F.A.V.O.R. - Adoption Contract

Thank you for adopting a dog! We find it's best to have a few things written down so that we both know what we’re agreeing to, who should do what, and what happens if things go wrong. In this contract, you won't find complicated legal terms or long passages of unreadable text. We want you to understand what you’re agreeing to, and don’t want you to sign something that you might later regret or don’t understand.

Adopter’s Acknowledgement of Terms

I, the “Adopter,” hereby acknowledge the receipt of the above described animal and therefore understands and agrees to the following terms listed below.
Fee*

The adoption donation is not a fee or sale price, but a request to reimburse the Rescuer for any and all medical expenses, or any other expenses incurred to consider the Dog for adoption. Fees are applied towards spaying or neutering the Dog, wellness visit, up-to-date vaccines, microchip, state health certificate, and transport costs. The donation also allows the Rescuer to continue to rescue animals in need. There will be no refunds of adoption donations.
Spay/Neuter*

The Dog is spayed/neutered.
Microchip/Vaccines*

The Dog is microchipped. The Dog has been tested for heartworm and lyme disease. The Dog has all age-appropriate vaccinations including rabies, distemper/parvo and bordatella. Additional booster shots may be required depending on the age and weight of the Dog at the time of initial vaccinations.
Health*

After the completion of the adoption, the Dog must be seen by a veterinarian within 10 days of the adoption date so that the Dog can get established at a veterinary facility and so records and a relationship can be initiated.The Dog is adopted with a state-issued health certificate of good health to travel, however, the Adopter understands that the stress transport can often lower the immune system causing viruses (kennel cough) to be contracted, as well as the emergence of parasites (coccidian, giardia, or hookworms). The Adopter will be responsible for treatment of any medical expense that presents after adoption.The Dog shalll have yearly documented physical examination at a veterinary clinic by a licensed veterinarian. The Dog shall have any pertinent care, including but not limited to annual vaccines and blood work, as deemed necessary by the attending veterinarian. The Dog shall always be up-to-date on the rabies vaccine as required by law. The Dog shall remain on heartworm preventative for the rest of the entire lifespan of the Dog.The Rescuer reserves the right to check with the veterinarian at any time to verify that all the basic health requirements are being done, that heartworm preventative has been purchased and that the Dog has a yearly heartworm blood test.
Cosmetic Surgery*

Unless directed by a licensed veterinarian for reasons related to the health and welfare of the Dog, cosmetic surgery will not be performed under any circumstances, including but not limited to tail docking, ear cropping or de-barking.
Temperament*

The Rescuer makes no explicit or implicit guarantees in reference to the health and/or temperament of the Dog. The Dog is adopted “as is” and the Adopter assumes all responsibility for the treatment of any and all existing conditions or any other conditions of physical or temperament changes that may occur.
Training*

The Dog will be a family member only and only participate in basic and advanced obedience training, good citizen training, search and rescue training, therapy dog training, or service dog training. While we cannot require training, we highly recommend training to create a positive relationship, learn life skills, increase sociability, avoid problem behaviors, and to build an overall solid foundation for the Dog.Under no circumstances will the Dog be trained to develop dual personality, nor will the Dog be encouraged to show any aggression, agitated, or territorial display of behavior. In addition, no protection, attack, or guard dog training is permitted.If training has already begun with the Dog, the Adopter will continue the training protocol set by the organization and continue working with recommended trainers.
Collars, Tags, and Leashes*

The Dog shall be required to wear a secure collar with the rabies tag, identification tag displaying name and contact phone number at all times.A leash is required when the Dog is taken out in any public or residential area which enforces a leash law or any area which requires total control over the Dog at all times.In the event that the Adopter wants to use a pinch, choke, or similar training tool, the Adopter is required to get proper training with a certified dog trainer. The Dog will NOT wear a pinch, choke, or similar training tool as a permanent collar, but only as needed for WALKING as instructed by a certified dog trainer.In the event that the Adopter wants to use an electronic collar or vibration collar, the Adopter is required to use a certified dog trainer for proper training and how to acclimate and correct the Dog safely. We recommend the Mini Educator E-Collar systems.In the event that the Adopter wants to use an electronic fence collar, the Adopter is required to use a certified professional for proper installation and training.
Food & Water*

The Dog shall have free access to clean drinking water at all times and adequate food on a regular meal schedule. The Adopter will learn about the importance of a healthy corn-free diet, higher quality kibble, cooked, or raw diet, and the importance of maintaining a healthy weight on a dog. If the Dog becomes overweight, the Adopter will seek help from a licensed veterinarian to help monitor and control the Dog’s weight for the long term health and safety of the Dog.
Exercise*

The Adopter agrees the Dog will be exercised properly, promising to provide the Dogs with adequate daily walks and playtime. The Dog will be let out to relieve him/her at least 3-5 times per day every day.
Environment*

The Adopter agrees the Dog will be kept as a domesticated house pet. The Dog shall reside indoors, in the Adopter’s home, and live as a family member and companion only. The Dog is not to be left with small children at any time without adult supervision.When the Adopter is home, the Dog is not to remain solely in one room, not to be confined to either the crate or a room, except for nap and bedtimes, and must have free roam of the house as a family member.The Dog may be confined to a crate, kennel, or room such as a bedroom or any other room of adequate size while the Adopter is not home, but not for more than six hours during the day. The crate or kennel must be large enough for the Dog to stand up in, and turn around in, as well as having proper floor of the crate for the Dog to lie comfortably on its side. The Dog is not to live in a garage, doghouse, or any type of outside shelter.The Dog will not be kept outdoors during the Adopter’s working hours, or at any other time left alone outdoors while the Adopter is not at home. The Dog will not be left outside loose or unrestrained in an unfenced area without adult supervision. The Dog will not be chained to a doghouse or chained outside to any type of object or outbuilding. When the Dog is outside alone, the Dog must be restrained by a fence or an appropriate lead.The Dog will not ride in the back of a pickup truck under any circumstances, including in a crate/kennel or tied down. The Dog will not remain in any vehicle in extreme heat or colls, with windows down, or unattended for any extended amount of time.The Adopter will not to expose the Dog to harmful objects, poisons, or other living creatures that may endanger the Dog’s life. The Adopter will refrain from physical abuse of the Dog and from otherwise treating the Dog in an inhumane manner.
Transfer of Ownership*

The Dog shall NOT be sold, given to, or adopted to anyone else, nor transferred to any firm, corporation, or organization of other homeless animals, such as shelter facility or research facility.If the Adopter must re-home the dog, the Rescuer must be made aware of the change of ownership.If the Adopter requires the help of the Rescuer for rehoming purposes, the Rescuer will charge a fee to be used towards supplies, vetting, and training with a professional.Violation of this agreement will result in court costs and attorney fees payable by the Adopter, if necessary, for the Rescuer to redeem the Dog.
Change of Address & Other Notifications*

The Adopter agrees to notify the rescuer no less than ten (10) days prior to change of address or change of environment that will affect the Dog.The Adopter agrees to to notify the rescuer of any incident involving animal control and/or complaints arising from ownership of the Dog. The Adopter agrees to notify the rescuer if the Dog becomes lost, seriously injured, and/or permanently disfigured, or for any reason the Dog dies.
Rescuers Reservation of Rights*

The Rescuer reserves the right to follow up on this adoption via email or phone during the entire lifespan of the Dog for the sole purpose of determining whether the Adopter is abiding by the terms of this contract.If the terms and conditions of this contract are not upheld by the Adopters and/or any misrepresentations have been made to/by the Adopter, rescuer reserves the right to terminate this contract and the Adopter will agree to allow a representative of the rescue to reclaim the Dog without notice or refund.
Remedy for Non-Compliance*

In the event it appears to the rescuer that the Dog is not getting proper and humane care as specified by the terms of this contract or in breach of the terms of this contract in any way, the Dog may be taken by a representative of the rescue without notice or refund, or through a claim and delivery service.
Costs of Enforcement*

Should it become necessary for us to take action to recover an adopted dog or otherwise enforce the adoption contract agreement, the Adopter will be responsible for all claim and delivery service fees, court costs and all fees for the Adopter’s attorney and for the rescuer’s attorney.
Right of Ownership*

The Dog adopted from the Rescuer is “sole property” of the Rescuer and was surrendered by private owners or animal facilities that have signed a statement agreeing that the Dog is not owned property of any other person, firm, or organization. The Rescuer shall not be held liable, charged, or chargeable for any misrepresentations unknown to the Rescuer.
Upon adoption, I agree that:*

I will visit a licensed veterinarian within 30 days of the date on this contract.I will register my contact info with the microchip company within 10 days of the date of this contract.I will provide written permission from the landlord consenting to the Dog adoption (if applicable).I will keep the Rescuer informed of my current address, telephone and email information for the life of the pet.I will give the Rescuer permission to call my home at any reasonable hour to ensure that the animal is being properly cared for. If for any reason I am unable to provide care for the animal, I agree to return the animal to the Rescuer.I will NOT offer the animal for sale under any circumstances and I will not give the animal to a third party without the express written consent from the Rescuer.The Rescuer will have the right of immediate repossession of the animal if, in the judgment of the Rescuer, the animal is receiving inadequate care or is being improperly housed or handled.
Upon adoption, I hereby declare:*

I accept possession, legal guardianship and responsibility for the Dog in this contract and discharge the Rescuer forever from liability for any injury or damage to any person or property caused in the future by said animal, and from any causes of action, claims, suits or demands whatsoever that may arise as a result of such injury or damages.I am aware that the Dog is different from human beings in their responses to human action.I am aware that the Dog must be supervised when interacting with children.I am aware that the Dog’s actions are often unpredictable.I am aware that the Dog’s behavior may change after it leaves the shelter, boarding, foster home or other environment and accustoms itself to its new environment.I am aware that the Rescuer makes no claims or guarantees about the animal’s age, temperament, or health and is not responsible for future damages or injuries caused by or suffered by the animal.I am above the age of 22 at the time of this adoption.I have discussed the adoption with all household members, and we have all agreed to the adoption of the Dog, and that all household members will abide by the terms of this contract.I have never been subject to legal action or investigation for cruelty to or neglect of animals or for domestic violence.I have never owned an animal that has been confiscated by an animal control officer or humane organization for violations of state or local animal control regulations or animal adoption agreements.
