A. Session Fee
Client agrees to pay photographer a deposit of the chosen session fee at the time of booking to secure their appointment date and time. This is a non-refundable fee. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer & 5 digital downloads (for signature sessions). Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images are available at an additional cost as per our current pricing guide. Signature Session prices are as advertised.
B. Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
B. 1. Signature Sessions Rescheduling: Signature Sessions cannot be rescheduled. For signature sessions the sitting can be put towards a regular session in 30 days from the signature session date. $99.00 sitting fee & remaining amount paid towards your order.
C. Re-shoots / Refunds
Cylinda’s style is documentary, telling your story no matter what the outside influences are is her passion. That being said she wants you to be 100% satisfied and will absolutely photograph another session. However, you will need to repay the session fee. The session fee covers the time and talent of the photographer only. Since Cylinda has already invested time into your session there are no refunds to any session fees.
D. Archive
After six (6) weeks, all unpurchased images may be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
E. Payment
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
F. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
G. Model Release
For good and valuable consideration, the receipt of which is hereby acknowledged, I, hereby authorize Cylinda B Photography permission to use my likeness in a photograph in any and all of its publications, including but not limited to all Cylinda B Photography’s printed and digital publications. I understand and agree that any photograph using my likeness will become property of Cylinda B Photography and will not be returned.
I acknowledge that my participation with Cylinda B Photography is voluntary, I will receive no compensation.
I hereby irrevocably authorize Cylinda B Photography to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing Cylinda B Photography’s programs or for any other related lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, where in my likeness appears. Additionally I waive any right to loyalties or other compensation arising or relating to the use of the photograph.
I hereby hold harmless and release and forever discharge Cylinda B Photography from all claims, demands, and causes of action which I, my heirs, my representative, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
H. Copyright Policy
Any digital images that you purchase are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and social media publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Cylinda B Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.
If you are posting any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram* etc.) OR if you share or use any digital files from either Facebook or my website, you may not alter the image in any way**. *Instagram – you may not alter the image(s) in any way by adding filters.
** You may not re-edit, crop, or remove the watermark, or alter the images in any way, doing otherwise is copyright infringement.
I. Liability
Photographs at Cylinda B Photography Client will not hold Cylinda Battaglia/Cylinda B Photography responsible in case of injury, fall, get bite, plant rash etc, loss of property, or death while on the property of Cylinda B Photography at 709 Church Rd Baldwinsville, NY.
