HOUSE RULES: The Coordinator(s) are limited by the guidelines of The Event ceremony and/or reception site management. All rules set out by each venue and vendor will be followed and respected.
DECORATING ARRANGEMENTS: It is the Client’s responsibility to communicate with The Coordinator(s) number of items provided for decorating such as: centerpieces, guestbook, and other specifics. It is required to have a Packing List in order to accomodate personal items. Some events may need more time, depending upon details required. If the venue will allow decorating the day before, The Coordinator(s) will make every effort to accommodate this allowance. Breakdown does not include clearing and bussing of tables, trash, etc. The Coordinator(s) will pack decor in containers as listed on Packing List for arranged person(s) to take from the Venue.
Receipt/Inspection of Rental Equipment/Items: Client hires the Rental Equipment on an "as is" basis. Client acknowledges that Client will personally inspect the rental items prior to its use. AB has made considerable efforts to ensure the accurate display of the colors of linen on our website. However, the actual colors you see will depend on your monitor. We cannot guarantee that your monitors display of any color will be accurate.
CARE of RENTALS: Client will report any damage to rental items, setting damaged items to the side for inspection by an AB staff member. Client shall be responsible for any and all damage to any of the Rental Equipment not caused by ordinary wear and tear. "Ordinary wear and tear" shall mean only the normal deterioration of the rental equipment caused by ordinary, reasonable and proper use of the rental equipment. Client shall be liable to AB for any and all damage which is not "ordinary wear and tear" in an amount equal to the replacement value of the rental equipment. Damage which is not "ordinary wear and tear" includes, but is not limited to, cutting or tearing of vinyl/plastic/linens/wood, bending/breaking of poles or stakes, damage due to overturning, overloading, exceeding capacities, breakage, improper use, abuse, lack of cleaning, contamination of or dirtying of rental equipment.
POSSESSION/TITLE: Client's right to possession of the Rental Equipment begins upon the items being delivered to Client's premises and terminates on the actual pick up by AB. Retention of possession, or any failure to permit the pick up of the item(s) at or after the end of the "Rental Period" specified constitutes a material breach of this Agreement. In the event that the Rentals are not returned for any reason, including theft, the Client is obligated to pay to AB the full replacement value for such Rantals, plus any and all incidental costs associated with the attempted pick up or recovery of the Rentals by AB. Title to the rental items is and shall remain in AB name. Client agrees to keep the Rental Equipment in his/her/their custody and control from the time of AB delivery of the items, until AB picks up such items. Client shall not cause nor permit these items, or any of them, to be sublet, rented, sold, or removed from the Delivery Address, or otherwise transfer such items. If rental items are not returned and/or levied upon for any reason whatsoever, AB may retake possession of said items without further notice or legal process and use whatever force is reasonably necessary to do so. Client hereby agrees to indemnify, defend, and hold AB harmless from any and all claims and costs arising from such retaking and/or levy. If rental items are levied upon, or otherwise moved from Delivery Address, Client shall notify AB immediately.
ASSISTANTS and ATTIRE: Should The event require it, The Coordinator(s) will provide assistants in order to fulfill this contract. These assistants will abide by all terms of this contract. The decision to use assistants is at the sole discretion of The Coordinator(s). The cost of said assistants is included in your contract amount. The Coordinator(s) and any associated staff will dress in appropriate attire for The Event.
MODEL RELEASE: It is agreed that The Coordinator(s) may display and use any photographs taken for advertising in ways thought proper by The Coordinator(s). For The Client's privacy, last names may be obscured if requested.
LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative coordinator. The Coordinator(s) will make every effort to secure a replacement coordinator able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for The Event package. The limit of liability shall not exceed the contract price stated herein. If The Coordinator(s) deems that The Client and/or The Event’s guest are negligent and malicious and The Coordinator(s) property is altered from the original state or permanently damaged, then The Client will be charged the total replacement cost for each item. The Coordinator(s) is not responsible for items that are stolen by client’s guests during the event. If the client’s guests remove items (i.e. centerpieces, decorative accents, ect.) that are the property of The Coordinator(s) or any outside vendor, then the client will be charged the total replacement cost of the items.
DAMAGES: The Coordinator(s) and any assistants associated with, will be held harmless for any injuries to The Client or The Event guests, as well as from any damages done to The Client(s) peronal decor items. Any form of damage to The Coordinator(s) property will result in in additional charges to The Client renting the property.
LEGAL FEES: In the event that an attorney is retained to enforce any provision of the Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs in such action or proceeding, in an amount to be determined by the court or arbitrator.
RIGHT OF WITHDRAWAL: The Coordinator(s) discovery of new information, changes to agreed circumstances without previous discussion, or other factors which tend to circumvent standard policies may result in withdrawal. Should The Coordinator(s) initiate the withdrawal, all fees will be returned, excluding retainer fee as well as fair market value for all services/products already provided.
CANCELLATION POLICY: Cancellation notification form must be signed by all parties before it is taken in to effect. All previous fees made are non-refundable.
SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
