    Dear Non-Profit Exhibitor,

    Nothing says late summer like Pittsburg’s own Seafood & Music Festival, the two-day, outdoor extravaganza that draws thousands of visitors to Pittsburg every year. We cordially invite you to apply for booth space to display and sell your original artwork at the 35th Annual Pittsburg Seafood & Music Festival. Please read through the entire package carefully as there are changes.

    This year's festival will be held Saturday, September 9, 2023 from 10:00 a.m. to 7:00 p.m. and Sunday, September 10th from 10:00 a.m. to 7:00 p.m. at the Pittsburg Marina.

    The Pittsburg Seafood & Music Festival has long been one of the keystone events in Contra Costa County. This gastronomic extravaganza features lots of tasty treats including gumbo, craw-fish, BBQ oysters, steamers, muscles, chowder, fish & chips, lobster rolls, alligator on a stick, corn on the cob and an array of all types of foods for every taste! The Pittsburg Seafood and Music Festival provides a safe and enjoyable environment for the whole family with a wide variety of activities, including but not limited to: arts and crafts on display, amusement rides for the kids, three to four live entertainment stages, jet ski races or demonstrations, beer pavilion featuring NFL football games, a wine pavilion, and so much more - insuring an crowd throughout the day!

    Our extensive promotion efforts assures coverage in all media and attendance is expected to equal or surpass the previous years. The Pittsburg Seafood & Music Festival has developed a strong exhibitor following over the years. The 100+ booths are lined along Marina Blvd, which is a level and well maintained area. There is no natural shade. The Seafood & Music Festival is a green event. As such, we do not allow standard packaging products that are not organic, compostable, or recyclable.

  • 2023 Non-Profit Booth Application - Policies, Procedures & Requirements

  • Objectives
    The 35th Annual Pittsburg Seafood & Music Festival will take place on Saturday, September 9, 2023 from 10:00am to 7:00pm and Sunday, September 10, 2023 from 10:00am to 7:00pm. The mission of the Festival is to support local worthy charities and promote the community through a quality celebration of seafood and Music. These goals will be accomplished by showcasing many unique quality Vendors that showcase our theme.

    Non-Profit Vendor Booths
    Only a few Non-Profit Booths are available. Vendors are required to supply their own booth and must submit a picture of their set-up with application. All booths must meet the standards set by the 2023 Pittsburg Seafood & Music Festival Committee, Contra Costa County Department of Environmental Health and the Fire Marshall. Booth size and appearance must be pre-approved. 

    All items you wish to give away to festival patrons must be approved by the Pittsburg Seafood & Music Festival Committee. In order to qualify you must be approved by the Seafood & Music Festival Committee, and agree to follow all rules and guidelines. No food or beverages, including water, are allowed to be given or sold. If you are found to be selling any of these items, you will be asked to leave the festival and no refunds will be made. 

    Application Deadline
    Applications have been extended to 5:00pm PST, Thursday, August 15, 2023! 
    Fees will be accepted only after an application has been approved by the Committee and a billing notice issued. Payment in full must be received by Thursday, August 29, 2023. Failure to meet this deadline will incur late fees and may result in loss of booth space.

    Screening

    1. Applicants must submit four (4) photographs. (1) photo of their booth display, (2) photos of their merchandise/or give aways, and (1) photo of marketing materials.
    2. A committee will screen applicants from the photographs only. The committee will select the highest quality vendors based on the following criteria: Quality of items being given out to festival patrons, marketing materials, quality of merchandise sold and quality of booth display.
    3. Past participation in the Festival does not guarantee acceptance and booth spaces are assigned on a first come first serve basis. Seniority or past participation will not apply in space selection.
    4. Applicants will be notified via e-mail in July-August as to whether they are accepted or not. Those accepted will receive additional information, such as location assignment, parking, location maps, etc.
    5. No food or beverages, including water, are allowed to be given or sold. If you are found to be selling any of these items, you will be asked to leave the festival and no refunds will be made.
    6. Only merchandise of the type submitted may be sold/given.
    7. The Committee reserves the right to reject any applicant if they feel the quality or nature of the display does not complement the Festival, or is significantly different from representative images submitted.
    8. All non-profit vendors are responsible for providing all needed equipment and extension cords. (WE ENCOURAGE YOU TO BRING A BACK UP GENERATOR IN CASE OF POWER FAILURES). All equipment and extension cords must be in good working condition, UL Listed and meet electrical requirements. Power is limited; therefore, if you do not select Power/Electricity option below, power will not be available to you.
    9. No booth, tables, chairs, or canopies will be supplied. Only a 10' x 10' space will be provided. 
    10. The Pittsburg Seafood & Music Festival will provide overnight security; however, the Pittsburg Seafood & Music Festival, Pittsburg Chamber of Commerce, and City of Pittsburg, will not be responsible for lost or missing items from your booth.  We recommend all valuables be removed at the end of the day. 

    Vendor Fees:

    A $25.00 non-refundable application fee must be submitted with this application. The Festival only accepts credit and debit cards as part of the online submission process.

    Business/Merchandise booth space is available for:

    • Non-profit/charitable organization: $310 (10' wide x 10' deep) - Including $10.00 city license fee.
    • Non-profit/charitable organization & Chamber member: $210 (10' wide x 10' deep) - Including $10.00 city license fee.
    • Non-profit/charitable organization: $360 (15' wide x 10' deep) - Including $10.00 city license fee.
    • Non-profit/charitable organization & Chamber member: $260 (15' wide x 10' deep) - Including $10.00 city license fee.
    • Non-profit/charitable organization: $410 (20' wide x 10' deep) - Including $10.00 city license fee.
    • Non-profit/charitable organization & Chamber member: $310 (20' wide x 10' deep) - Including $10.00 city license fee.
    • $50.00 - Additional fee for corner space - (A limited number of corner spaces are available).
    • $125.00 - Liability Insurance Fee (Unless you can provide your own insurance with a signed release & waiver form, certificate of insurance naming the City of Pittsburg & The Pittsburg Chamber of Commerce as additionally insured including a letter of endorsement).
    • $50.00 Power/Electricity - 110 volt service per location (If needed).

    Liability and Security

    1. Vendors are to provide their own displays, tables, racks, shade, etc. We ask that displays be orderly and aesthetically pleasing. Displays must be set up and ready no later than 9:00 a.m. on Saturday.
    2. The Seafood & Music Festival is a green event. As such, we do not allow standard packaging and or marketing products that are not organic, compostable, or recyclable.
    3. There is no electricity in the non-profit vendor areas. The use of generators, batteries and amplified music is prohibited. Battery-operated fans are allowed.
    4. Merchandise must not be removed from the booth until the Festival is closed to the public. Vendor agrees to remove all booth material and clean up vendor space by 8:00 p.m. Sunday, September 10, 2023.
    5. Artist agrees to accept responsibility for all materials and goods furnished by him/her, and used or displayed in the booth area. While the Festival will make reasonable efforts to provide security, the exhibitor accepts full responsibility for his/her personal property.
    6. If you decide not to participate, kindly notify the Pittsburg Seafood & Music Festival immediately. This way we can offer your space to another vendor.
    7. Payment is due Thursday, August 29, 2023. No exceptions. Space will be reassigned. Once notified of acceptance, an vendor's fee will not be refunded if he/she withdraws from the Festival, unless the committee is notified by August 18, 2023 and there is just cause for such a request. No refunds after August 18, 2023.
    8. If an artist fails to open his/her display in the space assigned by 9:00 a.m. Saturday, September 9, 2023 the committee reserves the right to assign that space to someone else.
    9. No animals are allowed on Festival grounds.
    10. Vendors must comply with all applicable Federal, State and local statutes and ordinances, and agree to assume full responsibility for the payment of all sales taxes occasioned by use of booth space.
    11. Vendors must provide a valid California State Resale Permit Number no later than August 15, 2023.
    12. The Liability Insurance fee of $130.00 will be waived if you provide a $1,000,000.00 Certificate of Insurance naming the Pittsburg Seafood & Music Festival, Pittsburg Chamber of Commerce and the City of Pittsburg as an additional insured along with a letter of endorsement. If approved, you must submit the valid Certificate of insurance to the Pittsburg Chamber of Commerce office no later than August 15, 2023.
    13. You, THE VENDOR, must be in attendance at your booth during the hours of 9:00 a.m. to close on both Saturday, September 9th and Sunday, September 10th. Do not send friends, family or paid representatives to replace you. Your presence is required. Bring enough inventory for two (2) days. If you leave early you will not be allowed to participate the following year.
    14. No food or beverages, including water, are allowed to be given or sold. If you are found to be selling any of these items, you will be asked to leave the festival and no refunds will be made.
    15. The Pittsburg Seafood & Music Festival will provide overnight security; however, the Pittsburg Seafood Festival, Pittsburg Chamber of Commerce, and City of Pittsburg, will not be responsible for lost or missing items from your booth.     Statutory Requirement

    You are required to provide proof of general liability certificate in the amounts specified above naming the Pittsburg Chamber of Commerce and the City of Pittsburg as additional insured. You must also include an endorsement letter with your certificate of insurance, OR you may purchase general liability insurance from the Chamber for for $130.00 to cover this special event.

    On behalf of all vendors participating in the 2019 Pittsburg Seafood and Music Festival, the committee has declined Terrorism Risk Insurance coverage associated with the General Liability policy for this event. The cost of this coverage is an additional $5.16 per vendor. Please see the attached mandatory notice from our insurance broker and explains in detail the requirements of the US. Federal Terrorism Risk Insurance Act of 2002, enacted November 26, 2002 (TRIA).

    Should you have any questions regarding the declination of coverage, the Pittsburg Chamber of Commerce at (925) 432-7301. You also are responsible for providing the stated amount of automobile liability insurance. For more information, contact the Pittsburg Chamber of Commerce staff.

    Terrorism Risk Insurance Act Notice Disclosure: We are providing this Notice in compliance with the requirements of the US. Federal Terrorism Risk Insurance Act of 2002 enacted November 26, 2002 (‘TRIA”). TRIA requires that we offer coverage for certain losses (the “TRIA Terrorism Losses”) that result from an “act of terrorism” (as defined in TRlA). Based on our written quotation to you (the “Quote”), your coverage of terrorism losses would not be broader than coverage of TRIA Terrorism Losses. The specific charge for including coverage of TRIA Terrorism Losses is shown on your quotation form. TRIA provides that the U.S. Government will share in the payment of the compensation of insured TRIA Terrorism Losses. Subject to the terms and conditions of TRIA, the US. Government’s share in the payment of compensation of any TRIA Terrorism Losses which we insure will be equal to 90% of that portion of such TRIA Terrorism Losses that exceeds a statutorily-determined amount which we will pay without U.S. Government compensation. The applicable policy limits will apply to our coverage of TRIA Terrorism Losses, but TRIA also limits the liability of both the U.S. Government and insurance companies like us for the payment of compensation of TRIA Terrorism Losses if the aggregate amount of the insured TRIA Terrorism Losses of all policyholders exceeds $100 billion in either the period from November 26, 2002 through December 31, 2003 or any subsequent annual period covered by TRIA.

  • 2023 Pittsburg Seafood & Music Festival Release Waiver of Liability and Indemnity Agreement

  • This Agreement is made:

  • in the City of Pittsburg, County of Contra Costa, by and between:

  • hereinafter referred to as “Participant” and the Pittsburg Chamber of Commerce, its officers, directors, employees, agents, and representatives, all hereinafter referred to as “the Chamber.” IN CONSIDERATION FOR THE PARTICIPATION in the 2023 PITTSBURG SEAFOOD & MUSIC FESTIVAL, the parties hereby agree as follows:

    1.Participant hereby releases, waives, and forever discharges both the Pittsburg Chamber and the City of Pittsburg from any and all claims, demands, causes of action, damages, losses, costs, attorney’s fees and expenses of any kind or nature whatsoever known or unknown which Participant have or may have against either the Chamber and/or the City of Pittsburg resulting in any way from Participant’s involvement in or merely attendance at the Pittsburg Seafood Festival.

    2.Participant hereby agrees to indemnify, hold harmless, and defend both the Chamber and the City of Pittsburg from and against all past, present and future claims, demands, causes of action, obligations, losses, liens, costs, expenses, attorney’s fees, liabilities, injuries and damages of any kind or nature whatsoever brought by any person or entity arising out of or connected in any way with Participant’s involvement in or attendance at the Pittsburg Seafood & Music Festival, whether caused solely or partially by a Participant or any other person or entity.

    3.This Agreement may be pleaded as a fully and complete defense to any action or proceeding, as the basis for abatement of, or injunction against, such action or other proceedings, and as the basis of a cross-complaint for damages. Participant’s specifically waives his or her rights under California Civil Code 1542, which provides as follows:

    “A general release does not extend to the claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

    4.This Agreement shall be interpreted in accordance with and governed in all respects by the laws of the state of California with venue agreed to be in Contra Costa County, California. Moreover this Agreement shall be binding upon and inure to the benefit of the heirs, executors, administrators, trustors, trustees, beneficiaries, predecessors, successors, assigns, partners, principals, agents, and all persons or entities connected in any way with Participant without limitation. If any provision or any part of the Agreement shall, for any reason, be held to be invalid, unenforceable or contrary to the public policy or any law, then the remainder of this Agreement shall not be affected thereby.

    5.Each party has read and understands this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and has voluntarily signed the same.

    Hold Harmless Agreement

    Booth Vendor shall be solely responsible for any and all injuries to persons or damages to property or any other injury, claim, damage or loss of whatever nature, arising from or related to the Festival. Booth Vendor shall indemnify, save and hold harmless the Pittsburg Chamber of Commerce and the City of Pittsburg, its employees, agents and volunteers from and against all liability, loss, damages, claims, costs, and expenses (including reasonable attorney's fees) arising out of injury to person (including death) or damage to property or any other injury, claim, damage, loss, cost or expense arising from the Festival performed by vendor including, but not limited to, any negligence, act or omission of vendor.

    Memorandum of Understanding

    I understand that the Pittsburg Chamber of Commerce, its Board of Directors, staff and the City of Pittsburg will not be responsible for any lost, stolen, or damaged materials and/or merchandise. I have read and fully understand and agree to comply with the policies and procedures included in this application. My submission of this application constitutes a digital signature. I understand that violation of the rules and procedures will result in my removal from the Festival without refund. 

    If your application is accepted, you will receive additional information regarding fee payment, location, I hereby agree to the above and wish to submit my application.
