§ 1102.4

If an applicant has ever been convicted of, pled guilty or nolo contendere to, or been given probation before judgment for any offense, other than a crime of violence, as defined in D.C. Official Code §23-1331 (4), or traffic offense, in any jurisdiction that would be ineligible to be commissioned as a special police officer for (5) years following the applicant’s release from incarceration and conclusion of any court ordered parole, probation, or supervision relating to the offense.

Perfect Precision Security & Firearms Training Academy LLC, and its employees, trainers, and all regents, agents and employees of these entities.

WAIVER AND RELEASE OF LIABILITY:

Because physical exercise or certification training can be strenuous and subject to risk of serious injury or death, we urge you to obtain a physical examination from a doctor before using any exercise equipment or participation in any exercise/training activity to include Taser CEW exposure, Firearms Training, Oleoresin Capsicum Exposure “OC”, Expandable Baton, Handcuffing, Defensive Tactics Training and Physical fitness assessment. You agree that participating in physical exercise or training activities, you do so ENTIRELY AT YOUR RISK. Any recommendations for changes in diet including the use of food supplements, eight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and the use of these facilities and premises AND ASSUME ALL RISK OF INJURY, ILLNESS OR DEATH.

INDEMNITY:

I also agree to indemnify and hold harmless the Releasees from any loss, liability, damage or costs, including court costs and attorney's fees, that they may incur due to my participation in the training sessions, whether caused by the negligence of Releasees or otherwise. For example, I specifically agree to indemnify and hold harmless the Releasees from losses they may incur as a result of my injuring another person or damaging another person’s property while participating in the training sessions or while employed through any other security company when licensed through Perfect Precision Security & Firearms Training Academy LLC,. It is further understood and agreed that if I am NOT hired by Perfect Precision Security & Firearms Training Academy LLC, upon completion of my training program that Releasee WILL NOT be liable for any actions I may take while employed by any other security company when licensed through Perfect Precision Security & Firearms Training Academy LLC.

You acknowledge that you have carefully read this “Waiver and Release” and fully understand that it is a RELEASE OF LIABILITY AND INDEMNIFICATION. You expressly agree to release and discharge the trainer of instructor, as well as Perfect Precision Security & Firearms Training Academy LLC, from any and all claims or causes of action and you further agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the trainer or instructor, and Perfect Precision Security & Firearms Training Academy LLC, for personal injury, illness, and or death.

To the extent that statute or case law does not prohibit release for negligence, this release is also for negligence.

If any portion of this release from liability and indemnification shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability and indemnification shall remain in full force and effect and the offending provision or provisions severed here from.

By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.

ATTENTION ARMED SECURITY GUARDS

If you are a security guard applicant and require a handgun permit, please be advised the handgun permit application process is completely separate from applying for security guard certification. Security guards applying for a handgun permit for the purposes of employment must utilize the Maryland State Police Portal to apply online for a handgun permit. A separate set of Livescan fingerprints, passport photos and fees must be submitted to apply for a handgun permit. Security guard applicants are also encouraged to apply for their security guard card prior to applying for a handgun permit.
