TERMS AND CONDITIONS

Purpose: This constitutes an order of videography/photography services between contracting parties referred to as “client” and Sure Shot Video + Photo (referred to as Sure Shot) and its employees, contractors, and sub-contractors. It is a two-page agreement.  It is understood that any samples of our work remain the property of Sure Shot and may be used for advertising and display.  

Model Release: The contracting party grants Sure Shot the unrestricted right to copyright, use, and publish videos and photos of the contracting party for commercial, promotion, competition, or other purposes without compensation or liability. It is the responsibility of the client to advise all participants/attendees that the event will be videotaped. All parties attending the event will be considered as consenting to be included in the final video or photos and/or commercial promotional materials.     

Editing: The client grants Sure Shot full production and editorial control regarding all aspects of production. In the case of a particular segment of the event that is either not recorded, partially recorded, or not part of the final edit, it is at Sure Shot’s discretion. 

Deposit Fee: Upon signature, Sure Shot reserves the date agreed upon. For this reason, the deposit fee is non-refundable, even if the wedding date/event is changed or canceled for any reason.

Cancellation policy: We understand that things happen☹ All cancellations but be submitted 30 days prior to the event/wedding in order to receive any refunds. If cancellation is submitted after 30 days, the client is responsible for the full payment/balance.

Pre-Event Conversation: The parties agree to a pre-event conversation approximately one to two weeks before the event date in order to finalize shooting times, locations, preferences, and special requests. If Sure Shot has not contacted the client at least four days prior to the event, it is the responsibility of the client to contact Sure Shot. Failure of the client to contact Sure Shot within four days of the event makes this agreement null and void.

Location: It is the responsibility of the client to secure the permission of the church, synagogue, or venue to videotape or photograph the event. Sure Shot will give its best efforts to abide by the rules of the church/synagogue.

Copies/originals: Sure Shot plans to, but is not obligated to, retain masters of the videos and photos. (Typically 3 months)

Final Product: Sure Shot will make best efforts to give the client the best videos and photos possible, but makes no guarantee, in regards to the factors beyond our control. (i.e. weather conditions, fire, or acts of God)

Artistic Style: The client acknowledges that the Photographer/Videographer requires and retains discretion as to how its services shall be provided (e.g. choice of poses, lighting, lenses, etc.); that Client is familiar with the Sure Shot’s portfolio and is requesting our services with knowledge of Sure Shot’s style; that Sure Shot work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the images created may be different from images taken by us in the past; and that in creating the images, we shall use be personal artistic judgment to create images consistent with her personal vision of the wedding, which vision may be different from the Client’s vision of the wedding. Accordingly, the Client acknowledges that the images shall not be subject to rejection on the basis of taste, esthetic criteria, or personal appearance.

We do our best: We strive to capture every moment possible, sometimes it is not possible to capture all the moments that are not part of the posed parts of the wedding.

Protection for the equipment: The client is responsible to provide adequate shelter from inclement weather and extreme temperatures. Sure Shot at its discretion reserves the right to decline service outdoors in inclement weather and extreme temperatures.

Liability: Sure Shot takes the utmost care with respect to exposure, transportation, and handling of videos. However, in the unlikely event, all of the files should be lost, stolen, damaged, or destroyed, for reasons beyond our best efforts, our liability is limited to the return of all payments received for video services.

DVD Compatibility: Sure Shot makes no guarantee that video DVDs provided will function on all computers or DVD players.

Food: The client will provide Sure Shot reps food & beverage during the event.

Travel Fees: There are no fees within the St. Louis Metro Area. Outside St. Louis, fees are $0.50 per mile.

Approval: Videos and photos must be approved within 30 days of shipping; otherwise Sure Shot assumes the client has approved the product.

Delivery times: Normal delivery times for finished product(s) are 12-16 weeks. However, during the busy season delivery time could take up to 20 weeks.

Discounts/Engagement Sessions: While engagement sessions are optional, they cannot be applied as discounts, extra package time, or additional media. They allow us to establish a connection with the couple, and if not utilized, the opportunity is lost.
