BOARD & TRAIN AGREEMENT
DEPOSIT & PAYMENT POLICY
All Board & Train clients are required to submit a deposit equal to fifty percent (50%) of the total program cost prior to the scheduled drop-off date. The remaining balance is due in full at the time of drop-off unless otherwise agreed to in writing by Transform Your Dog LLC.
Failure to make full payment by the scheduled drop-off date may result in cancellation, postponement, or refusal of services at the sole discretion of Transform Your Dog LLC.
Client agrees to pay all collection costs, court costs, attorney fees, filing fees, and expenses incurred by Transform Your Dog LLC in collecting unpaid balances.
Transform Your Dog LLC reserves the right, where permitted by law, to retain possession of the dog until all outstanding balances have been paid in full. Additional boarding fees of $75 per day may be assessed for dogs remaining in our care due to unpaid balances.
CHARGEBACKS AND PAYMENT DISPUTES
Client agrees not to initiate credit card chargebacks, bank disputes, payment reversals, or similar actions for services rendered or currently being provided.
Should a chargeback or payment dispute be initiated after services have begun, Client agrees to reimburse Transform Your Dog LLC for all administrative costs, collection fees, attorney fees, court costs, and expenses associated with defending or recovering payment.
CANCELLATION & NO-SHOW POLICY
If a client cancels or fails to appear for their scheduled drop-off appointment within twenty-four (24) hours of the scheduled time without prior notice, the deposit shall be deemed earned and non-refundable.
At the sole discretion of Transform Your Dog LLC, a training credit may be issued for future services. Any approved credit must be used within twelve (12) months of the original scheduled drop-off date and is non-transferable.
REFUND POLICY
All deposits are non-refundable.
Once services have been scheduled, reserved, or initiated, all payments made to Transform Your Dog LLC are non-refundable.
Transform Your Dog LLC does not provide monetary refunds for completed, partially completed, or ongoing services. Any credit issued for future services shall be at the sole discretion of Transform Your Dog LLC and shall not constitute an obligation to issue a refund.
TRAINING COMMITMENT & LIFETIME SUPPORT
This agreement establishes a partnership between the client, their dog, and Transform Your Dog LLC. The success of any training program depends upon continued owner participation, consistency, reinforcement, environmental management, and compliance with training recommendations.
Transform Your Dog LLC offers ongoing support for eligible training programs. This support is not a guarantee of specific behavioral outcomes, obedience levels, social behavior, aggression rehabilitation, off-leash reliability, or future conduct.
Lifetime support is available only to owners who:
Actively participate in the training process.
Follow training recommendations and homework assignments.
Maintain consistency with the dog's training.
Communicate honestly regarding behavioral concerns.
Restrictions Apply:
Lifetime support does not cover behavioral issues resulting from owner negligence, inconsistent reinforcement, environmental changes, neglect, abuse, medical conditions, or circumstances beyond the control of Transform Your Dog LLC.
Lifetime support becomes void if the dog is subjected to abuse, neglect, unauthorized training methods, or training practices that directly conflict with our recommendations.
Lifetime support applies only to dogs trained directly by Transform Your Dog LLC and does not extend to services provided by third-party trainers or organizations.
OWNER DISCLOSURE REQUIREMENT
Client certifies that all known medical conditions, behavioral concerns, aggression history, bite history, reactivity, anxiety, dangerous behaviors, and prior incidents have been fully disclosed before enrollment.
Failure to disclose any known behavioral, aggression, bite, or medical history shall constitute a material breach of this agreement and releases Transform Your Dog LLC from liability arising from such undisclosed information.
VETERINARY EMERGENCY AUTHORIZATION
Client authorizes Transform Your Dog LLC to obtain veterinary treatment for their dog in the event of illness, injury, accident, or medical emergency if the owner cannot be reached immediately.
Transform Your Dog LLC may utilize the veterinarian of its choosing when immediate care is necessary.
Client agrees to be solely responsible for all veterinary expenses, emergency treatment costs, medications, transportation costs, and related fees incurred on behalf of their dog.
BOARDING, TRAINING, TRANSPORTATION & SOCIALIZATION RISKS
Client understands that Board & Train services may include transportation, socialization, exercise, public exposure, field trips, handling by staff, interaction with other dogs, and exposure to unfamiliar environments.
Despite reasonable care and supervision, Client acknowledges that risks may include illness, injury, bites, scratches, stress, behavioral setbacks, property damage, escape, loss, theft, permanent disability, or death.
Client voluntarily assumes all risks associated with participation in services provided by Transform Your Dog LLC.
NO GUARANTEE OF RESULTS
Client understands that dog training and behavioral rehabilitation involve numerous variables, including genetics, environment, consistency, handler involvement, health conditions, and maintenance after training.
Transform Your Dog LLC makes no guarantees regarding specific outcomes, timelines, obedience levels, socialization success, aggression rehabilitation, service dog suitability, or future behavior.
CONFIDENTIALITY POLICY
Transform Your Dog LLC respects client privacy. Client information will not be sold, distributed, or disclosed except as required by law or as necessary to provide services.
MEDIA RELEASE
Client grants Transform Your Dog LLC irrevocable permission to photograph, videotape, record, and otherwise capture their dog's image, likeness, name, training progress, and activities.
Client authorizes Transform Your Dog LLC to use such materials for advertising, marketing, educational content, websites, social media, printed materials, and other promotional purposes without compensation or further approval.
AGREEMENT TO HOLD HARMLESS, WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
Client acknowledges that dog training, behavioral rehabilitation, boarding, transportation, exercise, socialization, and related services involve inherent risks that cannot be entirely eliminated.
Such risks include, but are not limited to:
Bites
Scratches
Injuries to persons or animals
Property damage
Illness
Escape
Loss
Theft
Permanent disability
Death
Unpredictable canine behavior
Client voluntarily assumes all risks associated with participation in services provided by Transform Your Dog LLC.
Client hereby waives, releases, discharges, and agrees to hold harmless Transform Your Dog LLC, its owner, employees, contractors, agents, representatives, successors, and assigns from any and all claims, liabilities, damages, demands, costs, expenses, actions, or causes of action arising from or relating to the client's participation in services or the behavior of the client's dog, except in cases of gross negligence or intentional misconduct.
This release includes, but is not limited to:
Injuries or damages sustained by the client, family members, guests, third parties, or animals.
Veterinary expenses.
Medical expenses.
Property damage.
Behavioral outcomes following training.
Escape, illness, injury, disability, or death of the dog.
INDEMNIFICATION
Client agrees to indemnify, defend, and hold harmless Transform Your Dog LLC, its owner, employees, contractors, agents, and representatives from any claims, lawsuits, damages, liabilities, losses, costs, expenses, or attorney fees arising out of the actions, behavior, injuries, bites, attacks, or conduct of the client's dog during or after participation in services.
ABANDONMENT OF DOG
Client agrees to retrieve their dog promptly upon completion of services.
Any dog not picked up within fourteen (14) days after completion of services and without communication or arrangements made with Transform Your Dog LLC may be considered abandoned to the fullest extent permitted by applicable law.
Client remains responsible for all fees incurred up to the date custody is transferred.
GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of New Jersey.
Any legal action arising out of or relating to this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of New Jersey.
ACKNOWLEDGEMENT
By signing below, I acknowledge that I have carefully read, fully understand, and voluntarily agree to all terms and conditions contained in this Agreement. I understand that this Agreement is legally binding upon myself, my heirs, successors, assigns, and representatives.
