I herby warrant and acknowledge that Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) will take reasonable steps to ensure that all services provided are of an acceptable standard, however, Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) cannot accept liability for physically injury, loss, damage or expense resulting from any event whatsoever.

By agreeing to participate in any Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) event, tour, workshop or safari, each participant indemnifies and holds harmless Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours), its Agents, Employees, Shareholders, Officers, Directors, Attorneys, Contractors and Suppliers as set forth in the following paragraphs.

Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) acts only as an Assistant/Consultant for the participant in regard to travel, whether by railroad, motorcar, motor coach, boat, airplane, or other means, and assumes no liability for injury, damage, loss, accident, delay or irregularity caused by defect in such vehicles or for any reason whatsoever, including the acts, defaults or bankruptcies of any company or person engaged in conveying the passenger or in carrying out the arrangements of the itinerary.

Losses, Travel Insurance and Additional Expenses:

Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) strongly advises that participants purchase comprehensive travel insurance. Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) accepts no responsibility for losses or additional expenses due to tour rescheduling, delay or changes in air or other services, sickness, weather, strike, war, travel restrictions, medical outbreak or pandemic, quarantine, natural disaster, terrorist activity or other causes. The participant shall bear all such losses and expenses.

Personal luggage & photographic equipment is solely the participant's responsibility at all times.

Each participant is personally responsible to ensure they have the necessary passports, visas, vaccines, Covid testing and other travel documents required for their specific itinerary and the countries they will travel to and/or through during the trip. The costs associated with theses items are the responsibility of the participant.

Health and Medical Disclaimer:

a.) I accept sole responsibility for establishing all health precautions, along with my health practitioners, required for the intended event, tour, workshop or safari that I will undertake with Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours), to any destination whatsoever, in the world. This includes, but is not limited to ensuring that I am personally responsible for acquiring all the required vaccinations for my intended destination.

b.) I am aware of the hazards specific to my travel destination. I understand that should I become sick or injured at any time during the workshop, tour or safari, any required medical care and any form of transport will be at my own expense. If I am unable to travel due to injury or illness and/or require medical care or quarantine, I understand that the tour will continue as scheduled without me and that there will be no refund for any uncompleted portion of the trip.

*COVID-19 Preparedness:

I understand that the Covid-19 virus has caused a worldwide pandemic and I am fully aware of the risks associated with this virus and traveling at this time. I accept that it is my personal responsibility to understand the requirements of the local government at my intended destination as it pertains to vaccination, testing upon arrival and/or departure, quarantine, any other regulation, as well as those of the country I will be returning to at the conclusion of my workshop, tour or safari. Should I become infected with Covid-19 during the tour, workshop or safari I understand that I will be required to comply with the directives of the local government who has jurisdiction and will in no way hold Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) liable. If I am infected with Covid-19 I understand that the tour will continue as scheduled without me and that there will be no refund for any uncompleted portion of the trip. In the event of this happening I understand that all costs for transportation and medical care will be my own responsibility.

All participants traveling with Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) are required to follow local laws, ordinances and protocols at all times. It is the responsibility of the participant to be familiar with all local protocols related to COVID-19, including but not limited to vaccine requirements, vaccine documentation requirements, testing requirements, quarantine periods and masking requirements. It is the responsibility of the participate to make travel arrangements that allow testing and quarantine before the tour begins as required by local laws, ordinances and protocols. If necessary, it is also the responsibility of each participant to arrange for Covid testing prior to returning to the USA. Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) cannot adjust itineraries to accommodate participants who failed to follow local requirements (such as pre-travel and post-travel testing). Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) is not responsible for the enforcement of local laws, ordinances or protocols. Please do not travel if you are sick.

Covid-19 Group Travel Policy:

Once the tour has officially begun all participants, (as well as our guides and drivers), will become part of our group collective. As required by the law of the local jurisdiction for each respective destination, all participants, guides and drivers will be tested prior to the beginning of the itinerary. Participants, guides and drivers in our group will not be required to wear a face covering when in private vehicles occupied exclusively by our group. Nor will they be required to wear a mask in accommodations when contact is limited to our group members, unless ordered by local laws, ordinances, mandates or protocols. Meals are often conducted in a public setting. If masks are required to get to our appointed table, then participants will be obligated to do so. Once seated as a group, guest will be free to remove their masks. Public transportation, hotel lobbies, shops and stores will often require masks and participants should ensure they have one available as needed. Should participants elect to wear a mask once they are in the group setting, they are welcome to do so. Participants are not to create conflict based on another’s decision to wear, or not wear a mask once in the group setting.

Purpose and Rules of Participation:

I am participating in a trip with Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours) as a hobbyist. I hereby declare that the photographs taken by me are not for commercial use, nor is the area knowledge and photos for the purpose of organizing or promoting a future workshop, photo tour, safari or similar trip.

I agree not to promote my business, print sales, photo workshops, tours and safaris or in any other way market to Wicked Good Photo Tours participants at any time.

Disruptive or Uncooperative Participants:

Our photo tours are intended to be enjoyable for all participants. Each participant shall conduct themselves in a civil manner towards Nathaniel Smalley, each of the other participants and any guides or outfitters working with Wicked Good Photo Tours, as well as tourists and local residents. We have a zero tolerance policy for rude or aggressive behavior. I will offer one warning before an offending client will be required to leave the group without any refund whatsoever. Under these circumstances it will be your own responsibility both physically and financially to make arrangements to leave the group effective immediately.

Within his sole discretion and determination, Nathaniel Smalley of Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours), reserves the right to terminate the photo tour, workshop or safari(s) without any refund or financial assistance to any person whose conduct is disruptive, harasses or otherwise interferes with the ability of other participants to enjoy their experience; and/or of any person who fails to comply with instructions from, or is otherwise uncooperative with Nature Odyssey Worldwide instructors, staff or its outfitters. All expenses associated with dismissal from a photo tour, workshop or safari are the responsibility of the participant.

I acknowledge that Nathaniel Smalley Photography LLC (DBS Wicked Good Photo Tours) reserves the right to refuse service to anyone without explanation.

Acceptance:

I accept your ‘Standard Conditions of Contract’ and I voluntarily assume the risk inherent in taking part in this trip.

I, together with my Heirs, Executors and Administrators hereby release Nathaniel Smalley Photography LLC (DBA: Wicked Good Photo Tours), it’s Officers, Outfitters, Suppliers, Agents and Representatives, from any duty or care towards me, in connection with my participation in any trip and from liability of all or any claims that could accrue to me or my Heirs, Executors and Administrators arising out of my participation in the tour or in any related activities irrespective of whether such claim or claims arose through the negligence of any person or from any of the risks, dangers or hazards inherent in this trip, or of any loss of, or damage to, any property from any cause whatsoever and I further indemnify and hold harmless associated persons against any claims howsoever the same may arise.
