not responsible for damage to portraits after delivery, including damage occurring during shipping or transit by U.S. Mail or other carriers. Once delivered, the client assumes full responsibility for the care and safekeeping of all images and products.

J. Copyright & Image Use Policy
Photography by Kimberly Murphy retains full copyright to all images created during the client’s session.

A print release may be purchased with digital images, allowing the client to print photographs for personal use only, up to the size specified on the print release. This release does not permit:

Commercial use
Image alteration or editing
Entry into contests or publications
Sale or transfer of images
without written permission from the photographer.

It is illegal to copy, scan, download, screenshot, print, share, alter, or otherwise use any image created by Photography by Kimberly Murphy without authorization. This includes, but is not limited to:

 

Sneak Peek & Behind-the-Scenes Sharing Preference

Photography by Kimberly Murphy enjoys sharing occasional sneak peeks and behind-the-scenes moments from photo sessions. These images may be shared anonymously online for promotional or educational purposes.

Please indicate your preference below. Photography by Kimberly Murphy always respects client wishes regarding the sharing of images.

Turnaround Time & Gallery Delivery
Sneak Peeks:
Sneak peek images will be provided within one (1) week, depending on the client’s selected model release preference. Sneak peeks may be posted on Facebook.

Proof Gallery:
A soft proof gallery will be delivered approximately 2.5 to 3 weeks after the session. Soft proofs are very lightly editedimages intended for viewing and selection.

Final Editing:
Final image delivery timelines depend on the type of session and the photographer’s current editing schedule. Expedited editing or gallery delivery may be available for an additional fee.

Gallery Availability:
Online galleries will be available for two (2) weeks from the delivery date. Clients are responsible for downloading and backing up all images during this time.

Once a gallery has expired, a $100.00 plus tax fee will be required to reload the session gallery.

Image Archiving:
Final images are archived for six (6) months following delivery. Clients are strongly encouraged to download and store images in multiple locations to prevent loss.
