COMPLETE RELEASE OF LIABILITY AND INDEMNITY AGREEMENT ROARING FORK CYCLING, INC.
(Read completely before signing)

“Me”, “Myself”, and “I”, means the adult, being at least 18 years old, who is accepting the terms and conditions of this release contract on my own behalf, or on behalf of a minor child in my legal care and/or another adult. The person, whether Me, a minor child in my legal care, or another adult taking, part in the “Event” that is a subject of this Release as described below is referred to herein as the “Participant”.

This release relates to the Event. I understand that the Event is or includes one or more bicycling-related activities, programs or instructional courses, and may involve, without limitation: bicycle riding instruction, training or race events; activities involving training and use of bicycles and bicycle-maintenance tools and equipment; bicycle trail design, maintenance and construction work including use of related tools and equipment; bicycle-related community service projects; social events; and other activities, all as sponsored, directed, supervised or otherwise related to Roaring Fork Cycling, Inc., (sometimes also referred to in this release contract as “RFC”) and its youth cycling education and training program.

I agree and understand that bicycling, in all its various forms, involves strenuous physical activity and is an inherently hazardous sport that has many dangers and risks, and that injuries are a common and ordinary occurrence for participants of this sport.

I acknowledge and understand that the Event is not only a bicycling activity, but will includes MOUNTAIN BIKE TRAINING and COMPETITION and related activities which are ESPECIALLY HAZARDOUS bicycling activities that GREATLY INCREASE THE INHERENT HAZARDS and RISKS of bicycling.

I agree and understand that there are inherent and other risks associated with participating in the Event, and recognize that it is impossible to delineate every possible risk. Possible risks include, but are not limited to: the Participant’s experience, skill, and physical and emotional condition; uneven, slick, rocky, or other irregular surface conditions; high elevation; marked and unmarked obstacles, structures, ramps, jumps, geographic and geologic features (both natural and manmade and in good or defective condition); rugged mountainous terrain; unpredictable and varying weather, temperature and visibility conditions; riding at high rates of speed; dehydration or inadequate nutrition; acts or failures to act of other participants; contact with other trail users on foot, bike, animal or other means of transportation; contact with dangerous wildlife; the use of or contact with tools or equipment (both in good or defective condition and as may malfunction, fail or break during correct use or misuse); crossing public roadways; risks associated with social activities and games; such as rock climbing, swimming, pick-up sports, and such similar activities associated with the Event.

I agree and understand that the Event will be held at various locations throughout Eagle, Garfield and Pitkin counties, or at any other locations, including private lands. I acknowledge that when, under Colorado law, private landowners either directly or indirectly, and without charge, invite or permit RFC, Me, or the Participant to enter their private property for recreational purposes as part of the Event for recreational purposes, those landowners are not and shall not be charged with a duty of: 1) providing any assurance that the premises are safe for any purpose; 2) conferring upon Me or the Participant the legal status of an invitee or licensee to whom a duty of care is owed; 3) assuming responsibility or incurring liability for any injury to person or property or for the death of any person, including Myself and the Participant, caused by an act or omission of any other person; and, 4) inspecting the land for any potential hazardous or dangerous conditions, natural or manmade, whether known or unknown to the owner.

I expressly understand that drop off and pick up zones present an inherent danger to Myself and the Participant and related parents, guardians, agents and other individuals, along with all vehicles owned or controlled by said persons, present at drop off and pick up zones. I hereby agree that I am fully responsible for the welfare of Myself and the Participant during drop off and pick up, and that if I leave the Participant without supervision at the drop off or pick up zones, or if I authorize the Participant to leave the Event unsupervised after its conclusion, I am still fully
responsible for the welfare of the Participant. Any injury, damage or loss to person or property of Myself or the Participant is included in the claims and rights which are fully waived and released under this release.

IN CONSIDERATION for the Participant be included in the Event, I hereby knowingly and voluntarily agree to accept the terms and conditions of this contract and release agreement. I hereby ASSUME ALL RISKS in connection with My and/or the Participant’s presence and/or participation at or in the Event. I release Roaring Fork Cycling, Inc., a Colorado Nonprofit Corporation, and each of its representatives, agents, affiliates, officers, directors, servants, employees, volunteers, and any owner of land who either directly or indirectly invites or permits Me or the Participant to use such property for recreational purposes of and from ALL LIABILITY for any injuries or damages, and from any claim made by me, my family, estate, heirs and assigns arising in any way from my attendance or participation in the Event, including any claim based upon NEGLIGENCE. I hereby expressly agree that RFC employees (including team coaches and volunteers) are not responsible for transportation or supervision of Me or the Participant at any time. In the event that I ask a RFC employee to provide any such supervision or transportation for Me or the Participant, which may include private or public means of transportation, I hereby acknowledge that RFC and its employees are not responsible and shall not be held liable for any resulting injury or claim.

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Roaring Fork Cycling, Inc., its representatives, agents, affiliates, officers, directors, servants, employees, and volunteers of and from any claim, action, harm, injury, damage, or loss to person and/or property which I or the Participant may suffer, or which I may contribute to or cause to any third parties. By signing on behalf of a Participant other than Myself, I hereby represent to Roaring Fork Cycling, Inc. that I have the authority to enter into this release contract on behalf of said Participant and on behalf of any other parent or guardian of said Participant and agree to defend and indemnify and hold harmless Roaring Fork Cycling, Inc. from any and all claims arising from this release brought on behalf of said Participant or any other parent/guardian thereof, even after the Participant has attained majority age, or from third parties injured by the Participant, and hold Roaring Fork Cycling, Inc., its representatives, agents, affiliates, officers, directors, servants and employees harmless from any such claim, legal action, harm, injury, damages or loss to person and/or property.

I AUTHORIZE Roaring Fork Cycling, Inc., its employees, agents or representatives, to call for medical care for Me or the Participant, or to transport either of us to a clinic or a hospital if such action is necessary in their opinion. I agree that at such time as I am allowed to transport myself, or I or the Participant are turned over to any ambulance, other medical transport, medical facility, clinic or hospital, Roaring Fork Cycling, Inc., it employees, agents, or representatives, shall have no further responsibility for Me or the Participant. I AGREE TO PAY all cost associated with medical care and transportation for Myself or the Participant, and I AGREE TO INDEMNIFY and hold harmless Roaring Fork Cycling, Inc., its representatives, agents, affiliates, officers, directors, servants and employees, from such costs.

I KNOWINGLY AND VOLUNTARILY AGREE that any and all disputes between Me and/or the Participant for whom I accept responsibility herein and Roaring Fork Cycling, Inc., arising from participating in the Event, and including any claims for personal injury and/or death, will be governed by the laws of the State of Colorado and the exclusive jurisdiction thereof will be in the state or federal courts of the State of Colorado.

I understand and agree that this release contract remains in effect after today’s date, and will continue to apply whenever I or the Participant engages in or attends the Event without need for Me to sign further or additional release agreements, at least until a new release of liability and waiver is executed by Me and/or on behalf of the Participant, or I revoke this release contract in writing and that revocation is acknowledged as received and accepted by RFC.

I HAVE CAREFULLY READ THE FORGOING RELEASE AND INDEMNITY AGREEMENT, I UNDERSTAND ITS CONTENTS AND I SIGN BELOW FOR MYSELF, OR AS AN INDIVIDUAL AND
AS THE PARENT OR GUARDIAN OF THE PARTICIPANT AND ON HIS/HER BEHALF. IF ANY PART OF THIS AGREEMENT IS DEEMED UNENFORCEABLE, THE REMAINDER SHALL BE AN ENFORCEABLE CONTRACT BETWEEN THE PARTIES. I AM AWARE THAT THIS CONTRACT IS LEGALLY BINDING AND THAT I AM RELEASING LEGAL RIGHTS BY SIGNING IT.

Authorization of Background Investigation

By my signature below, I consent to preparation of background reports to Roaring Fork Cycling and its designated representatives and agents, for the purpose of assisting Roaring Fork Cycling in making a determination as to my eligibility for employment (including independent contractor assignments, as applicable), promotion, retention or for other lawful employment purposes. I understand that if Roaring Fork Cycling hires me or contracts for my services, my consent will apply, and Roaring Fork Cycling may, as allowed by law, obtain additional background reports pertaining to me, without asking for my authorization again, throughout my employment or contract period from the CBI, FBI or other reporting agencies and firms. I understand that information contained in my employment or contractor application, or otherwise disclosed by me before or during my employment or contract assignment, if any, may be used for the purpose of obtaining and evaluating background reports on me. I also understand that nothing herein shall be construed as an offer of employment or contract for services. I hereby authorize all of the following, without limitation, to disclose information about me to the reporting agency and its agents: law enforcement and all other federal, state and local agencies, learning institutions (including public and private schools, colleges and universities), testing agencies, information service bureaus, credit bureaus, record/data repositories, courts (federal, state and local), motor vehicle records agencies, my past or present employers, the military, and all other individuals and sources with any information about or concerning me. The information that can be disclosed to the reporting agency and its agents includes, but is not limited to, information concerning my employment and earnings history, education, credit history, motor vehicle history, criminal history, military service, professional credentials and licenses. By my signature below, I also certify the information I provided on and in connection with this form is true, accurate and complete. I agree that this form in original, faxed, photocopied or electronic (including electronically signed) form, will be valid for any background reports that may be requested by or on behalf of Roaring Fork Cycling. 

Photography Release

I hereby grant permission to Roaring Fork Cycling, Inc., its representatives, agents, affiliates, officers, directors, servants, and employees, to use any individual or group photographs taken of members during racing or training for publicity and brochure purposes.
