Release of Liability

1. Participant understands and acknowledge that activities involving horses ("Equine Activities"), including but not limited to the mounting,riding, walking, dismounting, grooming, training, handling, feeding, observing and otherwise being in the physical proximity of horses is adangerous activity which produces a foreseeable risk of mortal or serious personal injury and/or property loss to the participant in suchactivity as well as to the person or property of others. 2. Participant agrees to assume ANY AND ALL RISKS INVOLVED IN OR ARISING FROM THE PARTICIPANT'S USE OF, OR PRESENCE UPON STABLE’S PROPERTY AND FACILITIES including, without limitation but not limited to, the risks of death, bodilyinjury, property damage, falls, kicks, bites, collisions with vehicles, horses or stationary objects, fire or explosion, the unavailability ofemergency medical care, or the negligence or deliberate act of another person. 3. Participant agrees to hold STABLE and all of its successors, assigns, subsidiaries, affiliates, officers, directors, employees and agentscompletely harmless and not liable and release them from all liability whatsoever and AGREES NOT TO SUE them on account of or inconnection with any claims, causes of action, injuries, damages, cost or expenses arising out of Participant's use of or presence uponSTABLE’S property and facilities, including without limitation, those based on death, bodily injury, property damage, includingconsequential damages, except if the damages are caused by the direct, willful and wanton negligence of the STABLE. 4. Participant agrees to waive the protection afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is toprovide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspectto exist at the time of executing the release. 5. Participant agrees to indemnify and defend STABLE against, and hold it harmless from, any and all claims, causes of action, damages,judgments, costs or expenses, including attorney's fees, which in any way arise from the Participant's use of or presence upon the STABLE’Sproperty and facilities. 6. Participant agrees to abide by all of STABLE’S rules and regulations. 7. Participants under the age of 18 shall wear properly fitted protective headgear at ALL times while mounting or riding a horse. Participantsover the age of 18, though not required by law to wear protective headgear, are hereby advised of the possible reduced risk of serious headinjury when protective headgear is worn and understand that is recommended that everyone mounting and riding a horse, regardless of age,wear properly fitted protective headgear. 8. If Participant is using their horse, the horse shall be free from infection, contagious or transmissible disease. STABLE reserves the right torefuse horse if not in proper health or is deemed dangerous or undesirable. 9. Participant agrees and gives permission to be videotaped and/or photographed while on STABLE’S premises and shall hold no legal claim to any recorded images, their use or distribution. Such images may be used in promotional materials in print and on social media.
